Laporan ini ini adalah analisa penulis tentang etika tata kelola perusahaan (Corporate
Governace) dalam klub football dan rugby di Australia. Laporan ini membahas kegagalan
dan ketidakmampuan klub untuk menerapkan etika tata kelola perusahaan. Kegagalan
tersebut menimbulkan skandal terhadap klub tersebut dan menarik perhatian media. Laporan
ini mengacu pada kode etik professional akuntansi Australia dan membahas peristiwaperistiwa
yang seharusnya bisa dicegah jika etika tata kelola perusahaan diterapkan. Analisis
penulis pada laporan ini didukung oleh artikel dan jurnal yang dipublikasi ABSTRACT This report is the author?s analysis about corporate governance in the Australian football and
rugby clubs. It discusses errors and inabilities of the clubs to apply the corporate governance.
The failures to apply the corporate governance lead scandal among the two clubs and raise
media attention. This report refers to the Code of Ethics of the Australian Accounting
Profession and analyses what events could have been prevented if the corporate governance
were applied. Published academic journals articles were provided to support the author?s
analysis., This report is the author’s analysis about corporate governance in the Australian football and
rugby clubs. It discusses errors and inabilities of the clubs to apply the corporate governance.

Obat – obatan terlarang semakin marak digunakan di dalam bidang olahraga di 4 dekade terakhir ini. Hadiah dalam bentuk uang yang akan diberikan apabila memenangkan suatu pertandingan menyebabkan keinginan yang besar untuk
menggunakan obat – obatan dimana bisa meningkatkat performa atlet. Tetapi,penggunaan obat-obatan ini akan menghasilkan efek yang buruk dimana dapat menodai citra olahraga itu sendiri dan merusak hubungan baik dengan para pemberi sponsor. Dari pembahasan masalah bisa dilihat, Menggunakan doping memungkinkan terjadinya permasalahan etika. Lebih spesifiknya lagi, obat –
obatan ini bisa terkirim ke atlet karena corporate governance yang lemah di dalam entiti. Di lain sisi, tidak adanya perbedaan yang signifikan di laporan keuangan dan prinsip corporate governance antara organisasi olahraga dan perusahaan Australia yang terdaftar.
ABSTRACT
There has been an increasing number of drug use problem in sport over the last
four decades. Financial stakes involved in professional sport create powerful
incentives for the use of performance enhancing substances. However, at the same
time, detection of drug use in sport can undermine the good standing of sport,
bringing it into disrepute, and fracturing the relationship it has with sponsors.
Results indicate that using drug enhancing performance will likely to raise issue in
ethics Furthermore, the drug itself can be administered to players because the
entities have applied weak corporate governance. On the other hand, the
annual/financial report and corporate governance practices are alike between
sporting organisation and listed Australian company., There has been an increasing number of drug use problem in sport over the last

Thesis ini berpusat pada skandal kasus Cronulla Sharks Rugby Leagues Club dan Essendon Football Club yang terjadi pada tahun 2013. Makalah ini akan rnencakup apa saja yang terjadi saat peristiwa tersebut berlangsung dan bagairnana peristiwa tersebut dapat terjadi.
ABSTRACT
Ethical considerations are a fundamental component of a company. Such company is expected to maintain ethical behavior in their working and personal lives so that it is accepted by the community. This assignment stresses on Cronulla Sharks Rugby Leagues Club Drugs Scandal and Essendon Football Club Drug Scandal, which happened in 2013. It covers on what happened during the scandal, what and how could the scandal happened."

Pada awal 2013, dua klub olahraga utama profesional Cronulla Sharks dari NFL dan AFL Essendon terungkap terlibat dalam penyelidikan ASADA berkaitan dengan dugaan penggunaan obat-obatan terlarang oleh pemain kedua klub tersebut. Hasil penyelidikan menemukan bahwa kedua tim menyewa ilmuwan olahraga yang sama, Stephen Danks, yang kemudian memprakarsai program untuk memasok pemain dengan zat yang dilarang termasuk CJC-1295, GHRP-6, dan AOD-9604. A Tale of Two Football Codes: Shortcomings in Corporate Governance = Kisah Dua Kode Olahraga: Kekurangan Tata Kelola Perusahaan
"Kegagalan dalam mengaplikasikan corporate governance yang benar akan membuat banyak pertanyaan tentang operasi sebuah bisnis apapun bidnangnya. Bidang olahraga pun bukan pengecualian. Beberapa tahun lalu di Australia, dua klub olahraga menjadi sorotan setelah menggunakan obat-obatan terlarang. Kedua tim ini adalah dua tim dari kompteisi yang berbeda, yaitu Essendon FC dari Austarlian Football League (AFL) dan Cronulla Sharks dari National Rugby League (NRL).
Penggunaan obat-obatan terlarang sudah dilarang oleh Komite Olimpiade Internasional karena obat-obatan tersebut bisa memberikan kemampuan fisik yang melebihi kemampuan normal seorang atlet. Kapabilitas yang didapatkan dari obat-obatan terlarang ini membuat klub-klub olahraga tertarik untuk menyalah gunakannya karena obat-obatan ini bisa membantu mereka memenangkan kompetisi.
Dari kasus ini, kita akan melihat bahwa kedua tim tidak mengikuti standar-standar etika yang sudah diberlakukan oleh Accounting Professional and Ethical Standards Board (APESB) dan tidak memperlihatkan praktik corporate governance yang baik.
Corporate governance failure may raise questions regarding a business’ operation whatever the industry the business is in. Sporting industry is not an exception. A few years ago in Australia, two sporting teams has been under the spotlight for use of sport enhancing drugs. Two of these teams are two sporting teams from two different competitions, Essendon FC from the Australian Football League (AFL) and Cronulla Sharks from the National Rugby League (NRL).
Use of performance enhancing drugs are prohibited by the International Olympic Committee as it may give an athlete the handicap of increase in physical ability. The capabilities given by a performing enhancing drugs has tempted sporting teams or athletes to abuse these drugs in order to win competitions.
It can be seen from this case that both teams has failed to compile with some ethical standards set by Accounting Professional and Ethical Standards Board (APESB) and unable to show any good corporate governance practice."

Aspek hukum good corporate governance menurut undang-undang N0. 40 tahun 2007 tentang perseroan terbatas
"Krisis ekonomi yang melanda Asia khususnya Indonesia pada pertengahan tahun 1997 diyakini karena lemahnya penerapan Good Corporate Governance (GCG) di dalam sistem perbankan nasional dan korporasi kita. Tesis ini membahas mengenai penerapan Good Corporate Governance (GCG) di Indonesia dimana dapat didorong dari dua sisi, yaitu etika dan peraturan. Penelitian yang dikembangkan adalah penelitian normatif.
Hasil dari penelitian ini, pada dasarnya dari sisi peraturan, Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas telah menerapkan prinsip-prinsip dasar GCG yaitu transparansi, kewajiban, pertanggungjawaban, kemandirian dan yang terakhir kewajaran dan kesetaraan. Akan tetapi karakteristik Perseroan di kawasan Asia Tenggara khususnya Indonesia adalah tingginya konsentrasi kepemilikan dan pengendalian pada sekelompok keluarga/grup usaha. Sebagaimana yang terjadi di dalam manajemen Bank X dimana pemegang saham pengendali ikut dalam mencampuri urusan operasional Perseroan yaitu dengan mempengaruhi kebijakan manajemen Perseroan. Atas tindakannya tersebut pemegang saham telah melanggar prinsip akuntabilitas yang berujung tidak independe-nya masing-masing Organ Perseroan.
Economy crisis that hitted in Asia especially Indonesia in the middle of the 1997 believed because the weakness application of Good Corporate Governance (GCG) in our national banking system and our corporation. This thesis focus to the application of good corporate governance (GCG) in Indonesia where pushed from two sides, that is ethics and regulation. This research uses normative research.
The result of normative research, basically from regulation side, Limited Liability Regulation Number 40th,2007 has applied base principles GCG that is Transparency, Accountability, Responsibility, Independence and Fairness. But the characteristics of company at south east asia especially indonesia is highly property concentration and control by group family / group business. In the same manner as happened in X Bank management where does controller shareholder get involved in company operational activity with influence company management policy. Cause of his action, shareholder has broken accountability principle pointed each of Organ Perseroan can not work independent."

"Good Corporate Governance sebagai suatu sistem pengelolaan Perusahaan yang bertujuan tidak hanya untuk melindungi kepentingan pemegang saham, tetapi juga untuk melindungi kepentingan stakeholder lainnya secara seimbang. Pekerja/buruh sebagai salah satu dari stakeholder memiliki peranan penting dan menjadi tolak ukur dalam mewujudkan Good Corporate Governance. Peranan pekerja sebagai stakeholder tergantung pada peraturan perundang-undangan di bidang ketenagakerjaan, yaitu Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Salah satu ketentuan yang diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan adalah mengenai Perjanjian Kerja Bersama yang merupakan ketentuan pelaksanaan dari undang-undang tersebut.
Perjanjian Kerja Bersama merupakan suatu perikatan yang dibuat antara Pekerja/buruh dengan Pengusaha yang merupakan media/sistem di dalam terciptanya Good Corporate Governance dengan mengatur hak dan kewajiban kedua belah pihak. Oleh karena itu, penerapan prinsip-prinsip Good Corporate Governance di dalam Tata Cara Pembuatan dan Ruang Lingkup Materi dari Perjanjian Kerja Bersama sangat diperlukan.
Dalam penyusunan tesis ini, penulis menggunakan metode penelitian yang bersifat deskriptif analisis, yaitu dengan membuat uraian yang jelas dan sistematis mengenai sesuatu untuk dianalisa guna mendapatkan fakta yang diinginkan dalam hal ini penerapan prinsip-prinsip Good Corporate Governance pada tata cara pembuatan dan materi Perjanjian Kerja Bersama pada salah satu perusahaan.
Good Corporate Governance as a system of company management which aims not only to protect the interests of shareholders, but also to protect the interests of other stakeholders in a balanced. Workers/labours as one of the stakeholders have an important role and become an assessment in the realization of Good Corporate Governance. The role of workers as stakeholders depending on the labour regulation, there is Act Labour Number 13 Year 2003. One of the regulation which is regulated in Act Labour Number 13 Year 2003 is Collective Labour Agreement which as the implementing regulation of that Act Labour.
Collective Labour Agreement is a commitment made between workers/labours with entrepeneurs/corporate owner, which is a media/systems in the creation of Good Corporate Governance, to regulate the rights and obligations of both parties. Therefore, the implementation of the principles of Good Corporate Governance in the Making Procedures and Material Scope of the Collective Labour Agreement is required.
In the preparation of this thesis, the author use research methodology which is descriptive analysis, by making a clear description and systematic about something to be analyzed in order to obtain the desired facts, in this case the implementation of the principles of Good Corporate Governance in making procedures and materials Collective Labour Agreements in one company."
