Keputusan Jepang untuk ikut berpartisipasi dalam Trans-Pacific Partnership TPP pada tanggal 5 Oktober 2015 mengharuskan Jepang untuk meliberalisasi berbagai sektor perekonomiannya termasuk sektor pertanian. Selain penghapusan tarif, pemerintah Jepang juga mengubah pola kebijakan proteksi yang selama ini diimplementasikan menjadi suatu kebijakan yang dapat meningkatkan daya saing sektor pertanian Jepang dalam menghadapi tren pasar bebas kawasan seperti TPP. Kondisi ini menyiratkan adanya perubahan yang cukup signifikan atas implementasi Developmental State Jepang yang sarat akan ideologi merkantilisme yang selama ini menjadi ciri pembangunan ekonomi Jepang. Namun demikian, penelitian ini menemukan bahwa terjadi perubahan berupa pergeseran dalam implementasi Developmental State di Jepang ke arah Developmental State Dualism. Perubahan tersebut terjadi sebagai akibat pengaruh dari mekanisme pasar yang sarat akan prinsip-prinsip liberalisme dan memberikan pengaruh terhadap bagaimana pemerintah Jepang melakukan intervensi terhadap sistem pembangunan perekonomian. ......Japan rsquo s decision to participate in Trans Pacific Partnership TPP on October 5, 2015 has made Japan to liberate economic sectors including the agricultural sector. Beside tariff abolition, Japan government also changed the pattern of protection policy that used to be implemented to be a policy that can promote Japan rsquo s agriculture competitiveness encountering free trade trend like TPP. This condition implies a significant change of Japan rsquo s merchantilism based Developmental State that well known as the main characteristic of Japan rsquo s economic development. However, this research discovered the transformation of Japan rsquo s Developmental State implementation in to Developmental State Dualism. The transformation occured due to the influence of liberalism based market mechanism that leverage how the government intervenes the the system of economic development.

ABSTRAK
Through the momentum of the third amendment of the 1945 Constitution of the Republic of Indonesia which was passed in 2001, Indonesia has officially adopted a dualistic judicial review system. Under such system, the authority to conduct judicial review is divided/spread to the two judicial organs, each with its own scope of review; namely, the Supreme Court/Mahkamah Agung reviews regulations below the level of Law (Undang-undang), while the Constitutional Court/Mahkamah Konstitusi reviews the same against the Constitution (constitutional review). Seen from the theoretical and practical perspective adhered to by states which adopt the formation of the Constitutional Court (centered judicial review model), the system adopted by Indonesia is uncommon, and moreover it could be considered as an error in designing the judicial review system. This is in view of the fact that in states which have a Constitutional Court, the authority to conduct judicial review is concentrated / centered upon the Constitutional Court. Such division of authority under the two review regime (legal review and constitutional review) as practiced by Indonesia is not known (except for South Korea), neither in states which use the centralized judicial review model nor in those which use the distribution judicial review model. Such distribution is bound to disrupt the judicial review itself, as the authority to review is implemented by two different institutions with different review standard. Accordingly, in the final part of this research the author puts forward the proposition to centralize the authority to conduct judicial review in the Constitutional Court thus putting an end to the practice of dualistic judicial review which has been proven to be problematic and ensuring that the judicial review system in Indonesia can be reconstructed and placed upon the correct theoretical and practical basis.

ABSTRAK
Dualisme penanganan sengketa administratif di bidang kepabeanan antara pengadilan Pajak dan Pengadilan Tata Usaha Negara telah menciptakan ketidakpastian hukum. Untuk itu penelitian ini membahas mengenai kekuasaan kehakiman terkait penanganan sengketa dimaksud. Penelitian ini menggunakan metode penelitian normatif. Sejalan dengan metode tersebut, pendekatan yang digunakan ini adalah pendekatan analitis (analytical approach) dan pendekatan peraturan perundang-undangan (statute approach). Berdasarkan sifatnya, penelitian hukum ini merupakan penelitian hukum deskriptif, sedangkan berdasarkan bentuknya, penelitian hukum ini merupakan penelitian preskriptif. Setelah dilakukan penelitian secara komprehensif maka dapat ditarik suatu kesimpulan bahwa pengadilan yang berwenang untuk memeriksa dan mengadili sengketa administratif di bidang kepabeanan adalah Pengadilan Pajak.
ABSTRACT
Dualism adjudication in customs administrative dispute between Tax Court and Administrative Court has caused a legal uncertainty. Therefore, this research analyzes the judicial power regarding to the dispute mentioned. This study uses normative research method. Accordingly, this research uses analytical approach and statute approach. By its nature, this study is a descriptive legal research, and by its form this study is a prescriptive legal research. Based on the analysis conducted in this research, it is concluded that the most competent court to adjudicate customs administrative dispute is Tax Court.

Adanya dualisme dalam kebijakan mengenai jaminan kesehatan di Kota Bekasi, yakni Jaminan Kesehatan Nasional (JKN) serta Jaminan Kesehatan Daerah (Jamkesda) melalui Kartu Sehat berbasis NIK, mengakibatkan terjadinya tumpang tindih dari segi aturan maupun biaya yang harus dikeluarkan Pemerintah Kota Bekasi. Penelitian ini bertujuan untuk menganalisis implementasi kebijakan KS-NIK sebagai Jamkesda di Kota Bekasi dengan menggunakan pengertian implementasi dari Van Metter dan Van Horn (1975) serta mengidentifikasi faktor-faktor yang mempengaruhi implementasi kebijakan KS-NIK sebagai Jamkesda di Kota Bekasi dengan merujuk pada teori Edward III (1980). Pendekatan penelitian yang digunakan adalah post-positivist dengan teknik pengumpulan melalui wawancara mendalam, serta studi kepustakaan. Hasil penelitian menunjukkan bahwa Implementasi KS-NIK sebagai Jamkesda di Kota Bekasi sudah dijalankan sebagaimana apa yang telah dikonsepkan oleh Van Meter dan Van Horn (1975). Namun, masih ditemukan kendala yang menciptakan terjadinya berbagai perubahan pada sistem pelayanan menggunakan KS-NIK. Dari 13 Dimensi yang mengukur faktor yang mempengaruhi implementasi, hanya 5 dimensi yang tercapai. Masih ditemui berbagai hambatan dalam pelaksanaan KS-NIK sebagai Jamkesda, diantaranya keterbatasan Sumber Daya, intruksi yang tidak disampaikan dengan jelas, ketidaktersediaan insentif, prosedur yang masih menimbulkan keluhan, serta kondisi politik yang tidak mendukung pelaksanaan Jamkesda. Penelitian ini merekomendasikan untuk menjadikan skema jamkesda hanya sebagai pelengkap dari kekurangan yang dimiliki JKN.
The dualism in the policy of health insurance in Bekasi City such as National Health Insurance (JKN) and Local Health Insurance (Jamkesda) through Kartu Sehat Berbasis NIK, causes the occurance of overlap from the side of rules or cost that must be issued by the government of Bekasi City. This research aims to analyze the implementation of KS-NIK policy by using the implementation definition from Van Metter and Van Horn (1975) and analyze the factors that influence the policy implementation of KS-NIK by referring to the theory of Edward III (1980). The research uses post-positivist approach with data collection techniques through in-depth interview and literature study. The research results show that KS-NIK implementation as Jamkesda in Bekasi City has been run in line withpolicy implementation concept (Van Metter and Van Horn, 1975). However, there are still some obstacles that cause the change in the service system using KS-NIK. Out of 13 dimensions that measure the factor which influences its implementation, there are only 5 dimensions achieved. There are still various obstacles in the implementation of KS-NIK as Jamkesda such as limited human resources, unclear instruction, inequal insentive, unclear procedures, and political condition that do not support Jamkesda implementation. This research suggest that Jamkesda neet to in line with national regulation and fill the gap from national insurance.

Research by anthropologists engaged with the Comparative Austronesia Project (Australian National University) has amassed an enormous data set for ethnological comparison between the religions of Austronesian-speaking societies, a language group to which nearly all Indonesian societies also belong. Comparative analysis reveals that ancestor veneration is a key-shared feature among Austronesian religious cosmologies; a feature that also resonates strongly with the ancestor-focused religions characteristic of East Asia. Characteristically, the religions of Austronesian-speaking societies focus on the core idea of a sacred time and place of ancestral origin and the continuous flow of life that is issuing forth from this source. Present-day individuals connect with the place and time of origin though ritual acts of retracing a historical path of migration to its source. What can this seemingly exotic notion of a flow of life reveal about the human condition writ large? Is it merely a curiosity of the ethnographic record of this region, a traditional religious insight forgotten even by many of the people whose traditional religion this is, but who have come under the influence of so-called world religions? Or is there something of great importance to be learnt from the Austronesian approach to life? Such questions have remained unasked until now, I argue, because a systematic cosmological bias within western thought has largely prevented us from taking Ancestor Religion and other forms of “traditional knowledge” seriously as an alternative truth claim. While I have discussed elsewhere the significance of Ancestor Religion in reference to my own research in highland Bali, I will attempt in this paper to remove this bias by its roots. I do so by contrasting two modes of thought: the “incremental dualism” of precedence characteristic of Austronesian cultures and their Ancestor Religions, and the “transcendental dualism” of mind and matter that has been a central theme within the cultural history of Western European thought. I argue for a deeper appreciation of Ancestor Religion as the oldest and most pervasive of all world religions.

Perkembangan Perbankan Syariah sangat pesat di Indonesia, mengingat Indonesia adalah negara dengan umat muslim terbesar di Dunia. Pertumbuhan perbankan syariah yang sangat tinggi berdampak pada tingginya tingkat sengketa yang terjadi diantara para pelaku perbankan syariah. Tuntutan akan penyelesaian sengketa perbankan syariah yang baik akhirnya berujung dengan dikeluarkannya Undang-undang No. 3 Tahun 2006 tentang Perubahan Atas Undang-undang No.7 tahun 1989 tentang Peradilan agama dimana diserahkannya kewenangan kompetensi absolut penyelesaian sengketa perbankan syariah kepada Pengadilan Agama. Dilain sisi peraturan tentang perbankan syariah yang masih menyatu dengan peraturan mengenai perbankan pada umumnya akhirnya melatari dikeluarkannya Undang-undang No.21 tahun 2008 tentang Perbankan Syariah, namun dengan dikeluarkannya Undang-undang ini menambah kebingungan penyelesaian karena dalam Pasal 55 Undang-undang 21 tahun 2008 memberikan pilihan hukum dimana para pihak dapat memilih penyelesaian sengketa selain di Pengadilan Agama, tetapi juga dilingkup Pengadilan Umum. Kondisi demikian membawa ketidak pastian hukum yang dimana akhrinya diajukan kepada Mahkamah Konstitusi. Mahkamah Konstitusi melalui Putusan No. 93/PUUX/ 2012 akhirnya mengembalikan kembali kewenangan kepada Pengadilan Agama. Pengembalian ini tidak lantas tanpa masalah karena adanya lembaga penyelesaian lain seperti Basyarnas yang melalui Fatwa Dewan Syariah Nasional menyebutkan bahwa penyelesaian sengketa Perbankan Syariah diselaikan melalui Basyarnas. Thesis ini membahas mengenai polemik konsepsi yang terjadi dalam proses penyelesaian sengketa perbankan syariah yang ada. ......Islamic Banking grows very fast in Indonesia, because Indonesia has the biggest moeslem population in the world. The developing of Islamic Banking is growing rapidly and it gives highly impacts with disputes between the bankers and the customers. To solve the case of dispute in Islamic Banking, The Government of Indonesia conceals the laws number 3 in 2006 about the changing of the laws number 7 in 1989 about religious court that it gets absolute competence authorities solves dispute on Islamic Banking. Beside of that, the rules of Islamic Banking still fuse with the common banking rules so the government has concealed the laws number 21 in 2008 about Islamic Banking. But the laws are confusing because in the chapter of 55 the laws number 21 in 2008, it says that the parties can choose to solve dispute of Islamic Banking not only in the religious court but also in the general court. This condition makes uncertain laws which is solved finally by constitutional court. The constitutional court has made decision number 93/PUU-X/2012 which finally return back the authorities to the religious court. In returning of the laws make another case because of the existence of another solving institution such as Basyarnas by The National Islamic Council saying that the solving of Islamic Banking dispute can be solved by Basyarnas. This thesis review about The polemic conseption that happens in the process of the solving this dispute Islamic Banking.
