"Skripsi ini membahas mengenai perbuatan melawan hukum dalam suatu tindak medis. KUHPer mengatur tentang kewajiban melakukan pertanggungjawaban atas perbuatan melawan hukum. Dalam melakukan penelitian, penulis menggunakan metode penelitian kepustakaan yang bersifat yuridis-normatif dan tipologi bersifat deskriptif. Permasalahan dalam skripsi ini adalah bilamana suatu tindak medis dapat dikategorikan sebagai perbuatan melawan hukum serta bagaimana tanggung jawab dokter dan rumah sakit terhadap hal tersebut. Kesimpulan atas permasalahan tersebut adalah suatu tindak medis dapat dikategorikan sebagai perbuatan melawan hukum apabila memenuhi unsur-unsur dan tidak terdapat teori pembelaan yang dapat digunakan untuk menghindari gugatan. Perbuatan melawan hukum dalam tindak medis menimbulkan kewajiban bagi dokter dan rumah sakit untuk bertanggung jawab. Putusan Pengadilan Negeri Medan No. 417/Pdt.G/2012/PN.Mdn kurang tepat dalam memutus dikarenakan adanya kelemahan proses pembuktian.

This thesis discusses the unlawful act in medical treatment. Civil Code regulates the obligation to responsibility for unlawful act. In conducting this research, the writer uses juridicial-normative library research methods and the typology is descriptive. The problem in this thesis is when a medical treatment can be categorized as an unlawful act and how the responsibilities of doctor and hospital on it. The conclusion to these problems is a medical treatment can be categorized as an unlawful act if it fulfills the elements and there is no defense theory that can be used to avoid a lawsuit. Unlawful act in medical treatment cause the obligation for doctor and hospital to be responsible. Medan District Court Decision No. 417/Pdt.G/2012/PN.Mdn less appropriate in deciding because of the weakness of the evidence."
