"Beberapa tahapan dalam proses pensertipikatan satuan rumah susun (sarusun) adalah pengesahan akta pemisahan dan pertelaan. Kepemilikan atas tanah tempat rumah susun berdiri akan berubah dari kepemilikan tunggal penyelenggara pembangunan menjadi bagian tak terpisahkan dari kepemilikan bersama yang terpecah sesuai dengan Nilai Perbandingan Proporsional (NPP) tiap satuan rumah susun. Kepemilikan hak atas sarusun dibuktikan dengan adanya Sertipikat Hak Milik Satuan Rumah Susun (SHM Sarusun), yang diterbitkan serentak bersamaan dengan disimpannya Sertipikat Hak Atas Tanah terkait. Setiap terjadi pengalihan SHM Sarusun dari penyelenggara pembangunan kepada pemiliknya yang baru, beralih pula kepemilikan bersama sesuai dengan NPP terkait. Ketika seluruh sarusun telah dialihkan, berarti seluruh bagian tanah bersama telah beralih kepada para pemilik sarusun yang baru. Sertipikat Hak Atas Tanah Bersama sebagai bukti hak atas tanah bersama masih tercatat atas nama penyelenggara pembangunan dan disimpan oleh Kantor Pertanahan Setempat, tanpa dapat digunakan maupun dipindahtangankan. Ketentuan mengenai perubahan pencatatan nama pemegang hak kepemilikan bersama dalam Sertipikat Hak Atas Tanah Bersama belum diatur secara tegas. Kedudukan subyek tercatat dalam Sertipikat Hak Atas Tanah Bersama berperan dalam melakukan perbuatan hukum, terutama mengenai perpanjangan jangka waktu kepemilikan hak atas tanah bersama. Penelitian ini adalah penelitian yuridis normatif dengan tipologi penelitian deskriptif, menekankan penggunaan bahan hukum sekunder, metode analisis data kualitatif yang menghasilkan hasil penelitian berupa deskriptif analitis. Kedudukan subyek pemegang hak atas tanah dalam Sertipikat Hak Atas Tanah Bersama di Rumah Susun demi hukum berada pada para pemilik sarusun, tetapi pencatatannya perlu diatur dalam ketentuan yang berlaku dan prosedur perpanjangan hak atas tanah bersama yang telah diatur dalam peraturan yang berlaku membutuhkan pembentukan Peraturan Pemerintah untuk mengatur mengenai kecakapan bertindak PPPSRS selaku wakil dari para pemilik sarusun.
One of the steps within certification of condominium units is legitimizing the segregation deed and its dissociation. Ownership of the land whereby the condominium resides would shift from singular ownership of the developer into inseparable common ownership, fissioned accordingly to Proportional Comparison Value (NPP) of condominium units. Ownership of the condominium units proven by Deed of Condominium Unit would be established concurrently, along with the preservation of Deed of Common Land. Every transitional conduct of a Deed of Condominium Unit from the developer to its new owner, would also mean the transition of common ownership per the value rested in each NPP. When all of the units have been transferred, the entire common land would be owned by the owners of condominium units. The Deed of Common Land which serves as proof of the common land ownership, would still be listed under the name of the developer and archived strictly in the Land Office. Currently there is no governing provision in changing the registered holder in The Deed of Common Land. The legitimacy of the registered subject in The Deed of Common Land matters for their ability to take legal actions, especially regarding the prolongation of its ownership. This normative judicial research uses descriptive research typology, emphasizes on using secondary legal materials, with qualitative data methods producing analytically descripted results. In conclusion, the legitimacy of the holder of common land by law is the right of the owners of condominium units needs to be clearly regulated and the prolongation of common land rights stipulated in the current regulations still requires the establishment of a Government Regulation regarding the capacity of the Owners Union as a representative of the condominium owners."

ABSTRACTThe Dissertation problem is concerning about implementation of land adjudication project (LAP) for poor people in slum area at jakarta City. Realization of the project faced fact that the socio economic conditions of the people are heterogenic, and have been defended to through application of various social institutions and culture, including by poor people. People anticipate that project with that variation. After adjudication, existence of land certificate do not always in line with clauses and mechanism of other development projects, hence poor people even also perforce to anticipate that condition with some ability and many ways.For the purpose of law and economics development for the poor people, this dissertation sees that target of adjudication influenced by a number of factors. So, the problem of this dissertation included an absolute poorness form, ownership doubting of land right, or the limited opportunity of poor people to access legal things. Not to mention existence of other resistance which faced by poor people after project of land adjudication done.Land adjudication in fact is only one of the small shares or step of a big and wide development process. Adjudication is only a step early to follow that big current. But if poor people only base on land adjudication is not yet adequate. The poor needed many other formal prerequisites if they want to be successful. And, adjudication also is not ending result. Adjudication of course yields formal evidence, namely land certificate, but certificate remains to have to be related to other formal things so that can useful for them.Thereby, development in fact affects less both for the poor. Development is not merely a planned process which isn't it become a set activity for whosoever, but require selected things, especially productive capital which can continue to develop. As a result, development become to side at owner of capital.Field data indicated regarding importantly of give adequate attention to heterogeneity that happened, especially in slum area. Existing heterogeneity exactly can equip various concept and theory, for example hitting ?culture of poverty' nor macro social and micro social concepts of Southall (1973) less giving of attention at variant that happened and barbed with people dynamics in answering to all sort of matter which intervening their social group, Heterogeneity also indication of is existence of culture knowledge which vary at people which remain to slum area. Culture knowledge which vary that will be used them to answer to various development intervention. If we mentioned more pay attention, hence will be able to assist us to analyze the essence relation between society and development."
