"Permasalahan dalam penelitian ini adalah bagaimanakah peran Setjen DPR-RI dalam memberikan dukungan keahlian untuk penguatan fungsi legislasi DPR-RI Periode Tahun 2004-2009, apakah struktur dan sistem Setjen DPR-RI mendukung fungsi legisasi DPR-RI periode tahun 2004-2009 dan apakah kendala yang dihadapi oleh Setjen DPR dalam memberikan dukungan keahlian dalam bidang legislasi pada keanggotaan Dewan periode tahun 2004-2009.
Hasil yang diharapkan dari penelitian ini adalah memperoleh gambaran secara menyeluruh mengenai peran Setjen DPR dalam memberikan dukungan keahlian untuk penguatan fungsi legislasi DPR periode tahun 2004-2009 Sebagai hasil penelitian dapat disimpulkan bahwa tugas dari Setjen DPR adalah menyelenggarakan dukungan keahlian, administratif dan teknis kepada DPR. Dukungan Setjen DPR RI di bidang Legislasi, yang merupakan salah satu fungsi utama Dewan belum dapat menghasilkan produk secara optimal. Hal ini tergambar dalam pelaksanaan tugas DPR RI periode 2004-2009 dari 122 RUU yang telah diselesaikan belum didukung sepenuhnya oleh Naskah Akademik maupun pendampingan dalam pembahasan RUU melalui rapat-rapat di Komisi/Pansus. Salah satu penyebabnya adalah masih terbatasnya sumber daya pendukung keahlian bidang legislasi.
Struktur kelembagaan dan pengorganisasian Sekjen DPR masih menjiplak sistem kesekretariatan di departemen-departemen di lembaga eksekutif dan diatur dalam Peraturan Presiden, pengaturan fungsi legislasi dalam Tata Tertib DPR belum rinci dan sistematis terutama pengaturan mengenai pemberian dukungan Setjen DPR. Penulisan tesis ini menggunakan metode penelitian yuridis normatif yaitu penelitian yang dilakukan dengan cara meneliti data sekunder atau bahan pustaka dan pendekatan yang digunakan adalah pendekatan perundang-undangan (statue approach).

Problems in this study is how the role of Secretary General of Parliament in providing expertise to support the strengthening of legislative function of Parliament 2004-2009 period, whether the structure and system of the Parliament Secretariat General support functions legislation Parliament in 2004-2009 period and whether the constraints faced by the Secretariat General of Parliament in support of expertise in the field of legislation on the membership of the period of 2004-2009.
The expected outcome of this research is to obtain a thorough picture of the role of the Parliament Secretariat General in providing support expertise for strengthening the function of legislation the House the period of 2004-2009 as the research results can be concluded that the duty of the Secretary General of the House is organizing support expertise, administrative and technical support to the House. Support Secretary General House of Representatives in the field of legislation, which is one of the main functions of the Council have not been able to produce optimally. This is reflected in the implementation of the tasks the Parliament the 2004-2009 period from 122 bill that has been resolved yet fully supported by the Academic Paper and facilitation of the discussion of the bill through meetings at the Commission / committee. One reason is the limited resources of expertise supporting the field of legislation.
Institutional structure and organization of the Secretary General of the DPR still plagiarizing secretarial system in the departments in the executive and regulated in Presidential Regulation, setting the legislative function in the Discipline of the House has not been particularly detailed and systematic arrangements for providing support to the Parliament Secretariat General. Writing this thesis using the method of juridical normative research is research done by examining secondary data or library materials and approach used is the approach to legislation (statue approach).

"Perubahan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD 1945) telah memberikan dampak yang sangat besar dalam sistem ketatanegaraan negara Republik Indonesia, khususnya telah menempatkan posisi Dewan Perwakilan Rakyat (DPR) sebagai pemegang kekuasaan membentuk Undang- Undang yang sebelumnya kekuasaan tersebut berada di tangan Presiden. DPR masa bakti 2004-2009 didasarkan pada Prolegnas tahun 2005-2009 untuk menjalankan program legislasinya. Prolegnas untuk masa bakti 2005-2009 telah menetapkan sebanyak 284 (dua ratus delapan puluh empat) judul Rancangan Undang-Undang yang direncanakan akan disusun dan dibahas dalam jangka waktu 5 (lima) tahun. Kualitas pelaksanaan fungsi legislasi DPR RI masa bakti 2004-2009 dapat dikatakan belum cukup baik. Hal ini dikarenakan tidak tercapainya jumlah Undang-Undang yang sesuai dengan perencanaan dalam daftar Prolegnas yang hanya tercapai kurang lebih 34 (tiga puluh empat) persen dari target awal. Adanya pengujian Undang-Undang ke Mahkamah Konstitusi juga menunjukkan bahwa kualitas pelaksanaan fungsi legislasi yang belum optimal. Belum optimalnya pelaksanaan fungsi legislasi DPR RI masa bakti 2004- 2009 disebabkan oleh berbagai kendala seperti: pertama pembahasan Rancangan Undang-Undang sangat lambat dan tidak efisien, kedua, pengaturan fungsi legislasi dalam Tatib DPR RI belum rinci dan sistematis, ketiga, kedudukan Baleg sebagai pusat harmonisasi dalam pembentukan Undang-Undang belum optimal, keempat, keberadaan SDM pendukung dalam pelaksanaan fungsi legislasi yang masih kurang, baik dari segi kuantitas maupun kualitasnya, terutama dalam hal penguasaan fungsi legislasi, kelima, sarana dan prasarana untuk mendukung pelaksanaan fungsi legislasi DPR masih sangat minim.

The Amendment of the 1945 Constitution of the Republic of Indonesia (UUD 1945) has caused an immense consequence on the constitutional system of the Republic of Indonesia, and in particular has positioned the House of Representatives (DPR) with its power of legislation that was formerly at the hand of the President. The 2004 - 2009's House has its 2005-2009 Prolegnas as the basic of legislation program. The 2005-2009 Prolegnas is a set of 284 (two hundred and eighty-four) proposed bills to be prepared and discussed within a period of 5 (five) years. The performance quality of legislation function of the 2004-2009 House is considered not satisfactory. The reason is it fails to meet the number of bills planned on the list of Prolegnas. At the moment, the number only reached approximately 34 (thirty-four) percent of the set target. Other benchmarks that can be used as a reference in assessing the quality of the legislation function of the 2004-2009 House of Representatives is through a number of judicial review at the Constitutional Court. The exercise of judicial review indicates a poor quality of the implementation of legislation function. There are some reasons and constrains for the poor performance of legislation function of the 2004-2009 House, such as: first, the draft discussion is time-consuming and inefficient, second, the rule of legislation function in the Rule of Procedure set up by the House is not yet thorough and systematic, third, the Legislation Commission that should plays a central role in drafting has not been the most favorable, fourth, the lack of support of human resources in the implementation of legislation function, both in terms of quantity and quality, especially in terms of mastering the legislation function, and fifth, a minimum facilities and infrastructure in supporting the function of legislation of the House that still exists."

"The Dewan Perwakilan Daerah (Regional Representatives Council - DPD) and the Dewan Perwakilan Rakyat (House of Representatives - DPR) are institutions which represent the people in the parliament of the Republic of Indonesia. However, these two institutions do not have equal powers, including the powers related to the control function. The DPD’s function related to control is provided for under Article 22D paragraph (3), Article 23E paragraph (2), and Article 23F paragraph (1) of the Third Amendment to the 1945 Constitution of the Republic of Indonesia. The DPD can exercise control of the implementation of certain laws related to regional interests, the implementation of the State Budget, taxes, education and religion, reporting on the results of supervision exercised by it to the DPR; it receives the results of state finance audit conducted by the Badan Pemeriksa Keuangan (Audit Board - BPK), and provides its consideration to the DPR in electing members of BPK. Based on a comparison among various countries it is evident that although some countries have weaker control authorities compared to those of the DPD, it is the DPD elected directly through the general elections which has the weakest authority among them. Proportionate powers need to be granted to the DPD in order to ensure that that the objective of its establishment in representing the interests of the regions may be achieved."

"ABSTRAK
Publik saat ini memberikan atensi yang besar terhadap kinerja Dewan
Perwakilan Rakyat Republik Indonesia. Hal tersebut tidak terlepas dari
permasalahan yang dihadapi oleh lembaga tinggi negara tersebut, yakni kinerja
yang masih buruk. Adapun saat ini DPR RI sudah didukung oleh 2 orang staf dan
5 orang tenaga ahli. Sehingga masing-masing anggota DPR dibantu setidaknya 7
orang. Jumlah tersebut belum termasuk tenaga ahli fraksi dan tenaga ahli alat
kelengkapan lainnya. Tenaga ahli merupakan seseorang pekerja yang memiliki
keahlian tertentu dan bagian dari sistem pendukung DPR RI. Dengan banyaknya
tenaga bantu, kinerja DPR seharusnya dapat optimal. Adapun, pokok
permasalahan mengenai tenaga ahli tersebut yakni mengenai status hukum serta
lebih lanjut mengenai hak dan kewajiban dalam pengaturan dan implementasinya.
Hal tersebut perlu ditinjau dari prinsip-prinsip yang mengatur mengenai pekerja
dalam peraturan perundang-undangan yang berlaku. Metode yang digunakan
dalam penelitian ini yakni berbentuk yuridis-normatif. Melalui penelitian ini
diharapkan dapat diidentifikasi secara yuridis-normatif mengenai status hukum
dan beserta perlindungan hak dan kewajiban tenaga ahli DPR RI.

ABSTRACT
Recently the general public has been paying great attention to the
performance of the House of Representatives. This is inseparable from the issue
faced by the high state institutions (lembaga tinggi negara), which is
underperformance. At present, a Member of the Republic of Indonesia House of
Representatives (DPR RI) may be supported by two ordinary staff and five expert
staff. Therefore, a member may be supported by up to seven individuals. This
amount does not take into account expert staff appointed the faction (fraksi) and
other instrumental expert staff. An expert staff is a worker that has certain
expertise and is a part of DPR RI support system. With that amount of assistance,
the performance of DPR should be optimal. An issue that has arisen in relation to
expert staff is regarding their legal status, furthermore their rights and obligations
under law and implementation thereof. This needs to be reviewed from legal
principles on workers contained in prevailing laws and regulations. This research
applies a juridical-normative approach. This research seeks to identify the legal
status and the protection of rights as well as obligations afforded to expert staff at
the DPR RI from a juridical-normative perspective."

"Kewenangan Pemerintah Provinsi DKI Jakarta dalam bidang transportasi merupakan salah satu urusan pemerintahan konkuren yang didapatkan secara atribusi dengan bersumber pada UU No. 23 Tahun 2014 tentang Pemerintahan Daerah. Atas dasar hal tersebut, Kewenangan Pemerintah Provinsi DKI Jakarta dalam bidang Transportasi pada pelaksanaannya dapat dibagi dalam kewenangan perencanaan; kewenangan penyelenggaraan dan kewenangan evaluasi. Dalam perkembangannya, permasalahan transportasi Jakarta yang kompleks dan terhubung dengan daerah sekitarnya membutuhkan penanganan yang terpadu dan komprehensif, sehingga pemerintah pusat membentuk Badan Pengelola Transportasi Jabodetabek (BPTJ) melalui Perpres No. 103 Tahun 2015 tentang Badan Pengelola Transportasi Jabodetabek. BPTJ melaksanakan tugas dengan mengacu pada Rencana Induk Transportasi Jabodetabek (RITJ). Oleh karena kewenangan BPTJ yang lintas daerah dalam wilayah Jabodetabek, maka kewenangan Pemerintah Provinsi DKI Jakarta dalam bidang transportasi tidak mengalami perubahan secara substansial, melainkan hanya terdapat perubahan terkait koordinasi pelaksanaan kewenangan. Dalam hal ini, Pemerintah Provinsi DKI Jakarta tetap berwenang dalam pengelolaan transportasi di lingkup wilayahnya yang didasarkan atas kewenangan atributif dari pembagian urusan pemerintahan di bidang perhubungan dalam UU No. 23 Tahun 2014 tentang Pemerintahan Daerah. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan jenis eksplanatoris, sehingga akan menghasilkan suatu penelitian yang menggambarkan atau menjelaskan secara mendalam terkait suatu gejala atau permasalahan dengan menggunakan data sekunder berupa norma hukum tertulis. Dalam praktik pelaksanaannya masih terdapat potensi tumpang tindih kewenangan antara Pemerintah Provinsi DKI Jakarta dengan BPTJ, sehingga diperlukan peraturan perundang-undangan yang mengatur secara jelas mengenai hubungan kerja dan pembagian urusan di bidang transportasi antara pemerintah daerah di wilayah Jabodetabek dengan BPTJ yang mengacu pada RITJ.
Jakarta Provincial Government Authority in the field of transportation is one of the concurrent authority obtained by attribution, referring to The Law of The Republic of Indonesia Number 23 of 2014 concerning Local Government. On that basis, Jakarta Provincial Government Authority in the field of Transport on its implementation can be divided into the planning authority; organizing authority and the authority of the evaluation. In its development, the transportation problems in Jakarta was complex and connected with the surrounding area in need of an integrated and comprehensive treatment, so that the central government established the Transportation Management Agency of Jakarta, Bogor, Depok, Tangerang and Bekasi (BPTJ) through Presidential Regulation Number 103 of 2015 concerning Transportation Management Agency of Jakarta, Bogor, Depok, Tangerang and Bekasi (BPTJ). BPTJ duties referred to the Transportation Master Plan for Jabodetabek (RITJ). Therefore BPTJ authority which cross the area in Greater Jakarta, the Jakarta Provincial Government authorities in the field of transport did not change substantially, but there are only related to changes in coordinating the implementation of the authority. In this case, Jakarta Provincial Government retains authority in the management of transport in the scope of its area are based on the attributive authority of the division of government affairs in the sector of transportation in The Law of The Republic of Indonesia Number 23 of 2014 concerning Local Government. The method used in this research is normative juridical with the kind of explanatory, so it will produce a study that depicts or describes in depth related to a problem with using secondary data in the form of a written legal norms. In practical implementation, there is still potential overlapping authority between the Government of Jakarta with BPTJ, so that the necessary legislation clearly regulating the relationship and the division of affairs in the field of transport between local authorities in the Greater Jakarta area with BPTJ which refers to RITJ."
