"Tesis ini membahas permasalahan yang sering terjadi dalam pengadaan barang/jasa pemerintah dengan menggunakan pendekatan kasus pengadaan alat kesehatan CSSD pada RSUPN Dr. Cipto Mangunkusumo Tahun Anggaran 2008. Penelitian ini adalah penelitian normatif doktrinal melalui penelitian kepustakaan. Permasalahan yang sering terjadi utamanya adalah korupsi dan persaingan usaha yang tidak sehat. Permasalahan lain adalah kemahalan harga, yaitu nilai kontrak pengadaan lebih besar daripada harga pasar atau daripada nilai kontrak pengadaan lain atas barang/jasa yang sama pada waktu yang sama, namun hal tersebut merupakan suatu ketidakadilan terhadap hukum.

This thesis discusses the problems that often occur in the government procurement by using a case approach of CSSD medical equipment procurement in RSUPN Dr. Cipto Mangunkusumo in 2008. This research is a normative doctrinal study through library research. Problems that often occur is corruption and unfair competition. Another issue is overpriced contract, ie the contract price is larger than the market price or larger than other contract on the same goods at the same time, but findings of overpriced contract is an injustice against the law.

And at this time being, it has never been investigated any better by the General Inspectorate neither the Development Finance Investigatory Administration.Prevention measures that should be perform that it need highly seriousness from the institution or administration who investigate the development performance and to provide fair sanction against the act, either to officials, the committee, technical managers, and contractors, making them learning their lesson and giving severe warning to those who intending to also misconduct."

"The pattern of corruption eradication effort in procurement of goods and services has a spesific characteristic and differs from other general patterns of corruption eradication various aspects of law in procurement of goods and services are dominated by elements regarding administrative law and civil law. Therefore, pattern of itsviolations also exists in those two areas of laws. Hence, the eradication strategy shall prioritize the enforcement of administrative law which has main function to provide asustainable controlling element as preventive factor without neglecting the repressive action. "Tujuan dari penelitian ini adalah untuk menganalisis mengenai perjanjian pengadaan barang/jasa pemerintah di Indonesia. Objek dalam penelitian ini adalah putusan Mahkamah Agung Nomor 1574 K/PDT/2011 mengenai gugatan PT Helga Prima Contractor melawan Pemerintah Kota Bekasi tentang sah atau tidaknya perjanjian pengadaan barang/jasa pemerintah diantara para pihak. Metode penelitian skripsi ini adalah yuridis normatif. Hasil penelitian ini menunjukkan bahwa pengadaan barang/jasa pemerintah terjadi dalam beberapa bidang hukum seperti hukum administrasi negara, hukum perdata, dan hukum persaingan usaha. Sebagai sebuah perjanjian maka perjanjian pengadaan barang/jasa pemerintah harus tunduk pada ketentuan hukum perdata.

The purpose of this research is to analyze the agreement of procurement by government in Indonesia. The object of this research is the Supreme Court Decision Number 1574 K PDT 2011 between PT Helga Prima Contractor against City of Bekasi rsquo s Government about the legalization of the agreement of procurement by government between the parties. This research method is normative juridical. Secondary data obtained from books, previous studies, and related legislative products.

The results of this research indicate that the procurement of government occurs in several areas of law such as state administrative law, civil law, and business competition law. As an agreement, the procurement is rulled by the Indonesian civil law system. "
