"ABSTRAKAssociation of Southeast Asian Nations (ASEAN) merupakan salah satuorganisasi internasional di wilayah Asia Tenggara yang tujuan awalnya adalahmembentuk suatu zona perdamaian di wilayah Asia Tenggara. Masalahkeanggotaan yang tercantum di dalam ASEAN Charter, sebagai instrumenpokoknya, tidak terlalu diatur dengan jelas. Bahkan masalah pengunduran dirikeanggotaan dari ASEAN tidak terdapat pengaturannya di dalam ASEAN Charter.Dengan tidak adanya pengaturan mengenai pengunduran diri ini, maka timbulpersoalan mengenai apakah pengunduran diri tersebut dapat dilakukan. Secarajelas Vienna Convention on the Law of Treaties 1969 mengatur bahwa apabilatidak terdapat pengaturan mengenai pengunduran diri dari suatu perjanjianinternasional, maka pengunduran diri tersebut tidak dapat dilakukan. Akan tetapi,terdapat perdebatan mengenai hal ini dimana teori kedaulatan negara turut andildalam perdebatan ini.

ABSTRACTAssociation of Southeast Asian Nations (ASEAN) is an international organization

in the Southeast Asia region, which was established at first to build a peace zone

in the Southeast Asia region. The ASEAN Charter, which is the constitution of

ASEAN, did not stipulate a clear provision on the membership issue. Moreover,

the issue of withdrawal was not at all mentioned in the ASEAN Charter. Thus,

without any provision on the withdrawal from ASEAN, an issue transpires on

whether the withdrawal itself can be conducted. The Vienna Convention on the

Law of Treaties 1969 stipulated that when there is no provision on withdrawal in a

treaty, then there is no possibility of withdrawal from that treaty. However, there

is still a debate on this in which the theory of state sovereignty took part in this

debate."
