"Penulisan Tugas Karya Akhir ini berfokus pada dampak dari pengabaian hak-hak pekerja migran Indonesia di Malaysia sebagai bentuk kejahatan negara dengan menggunakan studi kasus program rehiring pemerintah Malaysia periode 2016-2018. Program rehiring ini diadakan oleh pemerintah Malaysia bagi pekerja migran tidak berdokumen di Malaysia dengan memberikan visa kerja kepada mereka yang memiliki majikan, tidak memiliki catatan kriminal, dan masuk ke Malaysia secara legal. Penulisan ini menggunakan pendekatan kriminologi kritis, konsep sistem ekonomi dan politik kapitalis, state crime, dan teori viktimisasi struktural. Data yang digunakan berasal dari pengaduan korban kepada Serikat Buruh Migran Indonesia (SBMI) dan Tenaganita Malaysia. Penulisan ini menemukan bahwa pengabaian yang dilakukan pemerintah Indonesia terhadap program rehiring telah menyebabkan pekerja migran Indonesia di Malaysia mengalami viktimisasi struktural.

The focus on this study is about the impact of the neglect of the rights of Indonesian migrant workers in Malaysia as a form of state crime using a case study of the Malaysian government rehiring program for the period of 2016-2018. This rehiring program is conducted by the Malaysian government for undocumented migrant workers in Malaysia by providing work visas to those who have employers, do not have a criminal record, and enter Malaysia legally. This study uses a critical criminology approach, the concept of capitalist economic and political systems, state crime, and structural victimization theory. The data used came from the victims complaint to the Indonesian Migrant Workers Union (SBMI) and Tenaganita Malaysia. This study found that the Indonesian government neglect of the rehiring program had caused Indonesian migrant workers in Malaysia to experience structural victimization."

"ABSTRAK
Kebijakan dalam perlindungan hak pekerja/buruh outsourcing
merupakan wujud komitmen pemerintah untuk memberikan perlindungan
terhadap pekerja dan memenuhi hak-haknya. Praktek Outsourcing mulai
marak diterapkan oleh perusahaan-perusahaan yang ada di Indonesia tak
terkecuali oleh BUMN. Dari berbagai sumber referensi yang didapatkan
oleh peneliti, PT PLN adalah salah satu BUMN yang menerapkan praktek
outsourcing dengan jumlah pekerja outsourcing terbanyak dibandingkan
dengan BUMN lainnya. Berdasarkan hal tersebut, peneliti bertujuan untuk
mengetahui bagaimana penerapan perlindungan hak pekerja outsourcing
yang di implementasikan oleh PT PLN. Penelitian ini menggunakan teori
implementasi kebijakan dengan pendekatan post positivist dan teknik
pengumpulan data kualitatif. Teknik analisis data menggunakan analisis
deskriptif terhadap indikator-indikator batasan implementasi kebijakan.
Hasil penelitian ini adalah implementasi kebijakan dalam perlindungan
hak pekerja outsourcing di PLN belum mencerminkan adanya
implementasi yang sesuai dengan kebijakan yang berlaku. Hal ini
dikarenakan PLN masih melakukan praktik outsourcing dengan bentukbentuk
pekerjaan pokok (core business). Hasil penelitian menyarankan
agar PLN menginventarisir sifat dan jenis kegiatan pokok dari perusahaan
sesuai dengan Undang-Undang Nomor 13 Tahun 2003 Tentang
Ketenagakerjaan dan Permenakertrans No.19 Tahun 2012.

ABSTRACT
Policy in the protection of outsourcing worker/labor’s
rights commits the government to provide protection to workers and fulfill
their rights. The practice of outsourcing begin to bloom applied by
companies that exist in Indonesia is no exception by BUMN. Refrences
from various sources obtained by researcher, PT PLN is one of BUMN
could implement the practice of outsourcing with the highest number of
outsourcing workers compared with other BUMN. Based on that, the
researcher aimed to determine how the application outsourcing labor rights
protection that is implemented by PT PLN. This study uses the theory of
policy implementation with post positivist approach and qualitative data
collection techniques. Analysis using descrtive analysis of indicators of
policy implementation constraints. The results of this research is the
implementation of policies in the protection of rights of outsourcing
workers in PLN not reflect any policy implementation in accordance with
the applicable. This is because outsourcing in PLN stillpractice the basic
forms of work. The results of the study suggest that the nature and type of
inventory PLN principal activities of the company accordance with
Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan dan
Permenakertrans No.19 Tahun 2012."

"For hundreds of years people have debated what a human is. Some claim humans are those with human DNA. Some claim humans are those with certain traits like rationality. Others say humans are those who are made in the image of God. Scholars in this debate think that if society accepts the wrong definition of a human, people will look at their neighbor as more of an animal, object, or machine-making maltreatment more likely. Despite their seriousness, these claims have never been empirically investigated. This book focuses on human rights as exemplary treatment, and shows that the definitions of a human promoted by biologists and philosophers actually are associated with less support for human rights. Those members of the public who agree with these definitions are less willing to sacrifice to stop genocides, and are more supportive of buying organs from poor people, experimenting on prisoners against their will, torturing people to potentially save lives, and having terminally ill people commit suicide to save money. It appears that the critics are right. However, few Americans agree with these definitions of a human, and looking at how most of the public defines a human, we see a much more nuanced picture, and the presently dominant definitions of a human are unlikely to lead to human rights abuses. Therefore, the critics are right about the definitions of a human promoted by academic biologists and philosophers, but because few Americans agree with these views, concern about widespread maltreatment is overblown.
