ABSTRAK
Tesis ini membahas mengenai penanganan-penanganan kasus-kasus pidana yang dilakukan oleh anak melalui sistem peradilan pidana anak atau penyelesaian kasus yang diselenggarakan secara formal. Masih terdapat banyak permasalahan mengenai penanganan anak di setiap tingkat peradilan pidana terutama terkait perlindungan anak dan hak-haknya pada proses peradilan pidana dan tidak dijalankan sebagaimana mestinya upaya penyelesaian kasus melalui mekanisme diversi yang telah diamanatkan dalam Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, akibatnya ada begitu banyak anak yang ditahan dan dipenjara bahkan hingga kasus-kasus tindak pidana yang ringan. Dalam tesis ini penulis menggunakan metode yuridis normatif yaitu penelitian yang dilakukan melalui studi dokumen hukum berupa undang-undang, pandangan ahli hukum, putusan-putusan pengadilan, dan dokumen-dokumen lain yang terkait yang bertujuan untuk menjabarkan dan menganalisis mengenai penanganan anak yang berkonflik dengan hukum dan bagaimana pengaturan dan implementasi konsep diversi di Indonesia saat ini. Dari hasil analisis, penulis menemukan masih terdapat begitu banyak permasalahan terkait penyelesaian kasus anak secara formal, yakni masih belum adanya beberapa aturan pelaksana yang diamanatkan Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak terutama mengenai ketentuan pelaksanaan pidana non pemenjaraan, masih kurangnya sarana dan prasarana terkait pelaksanaan Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, dan masih belum baiknya kualitas dan kuantitas sumber daya manusia pelaksana undang-undang ini. Selain itu permasalahan lainnya yakni tidak dipatuhinya ketentuan-ketentuan dalam Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak baik saat anak diproses di tingkat kepolisian, kejaksaan, maupun pengadilan. Diantaranya masih seringnya penahanan dilakukan terhadap anak meski undang-undang mengamanatkan penahanan hanyalah sebagai upaya terakhir, jumlah lama penahanan yang tidak sesuai ketentuan, belum efektifnya pendampingan kepada anak baik itu oleh Balai Pemasyarakatan, Advokat, Pekerja Sosial, dan lain sebagainya, tuntutan jaksa dan putusan hakim yang berorientasi pemenjaraan, dan laporan peneliti kemasyarakatan yang belum maksimal dilakukan. Kemudian masih ditemukannya banyak kasus pidana anak yang tidak diselesaikan melalui diversi meski telah memenuhi syarat untuk dilakukan diversi.

ABSTRACT
This research discusses the handling of criminal cases committed by children through the juvenile criminal justice system or the settlement of cases that are held formally. There are still many problems regarding the handling of children at every level of criminal justice, especially related to the protection of children and their rights in the criminal justice process and are not carried out properly as an effort to resolve cases through a diversion mechanism that has been mandated in Law No. 11 of 2012 concerning the Child Criminal Justice System, as a result there are so many children who are detained and imprisoned even to cases of minor criminal acts. In this research the author uses the normative juridical method, namely research conducted through the study of legal documents in the form of laws, views of legal experts, court decisions, and other related documents that aim to describe and analyze the handling of children in conflict with the law and how the regulation and implementation of the diversion concept in Indonesia today. From the results of the analysis, the authors found that there were still so many problems related to the formal settlement of child cases, namely that there were still no implementing regulations mandated by Law No. 11 of 2012 concerning the Child Criminal Justice System, especially regarding the provisions of the implementation of non-imprisonment crimes, the lack of facilities and infrastructure related to the implementation of Law No. 11 of 2012 concerning the Criminal Justice System for Children, and the quality and quantity of human resources that implement this law are still not good. Besides that, another problem is the non-compliance with the provisions in Law No. 11 of 2012 concerning the Child Criminal Justice System both when children are processed at the police, prosecutors, and court levels. Among them the frequent detention of children is carried out even though the law mandates that detention is only a last resort, the length of detention that is not in accordance with the provisions, ineffective assistance to the child either by the Penitentiary, Advocates, Social Workers, etc., prosecutors' demands and decisions imprisonment-oriented judges, and social research reports that have not been maximally carried out. Then still found many child criminal cases that are not resolved through diversion even though it has met the requirements for diversion.

Abstrak :
Vestibulo Ocular Reflex VOR merupakan salah satu refleks keseimbangan vestibuler perifer yang berfungsi menjaga stabilitas visual saat bergerak sehingga VOR dapat menggambarkan keadaan vestibular perifer pada seseorang. Video Head Impulse Test VHIT merupakan pemeriksaan fungsi keseimbangan yang menilai fungsi VOR sehingga dapat menilai fungsi vestibuler perifer. Rentang nilai VOR yang dijadikan acuan pada pemeriksaan VHIT saat ini merupakan hasil penelitian di luar negeri, belum ada nilai VOR berdasarkan pengukuran di dalam negeri yang dapat dijadikan acuan. Penelitian ini bertujuan untuk mengetahui gambaran pemeriksaan VHIT dan nilai VOR gain pada orang dewasa tanpa gangguan keseimbangan. Penelitian ini adalah studi potong lintang dengan desain deskriptif pada 65 percontoh yang diambil secara konsekutif. Hasil penelitian ini didapatkan tidak terdapat perbedaan bermakna rerata VOR gain berdasarkan jenis kelamin dan kelompok usia 18 60 tahun. Rerata VOR gain lateral sebesar 1,11 dengan standar deviasi 13,5 dan indeks kepercayaan 95 berkisar antara 1,08 1,14. Rerata VOR gain anterior sebesar 1,11 dengan standar deviasi 0,28 dan indeks kepercayaan 95 berkisar antara 1,05 1,15. Rerata VOR gain posterior sebesar 1,01 dengan standar deviasi 0,26 dan indeks kepercayaan 95 berkisar antara 0,97 1,06. Pemeriksaan VHIT dapat melengkapi pemeriksaan keseimbangan yang sudah ada sehingga tatalaksana gangguan keseimbangan menjadi lebih baik.

Vestibulo Ocular Reflex VOR is one of the peripheral vestibular balance reflexes that serves to maintain visual stability while moving with the result VOR can describe the state of a peripheral vestibular system in a person. The Video Head Impulse Test VHIT is an examination of the balance function that assesses the function of the VOR in order to assess peripheral vestibular function. The range of VOR scores referenced that used in the current VHIT examination is the result of research abroad, there is no VOR value based on the domestic measurements that can be used as reference for VHIT examination. This study aims to determine the VHIT overview and know the value of VOR gain in adults without disturbance of balance. This study is a cross sectional study with descriptive design on 65 samples taken consecutively. The result of this study were there was no significant differences of average VOR gain between age and sex group. Average of lateral VOR gain was 1.11 with the standard deviation of 13.5 and the 95 confidence interval ranged from 1.08 to 1.14. The average of anterior VOR gain was 1.11 with the standard deviation of 0.28 and the 95 confidence interval ranged from 1.05 to 1.15. The average of posterior VOR gain is 1.01 with the standard deviation of 0.26 and the 95 confidence interval ranges from 0.97 to 1.06. VHIT examination complement the existing balance test so that the management of balance disorder is better.
