The stalling of the Doha Development Round trade negotiations has resulted in bilateral and regional free trade agreements (BRTAs) becoming an important alternative. These agreements have proliferated in recent years, and now all of the major trading countries are engaging in serious bilateral trade negotiations with multiple trading partners. This second edition provides updated and comprehensive analysis of the contents and trends of recent BRTAs. It is unique in that it situates these agreements in their economic, international law and international relations contexts. It also comprehensively reviews the recent agreements in relation to each substantive topic covered (e.g. intellectual property, investment, services and social policy) so as to provide an overview of the law being created in these areas.

An increasing number of researchers have hypothesized that regulatory attempts to improve automotive safety through product design would be at least partially offset by driver behavioral changes. This article analyzes two independent data sets to test whether differences in driver behavior exist between cars equipped with air bags and those not so equipped. An analysis of an insurance industry generated data sets reveals that relative injury claims increase following adoption of an air bag system. Since there is no indication that the increase diminishes over time, the results appear to be attributable to offsetting behavior as opposed to a sorting of auto buyers. Analyses of 1993 Virginia State Police accident reports indicate that air-bag-equipped cars tend to be driven more aggressively and that aggressiveness appears to offset the effect of the air bag for the driver and increases the risk of death to others.

Tax scholars traditionally emphasize economics and assume that all tax systems can be evaluated in more or less the same way. By applying the insights of anthropology, sociology, and other social sciences, Michael A. Livingston demonstrates that tax systems frequently pursue different values and that the convergence of tax systems is frequently overstated. In Tax and Culture, he applies these insights to specific countries, such as China and India, and specific tax issues, including progressivity, tax avoidance, and the emerging area of environmental taxation. Livingston concludes that the concept of a global tax culture is, in many cases, merely a reflection of Western hegemony, and is unlikely to survive the changes implicit in the rise of non-Western nations and cultures.

Conventional wisdom on the insufficiency of existing WTO disciplines on export restrictions has triggered momentum on the issue. In this book, Ilaria Espa offers a comprehensive analysis of the scope and coverage of WTO disciplines on export restrictions in light of emerging case law. She investigates whether such rules still provide a sufficient, credible and effective framework capable of preventing abuses in the use of export restrictive measures on critical minerals and metals during a period of economic crisis and change in international trade patterns. Giving a broad overview of the export restrictions applied to these materials, Espa identifies distinctive features in the proliferation of export barriers and analyses the existing WTO rules to reveal their scope, gaps and inconsistencies. She goes on to present solutions based upon her findings with the aim of bringing more coherence and equity to WTO rules on the export side.

Abad ke-21 adalah era perkembangan tanggung jawab sosial perusahaan atau yang dalam bahasa Inggris disebut Corporate Social Responsibility (CSR). Hal ini didorong oleh perkembangan perusahaan sebagai entitas bisnis dan sosial yang menyeimbangkan kepentingan publik dan swasta. Jika ada keseimbangan kepentingan publik dan swasta di perusahaan, penerapan CSR harus mampu mengakomodasi kepentingan publik. Namun ada sejumlah besar perusahaan di Indonesia yang tidak melibatkan masyarakat dalam perumusan model implementasi CSR. Hal ini mengakibatkan pelaksanaan CSR sering kali menjadi tidak tepat sasaran. Dalam konteks tersebut, teori konstitusionalisme perusahaan menjadi teori yang relevan untuk menjawab masalah ini. Teori konstitusionalisme perusahaan menempatkan musyawarah sebagai salah satu prinsip untuk mencapai legitimasi pengambilan keputusan dalam perusahaan. Melalui proses perumusan musyawarah model CSR dengan masyarakat, bukan hanya kepentingan pemegang saham yang dapat ditampung tetapi juga kepentingan stakeholders. Dengan demikian, CSR sebenarnya dapat berperan dalam menjawab tantangan global dan lokal. ......The 21st century is the era of the development of corporate social responsibility (CSR). It is encouraged by the development of the company as a business and societal entities that balances public and private interests. If there is a balance of public and private interests in the company, the application of CSR should be able to accommodate the public interest. However there are a lot of companies in Indonesia that do not involve the community in the formulation of CSR implementation model. This resulted the implementation of CSR which is often not well targeted. In that context, the theory of corporate constitutionalism becomes a relevant theory to answer this problem. The theory of corporate constitutionalism puts deliberation as one of the principles to achieve the legitimacy of decision-making in the corporation. Through a process of deliberation formulation of CSR model with the community, not just the interests of shareholders that can be accommodated but also the interests of stakeholders. Thus, CSR can actually be an instrument solvingto solve the global and local challenges.
