"Banyak pihak memuji keberhasilan pemerintah Indonesia dalam menjalankan strategi kontra-terorismenya. Keberhasilan ini antara lain ditunjukkan dengan kemampuan densus 88 menangkap para pelaku, anggota serta pendukungnya. Keberhasilan ini didukung pula dengan kemampuan intelejen nasional dalam mengumpulkan informasi. Walaupun begitu pemerintah harus melakukan strategi yang lebih komprehensif, tidak hanya menggunakan pendekatan secara 'hard' namun juga 'soft'. Strategi ini harus dibuat secara terpadu dan menyeluruh, mulai dari upaya preventif, penangkapan, rehabilitasi sampai pada program pengawasan."

"The present study set out from the condition that Indonesia has many counter-terror units each of which executes order from different institutions. Therefore, there are many questions about effectiveness and efficiency of the current counter terrorism management system. In the operational level, it creates some problems on response, and also problem on ruling, preventing, and problem on policy coordination.
In terms of research methodology, the present study is planned to pattern the case-study research strategy and collects data from interview, observation, and document searching. On the other hand, research is conducted in three stages: planning, actuating, and reporting.
Using modeling approach, the present study analyzes current Indonesian Counter-Terrorism System whether it uses convergence and divergence approach in order to improve counter-terror system in Indonesia. Convergence approach consists of clustering model and integration model. Meanwhile divergence approach consists of coordination model and networking model.
The organizational structure of counter-terror system, which is formed pooled interdependence model. is marked by internal dynamics which, among others, are reflected both in fractionalization and disappointed expectations and which manifest themselves in differences of the traditional war /whims as well as differences of perception and evaluation among military leadership. This present study proposes alternative by using Convergence Model in the organizational structure of Counter-Terror Management System. Building preventive culture is also recommended."

"ABSTRAK
Pasca terjadinya serangan 9/11, angka serangan teror yang berasal dari kelompok
teroris transnasional mengalami peningkatan. Menurut data Europol dari tahun 2006-
2012, Inggris, Spanyol dan Perancis mengalami serangan teror yang lebih dominan
jika dibandingkan dengan negara Uni Eropa yang lainnya. Namun dari data tersebut,
Inggris merupakan negara dengan angka rata-rata serangan teror terendah. Tesis ini
membandingkan upaya Inggris, Spanyol dan Perancis dalam menanggulangi
ancaman terorisme menggunakan kerangka analisa strategi penggentaran. Data
mengenai penanggulangan terorisme di ketiga negara dianalisis secara kualitatif
menggunakan tiga elemen strategi penggentaran, yaitu penggentaran dengan
hukuman, penggentaran dengan penangkalan, dan penggentaran dengan insentif.
Berdasarkan data dari penelitian ini, disimpulkan bahwa keberhasilan Inggris terletak
pada kemampuan pemerintahnya dalam mengkombinasikan pendekatan keras (hard
approach) dan pendekatan lunak (soft approach) serta meningkatkan partisipasi
masyarakat yang tidak terdapat pada penanggulangan terorisme Spanyol dan
Perancis. Selain itu, keberhasilan Inggris juga didukung oleh mekanisme kontrol
imigrasi yang dipegang sepenuhnya oleh Pemerintah Inggris.

ABSTRACT
After the event of 9/11, the number of attacks from transnasional terrorist group has
been significantly increasing. According to The Europol’s data from 2006 to 2012,
United Kingdom, Spain and France encountered more dominant terror attacks
compared to other countries including those in European Union . However, the data
shows that, UK had the lowest number of terror attack from three countries. This
thesis compares the efforts of UK, Spain and France in tackling the threat of terrorism
using deterrence strategy framework. Data concerning counter terrorism in three
countries was analyzed using qualitative method with three elements of deterrence
strategy namely deterrence by punishment, deterrence by denial, and deterrence by
incentive. Based on the result of the research, UK’s success due to its government’s
capability to combining hard and soft approach and as well as to increase society’s
active participation in implementing counter terrorism’s policy. Moreover, UK’s
success was also supported by immigration control mechanism that was fully handled
by British Goverment."

"ABSTRAK
Tragedi Bom Bali di Legian Kuta pada tanggal 12 Oktober 2002 membawa isu terorisme ke garis depan pemikiran keamanan di Indonesia. Karena serangan yang mendadak, banyak korban yang tewas. Konstitusi Indonesia UUD 1945 mengamanatkan negara untuk bertanggungjawab melindungi segenap bangsa Indonesia dan seluruh tumpah darah Indonesia. Untuk mencapai tujuan ini pemerintah Indonesia yang merumuskan sebuah kebijakan. Kebijakan adalah produk dari proses politik dimana dilakukan pemisahan atau pembagian kekuasaan. Salah satu bentuk kebijakan adalah kebijakan kriminal yang mengatur respon hukum masyarakat dan strategi pemberantasan kejahatan yang dilakukan secara formal oleh negara. Saat ini dalam kebijakan pidana Indonesia, terorisme didefinisikan sebagai tindak pidana. Hal ini telah menjadi perdebatan panjang karena ambiguitas dalam definisi teror dan telah menghasilkan multitafsir karena ketidakjelasan definisi teror. Banyak orang kuatir definisi teror ini akan diterjemahkan bebas oleh para pemangku kepentingan. Akibatnya, tujuan ideal dari suatu kebijakan tidak dapat dicapai, sebaliknya malah menghasilkan masalah baru yang mencederai demokrasi. Penelitian kriminologis ini dilakukan dengan menggunakan metode penelitian kualitatif untuk mengumpulkan data. Dalam hal menganalisis data, digunakan teori hegemoni Gramsci Antonio serta teori kriminologi konstitutif Stuart Henry dan Dragan Milovanovic. Penelitian ini menyimpulkan bahwa negara telah memainkan peran penting untuk merumuskan strategi kontra terorisme di Indonesia dengan pendekatan Penegakan Hukum dalam rangka perlindungan terhadap hak asasi manusia pada kerangka demokrasi. Meskipun demikian, model Penegakan Hukum ini tetap harus didukung oleh langkah-langkah pencegahan yang akan diatur dalam kebijakan sosial untuk menjaga keseimbangan antara kekuatan koersif dan kekuatan persuasif.

ABSTRACT
The tragedy of Bali Bombing in Legian-Kuta in October 12, 2002 brought the issue of terrorism to the forefront of Indonesia’s security thinking. Due to the suddenness of attack, a large number of people were killed. The Constitution of Indonesia UUD 1945 has mandated the state to be responsible to protect all Indonesian people and Indonesia’s motherland. To achieve this purpose Indonesia’s government formulated a policy. Policy is a product of the political process under which circumstances separation or distribution of power is executed. One form of policies is criminal policy which regulates legal responses of the society and the strategy on crime eradication that legalized formally by the state. Currently in Indonesia’s criminal policy, terrorism is defined as criminal act. This has been a long debate because of the ambiguities in the definition of terror and has produced multi-interpretation because it does not clearly specify the definition of terror. Most people feel anxious this the definition of terror interpreted freely by stakeholders. As a result, the ideal purpose of a policy could not be achieved, on the contrary it will produce a new problem that harms democracy instead. This criminological research is conducted by using qualitative research methods to collect data. In order to analyze the data, the theory of hegemony Antonio Gramsci as well as the theory of constitutive criminology Stuart Henry and Dragan Milovanovic were applied. This research concludes that the state has played an important role to formulate Indonesia’s counter terrorism strategy in Law Enforcement model due to the protection of human rights in the democracy framework. However, this Law Enforcement model should be supported by the preventive measures which will be regulated under social policy to keep the coercive power and the persuasive power balance."
