"Bank Indonesia (BI) dalam rangka menjalankan fungsinya sebagai bank sentral memiliki peran sebagai penjaga stabilitas moneter, mengatur dan menjaga kelancaran sistem pembayaran, dan sebagai pengatur dan pengawas perbankan. Namun fungsi pengaturan dan pengawasan terhadap bank yang dimiliki BI akan berpindah kepada sebuah lembaga pengawasan sektor jasa keuangan yang independen yang bernama Otoritas Jasa Keuangan (OJK) pada tahun 2010 sesuai dengan yang diamanatkan dalam Pasal 34 Undang-Undang Nomor 3 Tahun 2004 tentang Perubahan Atas Undang-undang Nomor 23 Tahun 1999 tentang BI. Lembaga ini nantinya bertugas mengawasi industri perbankan, asuransi, dana pensiun, pasar modal, modal ventura, dan perusahaan pembiayaan, serta badan-badan lain yang menyelenggarakan pengelolaan dana masyarakat.
Tugas dan wewenang OJK dalam hal pengawasan perbankan hanya berkaitan dengan aspek micro prudential seperti kelembagaan, kegiatan usaha, dan penilaian tingkat kesehatan. Sedangkan aspek macro prudential berkaitan dengan kebijakan moneter dan sistem pembayaran seperti ketentuan tentang Giro Wajib Minimum (GWM), ketentuan devisa, Operasi Pasar Terbuka (OPT) dan laporan-laporan serta pemeriksaan yang terkait dengan pelaksanaan tugas di bidang moneter dan sistem pembayaran merupakan kewenangan dari otoritas moneter BI. Dalam melaksanakan tugas dan wewenangnya, OJK perlu melakukan koordinasi dengan beberapa lembaga seperti BI, Lembaga Penjamin Simpanan (LPS), serta Menteri Keuangan bahkan Presiden agar nanti kebijakan-kebijakan yang dikeluarkan OJK dapat efektif dan efisien dalam memecahkan permasalahan di sektor keuangan.
Setelah OJK terbentuk Pengawasan perbankan akan menjadi kewenangan OJK. BI sebagai bank sentral meskipun telah terbentuk lembaga pengawasan tersebut, perannya tidak bisa dikesampingkan dalam pengawasan bank karena lembaga tersebut (OJK) tetap harus mempunyai hubungan koordinasi yang baik dengan BI, diantaranya menyangkut keterangan dan data makro perbankan yang ada. Setelah OJK terbentuk, BI akan fokus kepada kewenangan dalam hal kebijaksan moneter yaitu kebijakan untuk mencapai dan memelihara kestabilan nilai rupiah yang dilakukan antara lain melalui pengendalian jumlah uang beredar dan atau suku bunga.

BI for the agenda of implementing the function as central bank has role as monetary stability custodian, arranges and takes care of disbursement system fluency, and as regulator and banking supervisor. In Indonesia itself, it is likely the function of regulation and supervision to bank owned by BI will make a move to an observation institute of independent finance service sector which so called Otoritas Jasa Keuangan (OJK) in the year 2010 in accordance with provision in Article 34 Law Number 3 Year of 2004 regarding Amendment of Law Number 23 Year of 1999 regarding Bank of Indonesia (BI). Later the institution (OJK) undertakes the supervision of banking industry, insurance, pension fund, capital market, risk capital, and defrayal company, and other bodies carrying out fund management of public.
OJK's duty and authorize in the case banking supervision only related to the micro prudential aspect such as institutional, business activities, and assessment of health level. While macro prudential aspect which related to monetary policy and paying system, like in the rule about Statutory Reserve Requirement (Giro Wajib Minimum or GWM), state?s income regulation, Open Market Operation (Operasi Pasar Terbuka or OPT), and reports with the inspection that related to the duty implementation in monetary area along with the paying system, is the authority of BI as a monetary institution. The OJK supervising board which will be formed by law at the latest in 2010, must be proactive in managing cooperation with BI, Lembaga Penjamin Simpanan (LPS), dan the minister of finance.
After OJK is formed, therefore the supervision authority is no longer belong to BI. The Banking supervision will be come the authority of OJK. And BI will be focus on the authority in of monetary policy which is the policy to reach and maintain rupiah?s value stability done by inter alia through controlling the money circulation and/or interest rate.If the OJK is formed by the end of year 2010, therefore we will have fiscal authority, that is The Minister of Finance, monetary authority, that is BI, and finance service supervisor authority, that is OJK. Bapepam will enter OJK, thus it will no longer under The Minister of Finance."

"Skripsi ini membahas tentang kedudukan dari Otoritas Jasa Keuangan berdasarkan Undang-Undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan dalam hal pengaturan dan pengawasan perbankan di Indonesia. Penataan kembali struktur pengorganisasian yang lebih terintegrasi diperlukan terhadap lembaga-lembaga yang menjalankan fungsi pengawasan pada industri perbankan maupun industri keuangan bukan bank sehingga dapat tercapai mekanisme koordinasi yang efektif dan dengan demikian dapat tercapai stabilitas sistem keuangan. Lembaga yang terintegrasi ini oleh pemerintah dilahirkan dalam bentuk Otoritas Jasa Keuangan. Pokok permasalahan yang dibahas dalam penelitian ini adalah kedudukan dan keberadaan Otoritas Jasa Keuangan sebagai Lembaga Pengatur dan Pengawas Perbankan di Indonesia serta mekanisme koordinasi antara Otoritas Jasa Keuangan dengan Bank Indonesia dalam hal pengaturan dan pengawasan bank. Bentuk penelitian ini adalah yuridis normatif dengan melakukan studi dokumen dan menggunakan metode analisis data secara kualitatif.
Penelitian menunjukan bahwa didasarkan pada Pasal 1 ayat (1) UU OJK yang menyebutkan bahwa Otoritas Jasa Keuangan adalah lembaga yang independen dan bebas dari campur tangan pihak lain, yang mempunyai fungsi, tugas, dan wewenang pengaturan, pengawasan, pemeriksaan, dan penyidikan serta memiliki kedudukan diluar pemerintah. Koordinasi antara OJK dengan BI telah diatur dalam Pasal 39 UU OJK, yaitu dalam membuat peraturan pengawasan di bidang perbankan meliputi: kewajiban pemenuhan modal minimum bank, sistem informasi perbankan yang terpadu, kebijakan penerimaan dana dari luar negeri, penerimaan dana valuta asing dan pinjaman komersial luar negeri, produk perbankan, transaksi derivatif, kegiatan usaha bank lainnya dan penentuan institusi bank yang masuk kategori systemically important bank serta data lain yang dikecualikan dari ketentuan kerahasiaan.

This thesis discusses the position of the Otoritas Jasa Keuangan pursuant to Act No. 21 of 2011 on the Otoritas Jasa Keuangan in terms of regulation and supervision of banking in Indonesia. Restructuring required a more integrated organization of institutions that perform the function of oversight in the banking industry as well as non-bank financial industry so as to achieve effective coordination mechanism and thus can achieve the stability of the financial system. This integrated institution born by the government in the form of the Otoritas Jasa Keuangan. The main problems discussed in this study is the status and whereabouts of the Otoritas Jasa Keuangan as a Regulatory and Supervisory Institute of Banking in Indonesia as well as the coordination mechanism between the Otoritas Jasa Keuangan and Bank Indonesia in terms of regulation and supervision of banks. This research is a form of normative documents and by conducting studies using qualitative methods of data analysis.
Research shows that based on Article 1 paragraph (1) of the Otoritas Jasa Keuangan Act which states that the Otoritas Jasa Keuangan is an independent body and free from interference by other parties, which have the functions, duties, and powers of regulation, supervision, inspection, and investigation and have a position outside the government. Coordination between the Otoritas Jasa Keuangan and Bank Indonesia has been provided for in Article 39 of Otoritas Jasa Keuangan Act, namely in making banking supervision regulations include: minimum capital obligations of banks, banking information system that is unified, policy receipt of funds from abroad, receipt of foreign currency funds and external commercial borrowing country, banking products, derivative transactions, banking activities and the determination of other banking institutions are categorized as systemically important banks as well as other data are excluded from the provisions of the confidentiality of the information.

"Skripsi ini membahas kewenangan pengaturan dan pengawasan Otoritas Jasa Keuangan terhadap Bank Perkreditan Rakyat. Pembentukan Otoritas Jasa Keuangan pada tahun 2011 melalui diterbitkannya Undang-Undang No. 21 Tahun 2011 tentang Otoritas Jasa Keuangan menyebabkan pindahnya kewenangan pengaturan dan pengawasan atas industri perbankan, termasuk Bank Perkreditan Rakyat konvensional, dari Bank Indonesia kepada Otoritas Jasa Keuangan. Pemindahan kewenangan ini sendiri terjadi secara bertahap, dimana Otoritas Jasa Keuangan baru memegang kewenangan pengawasan pada tahun 2013, setelah sebelumnya hanya memegang kewenangan pengaturan atas industri perbankan.
Skripsi ini membahas penerapan kewenangan pengaturan dan pengawasan atas Bank Perkreditan Rakyat oleh Otoritas Jasa Keuangan, memaparkan kemungkinan adanya celah hukum ataupun overlap kewenangan, dan memberikan rekomendasi terkait dari perspektif hukum, untuk perkembangan Otoritas Jasa Keuangan dan Bank Perkreditan Rakyat, serta industri perbankan dan hukum perbankan di Indonesia secara umum yang lebih baik.

This undergraduate thesis discusses the Financial Services Authority?s regulatory and supervisory authority over the Rural Banks. Since the establishment of the Financial Services Authority in 2011 through the promulgation of Law No. 21 Year 2011 on Financial Services Authority, the supervision and regulation over the banking industry, including the conventional rural banks, is transferred from the Bank of Indonesia to the Financial Services Authority. The transfer of authorities itself is gradual, as the Financial Services Authority had only gain the supervisory authority effectively in 2013, previously only having the regulatory authority.
This undergraduate thesis dwelves into the regulatory and supervisory authority over the rural banks as implemented by the Financial Services Authority through Regulations and Circular Letters, exposing possible legal gaps or overlaps and providing related recommendations from the legal perspective, for the better development of the Financial Services Authority and the rural banks, as well as the Indonesian banking industry and banking law in general.

"Penelitian ini membahas mengenai perencanaan sumber daya manusia pengawas perbankan yang dilakukan oleh Otoritas Jasa Keuangan dengan mengacu kepada transformasi organisasi tahap awal dan tahap kedua. Teori yang digunakan dalam penelitian ini adalah manajemen sumber daya manusia, dan perencanaan sumber daya manusia. Penelitian ini menggunakan pendekatan post positivisme melalui studi lapangan dan studi kepustakaan. Hasil penelitian menunjukan bahwa perencanaan sumber daya manusia yang dilakukan oleh Otoritas Jasa Keuangan telah disusun dengan baik. Namun masih terdapat beberapa permasalahan dan kelemahan terkait dengan ketepatan perencanaan, penyusunan kebutuhan, dan rencana pemenuhan sumber daya manusia.

This research discusses human resources planning for banking supervision carried out by Financial Services Authority of Indonesiareferencing organizational transformation in firststage and second stage. The theory that being used in this research are human resources management and human resources planning. This research uses post-positivism approach through field studies and literature. The result shows that human resources planning carried out by Financial Services Authority of Indonesiais already performed well. However, there are still some issues and weaknesses associated with the accuracy of planning, preparation requirements, and plans for fulfillment of human resources."

"Integrasi pasar keuangan pada era globalisasi ini menyebabkan produk dan aktivitas yang ditawarkan oleh perbankan menjadi semakin kompleks dan bervariasi. Jasa Layanan Nasabah Prima (Wealth Management) muncul sebagai tanda perkembangan dalam dunia bisnis perbankan. OJK hadir sebagai lembaga pengawas perbankan (micro prudential supervisor) di Indonesia agar dapat menjaga stabilitas perekonomian dan keadaan perbankan nasional. Pokok permasalahan utama dalam skripsi ini adalah untuk membahas dan menganalisis peran OJK dalam mengawasi setiap Bank yang melakukan layanan tersebut, termasuk bagaimana ketentuan hukumnya. Penelitian ini merupakan penelitian yuridis-normatif menggunakan data sekunder. Hasil penelitian ini menunjukkan bahwa OJK telah melakukan pengawasan berdasarkan laporan (off-site) yang diterima secara berkala dan pemeriksaan langsung di lapangan (on-site). OJK harus mengawasi secara khusus terkait Layanan Nasabah Prima (Wealth Management) yang mana selama ini belum dilakukan, mengingat layanan ini memiliki risiko yang tinggi.

Integration of financial markets in this era of globalization led to products and activities offered by banks is becoming complex and varied. Wealth Management Service conducted by banks appears as a sign of advancement in banking business. Financial Services Authority (Otoritas Jasa Keuangan) as the banking supervisory institution (micro prudential supervisor) assigned to maintain the stability of the economy and stability of national banking. The main issues in this thesis is to discuss and analyzes Financial Services Authority roles in overseeing Banks carry out such of services, including legal provisions. This research is a normative legal research using secondary data. The results of this thesis showed that the Financial Services Authority has done supervision based on report (off-site) received regularly and based on auditing on filed (on-site). The Financial Services Authority should has special supervison related to Wealth Management Service which hasn’t been done before, it’s considered that these services are at high risk.

"Otoritas Jasa Keuangan OJK merupakan lembaga pengawas jasa keuangan di Indonesia, yang mengikuti model lembaga pengawas terintegrasi. OJK didirikan berdasarkan Undang-undang Nomor 21 Tahun 2011. Penelitian ini merupakan penelitian yuridis-normatif yang dilakukan melalui perbandingan hukum. Tugas pengaturan dan pengawasan sektor perbankan yang semula dijalankan oleh Bank Indonesia kini beralih kepada dengan didirikannya lembaga pengawas tersebut. Penelitian ini membahas kewenangan yang dimiliki OJK dalam menjalankan tugas pengaturan dan pengawasan perbankan, serta membandingkannya dengan tugas pengaturan dan pengawasan perbankan yang dijalankan oleh lembaga pengawas jasa keuangan di Negara lain. Perbandingan ini dilakukan terhadap Autorit des March s Financiers AMF dan Autorit de Contr le Prudentiel et de R solution ACPR di Perancis yang dianggap berhasil, dan terhadap Financial Services Authority FSA di Inggris yang di anggap gagal dan telah di bubarkan dan digantikan oleh Financial Conduct of Authority FCA dan Prudential Regulation Authority PRA yang di aggap berhasil. Perbandingan dalam penelitian ini ditinjau melalui kewenangan lembaga dalam menjalankan tugas pengaturan dan pengawasan perbankan di negaranya, mengenai independensi lembaga, dan mengenai hubungan antara lembaga pengawas tersebut dengan bank sentral di negaranya masing-masing.

Otoritas Jasa Keuangan OJK is the Indonesian financial services authority and was established as an integrated supervisory body under the Law No. 21 Year 2011. This thesis is a juridical normative research through the comparative study of law. The regulation and the supervision of banking activities was performed by the Indonesian Central Bank, otherwise known as Bank Indonesia, until the establishment of the OJK, which then resulted to the transfer of the said regulatory and supervisory authority over the banking sector onto the OJK. This thesis first elaborates the OJK rsquo s authority to regulate and to supervise the banking sector before comparing it later on with the financial supervisory authorities of two other countries. The comparison is conducted upon the Autorit des March s Financiers AMF and the Autorit de Contr le Prudentiel et de R solution ACPR in France, which are considered successful and not only upon the Financial Services Authority FSA in the United Kingdom which failed, but also with its replacing authorities that are the Financial Conduct of Authority FCA and the Prudential Regulation Authority PRA . The said comparison is done through the analysis of each institutions rsquo authorities in performing banking regulation and supervision and their independency, along with their institutional relationship with the Central Bank of each their respective country. "

"The development of the Shari'ah financial services sector in Indonesia is growing rapidly, this phenomenon innovating the importancee of the protection of consumers against the Shari'ah financial services which is offered by the provider; whether they are Shari'ah banks, insurances or the capital market form. The purpose of this protection is none other as a part of the maqashid shari'ah realization compliance. The protection of consumers in financial services is divided into two aspects: regulation and oversight. Both aspects are the authority and also the duty of the Financial Services Authority of Shari'ah since the adoption of Law Number 21 of 201 on the Financial Services Authority, relating to: the supervision of the institution does not have the role to be the supervisor in relation to Shari'ah financial services, because it is not regulated in detail and there is only one article which sets it. However, this condition is inversely proportional with the regulation and the supervision of the conventional financial services which are regulated in detail in this Act. The arising problem because of the regulation, which is not detailed, directs the Shari'ah financial service costumers to be not protected from the transactions that are prohibited by Isalm, so the aim of the establishment of the OJK is not fulfilled. This paper attempts to examine the protection of the Shari'ah financial service consumers through the supervision mechanism by the financial services authority. Financial services authority known as the OJK, has the function of regulating and supervising the financial services either conventional or Shari'ah. Specifically for the function as the supervisory institution has the role the protect the consumers from the behavior of the financial service provider. This protection is not only for the conventional financial services consumers but also for the Shari'ah financial service consumers. The role of OJK in protecting the Shari'ah financial service consumers is done together with the DSN-MUI as the external supervisor."
