"Perlindungan terhadap merek terkenal merupakan konsekuensi dari Konvensi TRIPS Agreement, walaupun kriteria merek terkenal telah diatur dalam UUM, namun sampai saat ini masih menimbulkan multi interprestasi. Bagaimanakah perlindungan merek terkenal terdaftar terhadap pihak lain yang mendaftarkan merek terkenal yang sama atau serupa untuk jenis barang yang berbeda?, apakah didalam sengketa merek dapat diajukan upaya hukum Peninjauan Kembali mengingat Undang-Undang Merek Tidak mengatur upaya hukum sampai dengan Peninjauan Kembali. Jenis Penelitan ini merupakan penelitian hukum normatif yuridis, cara dan alat pengumpulan data menggunakan penelitian kepustakaan yaitu data sekunder yang diperoleh baik melalui sumber hukum primer (peraturan perundang-¬undangan) maupun sumber hukum sekunder yaitu buku, internet, dan lain-lain. Masih perlunya ditingkatkan pemahaman mengenai perlindungan merek terkenal tidak hanya dikalangan Hakim Pengadilan Niaga namun juga dikalangan Direktorat Jenderal HaKI Merek, para konsultan HaKI, para pengusaha/pendaftar merek untuk diharuskan berkonsultasi terlebih dahulu dengan konsultan HaKI sebelum mendaftarkan suatu merek, dan masih perlu ditingkatkan perlindungan khususnya untuk merek-merek yang sudah masuk daftar sebagai merek terkenal, tanpa perlu para pemilik merek terkenal melindungi mereknya dengan mendaftarkan mereknya di semua jenis kelas barang dan/atau jasa. Walaupun Undang-Undang Merek tidak mengatur Upaya hukum sampai dengan Peninjauan Kembali, namun tetap dimungkinkan didalam suatu sengketa merek diajukannya upaya hukum Peninjauan Kembali.

The protection over a renowned brand is one of the consequences of the implementation of TRIPS Agreement Convention. However, despite the criteria for such brands have been regulated in the Law concerning Brand, in reality it still stimulates the occurrence of multi-interpretation by many parties. The questions to be addressed in this research is are as follow: How is the protection of a renowned registered brand towards other party who registers the similar renowned brand, but of different type goods?. Is there any possibility to conduct a Legal Review, recalling that the current Law regulating Brand doesn't regulate the matter up to the phase mentioned? This research is a normative juridical research, using the library research as the data collecting method, comprising secondary data gathered from both primary legal source (Law Regulations} as well as secondary ones, consisting of books, internet, and other resources. There is a need to improve the understanding concerning the protection of a renowned brand, not only for the judges responsible for the Trade Affairs, but also for the officials in the Directorate General of Brand IPR, the consultants deal with this matter, as well as the businessmen/the applicants. It is recommendable particularly for the applicants to have a consultation with the consultants before they apply to register for a brand. Another thing to be noted is the need to improve and refine the protection of the renowned registered brands, up to the point that enables the owners not to register all his brands in every categorized class of goods and services. Even though the Brand Law doesn't regulate any specific legal effort up to the point of legal review, it is still possible to conduct a legal review in a dispute over a brand."

"Penelitian ini bertujuan untuk mempelajari apakah efek pengamat (audience effect) mempengaruhi kinerja tugas visual pada individu. Penelitian ini menggunakan desain penelitian eksperimental dengan dua kelompok independen. Partisipan dalam penelitian ini adalah 30 mahasiswa dari The University of Queensland (UQ) yang dibagi rata ke dalam dua grup berbeda secara acak. Partisipan dalam kelompok pertama mengerjakan tugas visual, yaitu Spot the Difference Task di bawah pengamatan evaluatif dari eksperimenter sedangkan partisipan dalam kelompok kedua mengerjakan tugas yang sama tanpa pengamatan evaluatif dari eksperimenter. Keberadaan pengamatan evaluatif di kelompok pertama diprediksi menurunkan kinerja partisipan. Hasil dari penelitian ini menunjukkan bahwa tidak ada perbedaan dalam hal kinerja antara dua kelompok partisipan.Dengan demikian, efek pengamat pada kinerja tugas visual tidak dapat ditunjukkan dalam penelitian ini. Selain itu juga tidak ada perbedaan perasaan dievaluasi antara kedua kelompok, yang menunjukkan bahwa pengamatan evaluatif di salah satu kelompok tidak cukup untuk menghasilkan penurunan kinerja seperti yang diperkirakan berdasarkan teori evaluation apprehension dan penelitian-penelitian yang lalu.

The present study attempted to examine whether or not audience effect had an effect on individuals visual task performances. This study was an independent-groups experiment. Participants were 30 UQ students randomly assigned into two different groups. They were asked to do a Spot the Difference Task under the presence of evaluative observers in one group, and without the presence of evaluative observers in the other. The present study found no group difference in task performance; suggesting no audience or evaluation apprehension effect on task performance could be shown in this study. It also appears that there was no difference in the feeling of perceived evaluation between participants in two groups suggesting that the evaluative observation in one group did not elicit enough audience effect to deteriorate task performance as predicted based on evaluation apprehension theory and past findings."

"Artikel ini membahas penggambaran dominasi tokoh Ibu dan gugatan yang terdapat dalam film J`ai Tué Ma Mère karya Xavier Dolan melalui aspek naratif dan sinematografis film. Analisis yang dibuat didukung dengan konsep kekuasaan Michel Foucault untuk melihat bentuk dominasi sosok ibu yang terjadi dalam film. Kekuasaan merupakan landasan dari terbentuknya dominasi yang menimbulkan adanya represi terhadap orang lain, termasuk di dalam lingkup keluarga. Hasil analisis melalui aspek naratif dan sinematografis film menunjukkan bahwa dominasi terbentuk akibat adanya kegagalan komunikasi yang terjalin antartokoh dan menyebabkan terbentuknya resistensi yang dilakukan oleh tokoh yang terdominasi, dalam hal ini tokoh anak laki-laki. Kekuasaan dan dominasi sosok ibu yang sangat besar dalam kehidupan tokoh anak laki-laki tersebut menyebabkan masalah dan konflik yang terjadi diantara keduanya, sehingga hal tersebut menimbulkan jarak dalam hubungan antara ibu dan anak. Resistensi yang dilakukan oleh tokoh yang terdominasi bertujuan untuk menggugat kekuasaan atas dominasi yang diterimanya. Dominasi yang ada juga diperkuat oleh faktor budaya matriarkal di dalam budaya masyarakat Qu ? bec yang merupakan latar dalam film J`ai Tué Ma Mère.

This article discusses the depiction of Mother domination and the lawsuit contained in J`ai Tué Ma Mère by Xavier Dolan through the narrative and cinematographic aspects of the film. The analysis made is supported by the concept of power by Michel Foucault to see the form of dominance of the mother figure that occurs in the film. Power is the cornerstone of the formation of dominance that gives rise to repression against others, including within the family. The results of the analysis through the narrative and cinematographic aspects of the film show that the dominance is formed due to communication failure that exists between forces and causes the formation of resistance by dominated figures, in this case is figure of a son. The very great power and dominance of mother figure in the life of the son causes problems and conflicts between them, thus causing distance in the relationship between mother and child. Resistance by dominated figure aims to sue power over domination that he recieves . The dominance is also reinforced by matriarchal cultural factors within the culture of the Qu ? bec community which is the setting in the film J`ai Tué Ma Mère."
