Pembahasan dalam skripsi ini adalah perlindungan hukum kreditur dengan hak istimewa dalam PKPU, dengan studi kasus PT Bakrie Telecom. Pasal 1137 KUHPerdata telah mengatur secara jelas bahwa kedudukan tagihan terhadap kas negara merupakan tagihan yang diutamakan pembayarannya karena merupakan tagihan dengan hak istimewa. Adanya ketentuan tersebut dimaksudkan untuk mendahulukan kepentingan negara dalam hal ini piutang negara yang tidak dibayarkan oleh PT Bakrie Telecom melalui Kominfo. Penelitian ini adalah penelitian yuridis normatif dengan tipologi penelitian deskriptif. Dalam penelitian ini yang menjadi pokok perasalahan adalah apakah kedudukan Kominfo sebagai kreditor konkuren dalam PKPU PT Bakrie Telecom telah sesuai dengan Undang- Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang dan bagaimana upaya hukum yang dapat diajukan oleh Kominfo atas putusan homologasi tersebut sebagai bagian dari perlindungan hukum terhadap kreditor dengan hak istimewa. Pada akhirnya, peneliti memperoleh kesimpulan bahwa kedudukan Kominfo dalam PKPU PT Bakrie Telecom telah tidak sesuai dengan undang-undang yang berlaku yang oleh karena itu harus diajukan upaya hukum sebagai perlindungan terhadap kreditur dengan hak istimewa.

ABSTRACT
The main analysis of these bachelor thesis is focus on the legal protection of privileges creditors in Suspension of Debt Payment Obligations (PKPU) in correlation with PT Bakrie Telecom case studies. Article 1137 Civil Code of Indonesia mentioned comprehensibly regarding the position of state treasury debt as debt with privilege. The regulations intended to precedence the interest of states, thus, PT. Bakrie Telecom is not accomplish the obligation towards Ministry of Communication and Information (Kominfo). The research is based on normative juridical with typology descriptive study. The research is focus on the position of concurrent creditors under Suspension of Debt Payment Obligations (PKPU) of PT. Bakrie Telecom, which, pursuant to Law No. 37 Year 2004 regarding the Bankruptcy and Suspension of Payment, including the legal remedies Ministry of Communication and Information (Kominfo) to pursue; regarding the homologation decision as the legal protection of privileges creditor. Enclosing, the research conclusion is the position of Ministry of Communication and Information (Kominfo) is not in accordance with the applicable law in the grounds of the prior proposed remedies for protection against creditors with special privileges.
