"Penjualan di bawah tangan merupakan salah satu cara untuk melaksanakan eksekusi hak tanggungan, selain parate eksekusi dan titel eksekutorial. Mekanisme ini diperbolehkan sebagai bentuk penyimpangan dari prinsip melalui pelelangan umum. Metode penelitian yang digunakan dalam penulisan ini adalah doktrinal. Tulisan ini akan menganalisis bagaimana pelaksanaan penjualan objek hak tanggungan di bawah tangan dan upaya hukum partij verzet terhadap adanya penundaan penjualan objek hak tanggungan di bawah tangan, khususnya dalam Putusan Nomor 1095/Pdt.G/2017/PN Dps, 132/Pdt.G/2020/PN Cbi, dan 21/Pdt.Bth/2020/PN Bjn. Penjualan di bawah tangan dapat dilaksanakan sepanjang didasarkan pada kesepakatan pemberi dan pemegang hak tanggungan, termasuk sepakat atas harga jual objek hak tanggungan. Namun, alasan tersebut tidak dapat dijadikan dasar pengajuan partij verzet karena terdapat batasan dalam SEMA Nomor 7 Tahun 2012.

Underhand sales is one way to carry out the execution of mortgage object, in addition to execution parate and executorial title. This mechanism is permitted as a form of deviation from the principle of a public auction. The research method used in this writing is doctrinal. This paper analyzes how implementation of the underhand sales of mortgage object and legal action for partij verzet in cases of postponement underhand sales, that specifically focuses on the decision of number 1095/Pdt.G/2017/PN Dps, 132/Pdt.G/2020/PN Cbi, dan 21/Pdt.Bth/2020/PN Bjn. Underhand sales can be carried out as long as it is based on an agreement between debitor and kreditor, including an agreement on the sale price of the mortgage object. However, this reason cannot be used as a legal basis for partij verzet because there are restrictions in SEMA Number 7 of 2012."
