Process of democracy consolidation is more complex and longer after transition: study on democracy consolidation is varying compared to transition study. Democracy consolidation should be able to do reinforcement to 3 types of political institutions, they are : 1).State administration apparatus (bureaucracy) 2)Representative Institution and Stakeholder of Democracy System (political parties ,parliament and general election system and 3). The Structure guarantees horizontal accountability, constitutionalism and governance based law (judicial system,check and balances institution). In the context of local democracy, it is explained that the bigger autonomy of local governance, whether it's on the meaning of authority in decision - making or financial authority, the bigger is the degree of local politics. In relation to that proposition, it can be concluded that; firstly, the bigger local autonomy is, the bigger is democratization process and local politic, which is characterized the region uniquely. Secondly the more intensive of elite role is , the more developing is social politic dynamic and more dynamic also the development of regional politic. Third, more dynamic of democratization process is, more dynamic is regional politic development. In state constitution system, the ideal of state law is unseparatable part of the development of the idea of Indonesian state since its Independence Day, although in the articles of Undang-undang Dasar 1945 (Indonesia Constitution) before amanded, the idea of state law is no longer firmly explicitly, but in explanation of Constitution, it is firmed that Indonesia follows the idea of "rechstaat" not "machstaat".

As a government souvrenities of the people base to the law and to handle the state government base on constitution, therefore the management of state finance system should be appropriate with main regulation which stated in constitution 1945. The government budget and expenses (APBN), also the local government budget and expenses (APBD) to be fixed each year by the law including taxes and others charge with forced for the government needs also sort and price money area stated by the law. The President as an authority holder state management finance, delegates to the Ministers/Institution leaders, governors, Regents or Mayors and Head of certain organization unit leaders for arranging and fixing also responsibility in management of APBN anf APBD. In order to support good government realization in management of government state finance it's need to do profesionalism, open up and responsibility due to constitution 1945 in general principle namely: Accountability for the result oriented , Profesionalsm, Prpporsionalsm, Open up and controling . Relationship between Central government and Local government and Local government, that is central government to feel an obligation to local government for allocation funds sharing with proprosionality base on law and others regulation.

Penelitian ini adalah penelitian yuridis normative yang bersifat perskriptif dengan maksud memberikan solusi terhadap permasalahan Ormas di Indonesia. Tulisan ini akan mengkaji Konstitutionalitas undang-undang no 16 tahun 2017 tentang penetapan Pasal 61 dan 62 Perppu Nomor 2 Tahun 2017 yang mengatur tentang Pembubaran Ormas ditinjau dari UUD 1945 dan Konsep Negara Hukum. Sebagai hasil penelitian dapat disimpulkan bahwa Pasal 61 dan 62 undang-undang no 16 tahun 2017 tentang penetapan Perppu Nomor 2 Tahun 2017 yang memberikan kewenangan kepada pemerintah untuk membubarkan Ormas secara sepihak adalah Inkonstitutional karena bertentangan dengan Pasal 1 ayat 3 Tentang Indonesia sebagai Negara Hukum dan Pasal 28 E ayat 3 tentang kebebasan berserikat. Perlu adanya revisi terhadap undang-undang no 16 tahun 2017 tentang penetapan Perppu Nomor 2 Tahun 2017 dengan tetap memberikan kewenangan kepada Badan Peradilan dalam memutuskan pembubaran Ormas.
