"ABSTRAK
Tesis ini membahas tentang gagasan pelembagaan constitutional question di Indonesia melalui perluasan kewenangan Mahkamah Konstitusi dalam menguji undang-undang terhadap Undang-Undang Dasar. Metode penelitian yang digunakan adalah metode yuridis normatif dengan menyertakan pula pendekatan perbandingan di negara-negara yang telah mengadopsi lembaga constitutional question. Hasil penelitian ini menunjukan bahwa lembaga constitutional question itu dapat ditempatkan sebagai bagian dari kewenangan pengujian konstitusional yang telah dimiliki Mahkamah Konstitusi berdasarkan ketentuan Pasal 24C ayat 1 UUD 1945. Selain itu hasil penelitian ini juga menunjukan bahwa terdapat kebutuhan atau urgensi, baik dari segi teori maupun praktek untuk melembagakan mekanisme constitutional question di Mahkamah Konstitusi. Oleh sebab itu pada bagian akhir penelitian ini dikemukakan suatu kesimpulan dan rekomendasi bahwa lembaga constitutional question ini sangat perlu dan sangat prospektif untuk segera diterapkan di Indonesia. Caranya cukup dengan melakukan perubahan terhadap undang-undang tentang Mahkamah Konstitusi dengan mengatur dan memasukan mekanisme constitutional question ini ke dalam undang-undang yang dimaksud, tanpa harus mengadakan perubahan terhadap UUD 1945.

ABSTRACT
This thesis will discuss the concept of constitutional question institutionalization in Indonesia by expanding the Constitutional Court s constitutional review authority against the Constitution. The method used in this research is juridical normative, which includes a comparative approach within countries that have adopted the constitutional question institution. The research shows that the constitutional question institution can be placed as part of the Constitutional Court s constitutional review method based on Article 24C 1 1945 Constitution. Moreover, the research also shows that there is a need or urgency, in both theory and practice, to institutionalize the constitutional question mechanism in the Constitutional Court. Therefore, this research concludes that the constitutional question is inevitable, and that is recommended to be immediately adopted in Indonesia. One of the possible methods to implement the mechanism is through the Constitutional Court law revision, which includes the constitutional question mechanism, without amending the Constitution. "

"The composition of the Constitutional Court is a crucial aspect for the realization of constitutionalism. While the Constitutional Court has been praised for its significant contributions to the establishment of constitutional democracy in Korea, there have been criticisms regarding the composition of the Court in both its institutional structure and operational practices. The Constitutional Court of Korea consists of nine justices. Although these nine justices are formally appointed by the President of Korea, three are elected by the National Assembly, and three are designated by the Chief of the Supreme Court. This means that the President, the majority of the National Assembly, and even the Chief Justice of the Supreme Court can each choose three justices on their own without any consent or approval from other branches. This raises concerns about the lack of democratic legitimacy, judicial independence and the expertise of the Constitutional Court. Additionally, there are constitutional issues such as the relatively short term of office, the reappointment, the absence of a specified term for the Chief Justice, and the potential for prolonged vacancies of seats."

"Currently, there is no available mechanism for directly protecting taxpayers' constitutional rights from potential violations resulting from tax regulations and policies in Indonesia. The Constitutional Court's authority for constitutional review, the Supreme Court's authority for judicial review, and the administrative appeal process before the State Administrative Court all fail to provide sufficient protection for taxpayers' constitutional rights. This article proposes the introduction of a constitutional complaint mechanism for tax matters in Indonesia, as a mechanism to directly protect these rights. The constitutional complaint process ensures direct conformity between the reviewed regulation or policy and the Constitution, with an emphasis on the application of a proportionality test. This test serves as a valuable tool for assessing the balance between taxpayers' constitutional rights and the government's duty to collect taxes. Striking this balance is essential for advancing the exercise of political accountability in taxation. This study employs a normative-empirical methodology, combining case law studies and theoretical perspectives to conceptualize the use of constitutional complaint against tax regulations and policies in Indonesia. The main finding of this research shows that the current constitutional review mechanisms put taxpayers at a disadvantage. Therefore, the authors conclude that the establishment of a constitutional complaint process will improve the protection of taxpayers' rights."

"Tesis ini merupakan hasil tentang Telaah terhadap perdebatan antar Fraksi dan proses amandemen pasal 34 UUD'45, tentang peran negara dalam penangan kesejahteraan sosial di dalamnya. Latar belakang dari penelitian ini adalah adanya ketidak pastian bagaimana sebenarnya pananganan fakir miskin dan anak terlantar di Indonesia, ketidak pastian ini berkaitan dengan ppla institusional dan pola residual dalam penangan kesejahteraan sosial.
Penelitian ini dengan menggunakan pendekatan kualitatif dan metode deskriptif untuk menghasilkan data-data tentang proses perdebatan dalam amandemen pasal 34 UUD'45, pemilihan informan dengan menggunakan metode purposive sampling meliputi 6 informan dari wakil fraksi dari seluruh 12 fraksi yang ada dan dalam pengumpulan datanya menggunakan tehnik in-depth interview, observasi dan studi dokumentasi.
Hasil penelitian menunjukan bahwa terjadi kekaburan dalam penanganan kesejahteraan sosial oleh negara. Kekaburan ini berhubungan bagaimana peran negara, tentang pemeliharaan, bentuk pemeliharan negara dan cara negara dalam penangan kesejahteraan sosial. Konsep tentang negara kesejahteraan sangat penting disini karena dalam pembahasan selalu berhubungan dengan sistem jaminan sosial, jaminan kesehatan dan penyediaan fasilitas umum oleh negara.
Kepada siapa pelayanan kesejahteraan sosial itu diberikan merupakan hal yang sangat penting, apakah difokuskan untuk fakir miskin dan anak terlantar atau untuk seluruh masyarakat, hal ini penting karena akan menyangkut pola institusi atau pola residual dalam penanganan kesejahteraan sosial, dan dalam hal ini terjadi kekaburan karena negara tidak memberikan kejelasan tentang pola penanganan fakir miskin dan anak terlantar."
