"A cluster of Asian states are well-known for their authoritarian legality while having been able to achieve remarkable economic growth. Why would an authoritarian regime seek or tolerate a significant degree of legality and how has such type of legality been made possible in Asia? Would a transition towards a liberal, democratic system eventually take place and, if so, what kind of post-transition struggles are likely to be experienced? This book compares the past and current experiences of China, Hong Kong, South Korea, Japan, Taiwan, Singapore, and Vietnam and offers a comparative framework for readers to conduct a theoretical dialogue with the orthodox conception of liberal democracy and the rule of law."

"Indonesia is the world's third largest democracy and its courts are an important part of its democratic system of governance. Since the transition from authoritarian rule in 1998, a range of new specialised courts have been established from the Commercial Courts to the Constitutional Court and the Fisheries Court. In addition, constitutional and legal changes have affirmed the principle of judicial independence and accountability. The growth of Indonesia's economy means that the courts are facing greater demands to resolve an increasing number of disputes. This volume offers an analysis of the politics of court reform through a review of judicial change and legal culture in Indonesia. A key concern is whether the reforms that have taken place have addressed the issues of the decline in professionalism and increase in corruption. This volume will be a vital resource for scholars of law, political science, law and development, and law and society."

"Paradigmatic transition is the idea that ours is a time of transition between the paradigm of modernity, which seems to have exhausted its regenerating capacities, and another, emergent time, of which so far we have seen only signs. Modernity as an ambitious and revolutionary sociocultural paradigm based on a dynamic tension between social regulation and social emancipation, the prevalent dynamic in the sixteenth century, has by the twenty-first century tilted in favour of regulation, to the determent of emancipation. The collapse of emancipation into regulation, and hence the impossibility of thinking about social emancipation consistently, symbolizes the exhaustion of the paradigm of modernity. At the same time, it signals the emergence of a new paradigm or new paradigms. This updated 2020 edition is written for students taking law and globalization courses, and political science, philosophy and sociology students doing optional subjects."

This research discusses the application of the principle of legality in the context of criminal procedure law in Indonesia, specifically through an analysis of the Draft Law on Criminal Procedure (RUU HAP) discussed in DPR meetings between 1979 and 1981 and the pretrial decision of Angin Prayitno. The principle of legality, which serves to protect human rights, became fundamental in the Criminal Procedure Code (KUHAP) passed in 1981. This research uses a doctrinal method to trace the legislative process of the Criminal Procedure Bill and its relevance to western legal thought. This research highlights the principle of legality in the discussion of the Draft Law on Criminal Procedure, which is actually a principle that limits law enforcement officials to implement criminal procedure law to act in accordance with the law. This principle of legality is a fulfillment of the elements of the rule of law and the design of legal codification and unification as an effort to fulfill human rights. Through a case study of Angin Prayitno's pretrial decision, it was found that the judge failed to properly apply the principle of legality in determining the status of the applicant. In the decision Number 68/Pid.Pra/2021/PN Jkt.Sel that enuilt researched, the judge did not provide any legal basis in determining Angin Prayitno's status as a law enforcement officer, which is not in accordance with the concept of the principle of legality. The judge is also incorrect in expanding the State Organizer which in the Act has actually been limited.  The conclusion of this research shows that the application of the principle of legality in KUHAP still faces various challenges, especially in judicial practice. The author recommends the need for increased understanding so that the application of the principle of legality can be implemented properly to ensure the protection of human rights and justice in the criminal law system in Indonesia and the achievement of the ideals of the Rule of Law."
