"Investor-state arbitration is a relatively new dispute settlement mechanism that allows foreign investors the opportunity to seek redress for damages arising out of breaches of investment-related treaty obligations by the governments of host countries. Ketika para pihak yang bersengketamemilih arbitrase sebagai forum penyelesaian sengketa mereka, pemilihaninstitusi arbitrase serta tempat diadakannya arbitrase akan menentukan batasanserta ruang lingkup dari asas kerahasiaan yang terdapat dalam arbitrase mereka.Batasan dan ruang lingkup dari asas kerahasiaan akan ditinjau berdasarkanpengaturan asas kerahasiaan yang terdapat dalam peraturan institusi arbitrase,ataupun UU Arbitrase Nasional tempat arbitrase itu dilaksanakan. Abstract This thesis discusses about unsimilar approach, taken by arbitral institutions andnations, toward confidentiality. Author use juridical-normative research methodwith literature studies. When parties have chosen arbitration as their disputesettlement forum, their decision in choosing which arbitral institution rule shallbe used, and where the arbitration shall take place, will determine the scopes andlimitations of confidentiality in their arbitration. These scopes and limitations ofconfidentiality shall be pursuant to the confidentiality provisions within thearbitration?s institutional rule and its law of the seat.
