"Generally, geostrategy is a type of foreign policy guided principally by geographic factors, that express an aggressive and offensive character, which is outward-looking. Further, it combines strategic considerations with geopolitical situations in such way that the military is always included. Meanwhile, the national resilience concept which was developed by the National Resilience Institute of Republic Indonesia (Lemhannas) is more defensive, less millitaristic, inward-looking and based on prosperity and security principles. This study aims to prove the truth of national resilence concept by using deductive phenomenological interpretive qualitative methods with epistemology of geostrategy as a main objective. Popper’s falsification test is intended to gather evidence on which the geostrategic peripheral is applied to the national resilience concept, rather than reject the conception. The required data includes the national resilience concept and an epistemology of geostrategy to explain geostrategic realities in a sistematic hierarchy, using historical documents, scientific publications and also interviews. This study has shown that the national resilience concept sits outside the geostrategic periphery, despite some evidence of geostrategic validity. The evidence indicating the applicability of geostrategy includes (1) does not place emphasis a strategic substance; (2) without strategic planning, political/diplomatic attempts and/or military meansto achieve national objective; (3) an inward-looking drive to improve tenacity and sturdiness rather than active politicalstrategic influence; (4) the changes occur in the long-term and; (5) the defensive posture prioritizes consultation and cooperation. The evidence that shows the applicability of geostrategy includes (1) formulation of national objectives and; (2) consideration of geography and geopolitical conditions."

"Skripsi ini membahas mengenai Filed Rate Doctrine yang berkembang di Amerika mengenai peranan peraturan sektoral dalam penentuan harga. Isu penting pembahasan Filed Rate Doctrine adalah pengaturan harga diserahkan kepada sebuah badan sektoral yang khusus ditunjuk oleh pemerintah dan pengadilan tidak memiliki kewenangan intervensi dalam persoalan terkait harga, meliputi penentuan excessive price atau penetapan pembayaran ganti rugi sehingga konsumen tidak dapat mengajukan tuntutan ganti rugi terkait harga yang dianggap excessive. Penelitian terhadap doktrin ini diperlukan, mengingat sangatlah sulit mengukur presisi harga yang dianggap excessive dan penghitungan ganti rugi dari KPPU. Filed Rate Doctrine dapat dijadikan contoh sebagai solusi permasalahan di atas.

This thesis discusses about Filed rate Doctrine that flourished in America on the role of the sectoral regulations of pricing. The important issue of Filed Rate Doctrine is that a specific sectoral body appointed by the government to sets the price, including the determination of excessive price nor compensation which causes the consumer not being able to file a claim for damages related to the excessive price considered. Research of this doctrine is essential, given the level of difficulty to measure the precise price that is considered excessive and calculation of damages from KPPU. Filed Rate Doctrine can be a form of solution for the aforementioned problem."

"Tesis ini membahas tentang penerapan doktrin permulaan pelaksanaan terhadapbeberapa perkara makar untuk mengetahui bagaimana corak permulaanpelaksanaannya sehingga sudah dianggap merupakan perbuatan makar, yangselanjutnya atas kecenderungan tersebut peneliti juga akan melakukan penelitianterhadap penegak hukum untuk mengetahui pemahaman penegak hukum ataspermulaan pelaksanaan sehingga diharapkan terdapat korelasi antara keduanya.Penelitian ini beranjak dari tidak diaturnya secara jelas batas-batas suatupermulaan pelaksanaan perbuatan makar sehingga rentan bertentangan denganasas legalitas, mengingat pasal-pasal makar juga tidak memberikan rumusan yangjelas mengenai perbuatan-perbuatan yang bagaimana yang dilarang untukdilakukan. Dari penelitian yang sifatnya yuridis normatif yang dilengkapi denganwawancara, dengan menggunakan pendekatan perundang-undangan (statuteapproach) dan pendekatan konsep (conseptual approach) serta dianalisa secaradeskriptif analisis, diperoleh kesimpulan bahwa dengan menggunakan pendekatandoktrin-doktrin permulaan pelaksanaan, kecenderungan permulaan pelaksanaandalam penanganan perkara makar adalah bercorak subyektif, yakni memandangbahwa sudah ada permulaan pelaksanaan melakukan makar ketika sudah ada niatuntuk itu yang telah diwujudkan dalam perbuatan. Dari hasil wawancara terhadappenegak hukum ternyata diperoleh kesimpulan bahwa kecenderungan penegakhukum dalam memahami permulaan pelaksanaan adalah memang bercoraksubyektif. Secara keseluruhan dapat dipahami bahwa kecenderungan permulaanpermulaan pelaksanaan dalam perkara makar adalah bercorak subyektif karenasikap penegak hukum dalam memahami permulaan pelaksanaan dalam perbuatanmakar juga subyektif

This thesis discusses the application of fhe doctrine of commencement of the

implementation on several treason cases to identify what patterns of

commencement of the implementation considered as treason. Then, based on

those tendencies, a research regarding how good law enforcers understood the

commencement of the implementation was done. Therefore, it is expected that

there is a correlation between them. This research started from the fact that there

is no clear regulation about the lines of commencement of the implementation on

treason cases so that it is likely to be against the principle of legality because

treason articles do not clearly define the formula about what kinds of actions that

are prohibited to commit A conclusion obtained from a juridical normative

research supported with interviews using statue approach and conceptual approach

which then descriptively analyzed showed that by using the doctrine of

commencement of the implementation approach, the tendency of commencement

of the implementation in handling treason cases was subjective. It means that

there is a commencement of the implementation to commit treason when someone

has an intention to commit an offense and the person performs any act that

constitutes a substantial step toward the commission of that offense. The result of

the interviews on the law enforcer showed that the law enforcer had a tendency to

be subjective in understanding the commencement of the implementation. In a

whole, it is understandable that the tendency of the commencement of the

implementation in a treason case is subjective because the attitude of law enforcer

in understanding commencement of the implementation on a treason case is also

subjective."
