"Nothing in the Uruguay Round mentions directly about rights of private economic actors. It seems that the relationship to private economic actors (or may be individual) does not exist within the WTO Agreements, because as a general rule, private parties are not legal subjects of the international legal order. However, this article will prevail upon this situation, by looking closer at the essence of the WTO Agreements to discern the rights of private economic actors that derive from the WTO. The main question of this article is to what extent then Indonesia is dealing with the rights of private economic actors under the WTO Agreements? The background of this questionis because four years after ratifying the WTO Agreements, Indonesia has been facing what is arguably the most serious multidimensional crisis in 1997, some difficult situations have arisen from the crisis; therefore, the society hesitated to accept the open world trading system. The society seemed look askance to the implementation of the WTO Agreements. But Indonesian Government took major step to reduce the skepticism of society toward liberalization, by readjusting its national laws conform to the WTO Agreements with the intention to support the rights of national economic actors under the WTO Agreements in order to achieve total benefits of the WTO rules."

"Indonesia will be welcoming the ASEAN Economic Community in 2015 as a multilateral agreement
to create integrated regions such as: (a) a single market and production base, (b) a highly
competitive economic region, (c) a region of equitable economic development, and (d) a region
fully integrated into the global economy. These characteristics are interrelated and mutually
reinforcing in a sense that overall development would not be complete without total completion
of the previous sector. This article discusses the participation of Indonesia as part of ASEAN as a
single market and production base, through free flow of services which targets higher education
in law. The author researched that Indonesian higher education system still faces issues, especially
in legal education. As a result, the quality of Indonesian law graduate still varies. Indonesian legal
education is special in nature since it is considered profession and regulated by code of ethic.
According to the author, legal education should be integrated with profession organization so
that upon graduation, law graduates can directly conduct internship according to their desired
profession and compete against ASEAN law graduates.
Indonesia akan menghadapi ASEAN Economic Commmunity pada tahun 2015 sebagai realisasi
perjanjian multilateral untuk menciptakan wilayah terintegrasi seperti: (a) pusat produksi dan
pasar tunggal, (b) wilayah ekonomi yang kompetitif, (c) wilayah yang memiliki perkembangan
ekonomi yang memadai, dan (d) wilayah yang terintegrasi dengan ekonomi global. Karakteristik
ini saling berhubungan dan mendukung dalam arti semua perkembangan ini tidak akan lengkap
tanpa terpenuhinya semua persyaratan tersebut. Artikel ini membahas partisipasi Indonesia
sebagai anggota ASEAN mengenai potensi pendidikan tinggi dalam bidang hukum sebagai sektor
jasa. Akibatnya kualitas lulusan hukum di Indonesia masih beraneka ragam secara nasional.
Pendidikan hukum itu sifatnya khusus karena berupa profesi dan diatur oleh kode etik. Menurut
hemat penulis, seharusnya pendidikan hukum terintegrasi dengan lembaga profesi, sehingga
lulusan sarjana hukum sudah memiliki sertifikasi untuk langsung magang menurut profesinya
masing-masing dan bersaing dengan lulusan hukum dari ASEAN."

"Industri fashion Indonesia merupakan industri yang sedang berkembang pesat saat ini. Hasil rancangan perancang mode Indonesia merupakan salah satu obyek yang dilindungi oleh Undang-undang Nomor 31 Tahun 2000 tentang Desain Industri. Penelitian ini adalah penelitian non-doktrinal di bidang hukum yang mencari tahu bagaimana fakta-fakta seputar penerapan Undang-undang Desain Industri dalam industri fashion Indonesia, khusunya jika dikaitkan dengan perlindungan terhadap hasil rancangan para perancang mode dan bagaimana perspektif perancang mode Indonesia mengenai undang-undang tersebut. Hasil penelitian menyarankan bahwa perlu adanya sosialisai yang lebih terstruktur guna dapat menjangkau lebih banyak kalangan, salah satunya adalah desainer Indonesia.

Indonesia's fashion industry is growing rapidly at this time. Fashion items created by Indonesian fashion designer is one of the objects that are being protected by Law No. 31, 2000 regarding Industrial Design. This research is a non-doctrinal study in the field of law to find out the facts about the implementation of Law No. 31, 2000 regarding Industrial Design in Indonesia's fashion industry, especially if associated with the fashion items created by Indonesian fashion designers and their perspective about the law. Result of the study suggest that Law No. 31, 2000 regarding Industrial Design still needs more structured socialization or promotion to reach more circles, such as Indonesian fashion designer.

"Pada skripsi ini dibahas mengenai konsep perlindungan investor di dalam Perjanjian Bilateral Investasi (Bilateral Investment Treaty/BIT) dan definisi seputar investasi dan penanaman modal asing merujuk kepada pengertian secara global dan definisinya sesuai dengan perundang-undangan Indonesia. Selain itu, di dalam skripsi ini akan diberikan pula definisi seputar BIT dengan menyertakan contoh BIT Inggris-Indonesia sebagai kajian utama dan dua buah kasus arbitrase internasional terkait penanaman modal asal Inggris di Indonesia, yaitu kasus Churchill Mining Plc melawan Pemerintah Indonesia dan kasus Rafat Ali Rizvi melawan Pemerintah Indonesia. Dua buah kasus ini kemudian dibandingkan dan dijadikan patokan bagi Penulis untuk menentukan sejauh mana BIT Inggris- Indonesia dalam melindungi penanaman modal yang dilakukan oleh penanam modal asal Inggris.

The main discussion of this thesis is the concept of investor protection in the Bilateral Investment Treaty (BIT) and the global definition of foreign investment and its definition referring to Indonesian Law. This definition of BIT will be provided in this thesis with also a study of BIT between UK and Indonesia, and two cases related to British investment in Indonesia as examples. These cases are the dispute between Churchill Mining Plc and The Government of Indonesia and Rafat Ali Rizvi and The Government of Indonesia. These two cases will be compared and used as a benchmark for the Author to determine the extent to which the UK-Indonesia BIT protection protects the investment made by UK investors."

"Hukum persaingan usaha adalah salah satu instrumen yang wajib ada di dunia global ini. Keberadaan hukum persaingan usaha mengharuskan adanya lembaga yang menjalankan fungsi penegakan hukum persaingan usaha tersebut. Kewenangan yang dimiliki oleh institusi penegak hukum persaingan usaha berdampak besar terhadap efektifitas penegakan hukum persaingan usaha. UU No. 5 Tahun 1999 mengamanatkan penegakan hukum persaingan usaha di Indonesia untuk dilaksanakan oleh Komisi Pengawas Persaingan Usaha (KPPU). Amerika Serikat adalah Negara yang sudah sejak dulu menegakkan hukum persaingan usaha, Federal Trade Commission Act melahirkan Federal Trade Commission (FTC), yaitu institusi penegak hukum persaingan usaha di Amerika Serikat. Kewenangan yang dimiliki FTC sangat besar. Perbandingan kewenangan antara FTC dan KPPU akan melihat celah perbedaan antar kewenangan yang dimiliki masing-masing lembaga.

Competition is a compulsory instrument of the global world. The existence of competition law requires an institution for the enforcement of the law. Authority of competition law enforcer has a big effect to the effectiveness of the enforcement of competition law. Law No. 5 Year 1999 mandated KPPU to enforce competition law in Indonesia. United States of America has been enforcing antitrust law from very long ago. Federal Trade Commission Act create a competition law enforcement agency named The Federal Trade Commission. Federal Trade Commission has a very broad scope of enforcement authority. By comparing KPPU's and FTC's law enforcement authority, the difference from each agency can be revealed. "
