"RUU KUHP telah menimbulkan perdebatan, khususnya terkait dengan pasal-pasal yang berada di bawah lingkup kesusilaan. Rumusan pasal 488 sangat potensial untuk menimbulkan masalah baru bagi perempuan. Terutama perempuan memiliki kendala dalam mengakses identitas hokum. Pasal ini merupakan refleksi dari gagalnya para ahli hokum yang merumuskan undang-undang dalam memahami pengalaman perempuan terkait dengan aksesnya atas hak untuk memperoleh identitas hokum, terutama dalam konteks relasi dengan pasangan. Hokum pidana bukanlah jawaban atas semua masalah. Tulisan ini disusun dengan menggunakan data baik yang diperoleh dari suatu penelitian lapangan terkait dengan penanganan kasus kekerasan terhadap perempuan berdasarkan hokum adat, yang dilaksanakan oleh penulis beserta tim dari Bidang Studi Hukum dan Masyarakay pada 2015, 2016, dan 2017 di wilayah Indonesia Timur; maupun data hasil analisis teks hokum dan nonhukum. Keseluruhan metode dan analisis atas temuan penelitian menggunakan feminist legal studies feminist legal theoris."

"Thus paper will focus on feminist analysis of Law No. 7 of 2016 on the Protection and Empowerment of Fishermen, Fish Cultivators and Salt Farmers and Regulation of the Minister of Marine Affairs and Fisheries No. 16 of 2016 as the legal basis for policy on Fishermen Card and Insurance. This paper will also analyze the experiences of two fisherwomen in Ujung Pangkah, Gresik, East Java who successfully obtained legal identity in the form of fisher card and insurance as a form of legitimacy and recognition of their identity as hsherwomen. The strong patriarchal culture in various society layers, caused the recognition of the political identity of fisherwomen has become difficult, so a feminist analysis toward policy on fisher card and insurance is needed so that women can engage as active Subjects in the policy."

"A legal identity document is the right of every citizen because it is a prerequisite in accessing public services. This study aims to assess the implementation of Presidential Regulation Number 62 of 2019 on the National Strategy of Strengthening Civil Registration and Vital Statistics (Stranas Percepatan AKPSH), which focuses on regulatory synchronization and services at a local level. A qualitative analysis approach was used, consisting of a literature study and in-depth interview methods. The research sample includes ministries/agencies at the central level, also several local governments, i.e., Palu City, Bantul Regency, Muaro Jambi Regency, East Sumba Regency, DKI Jakarta Province, and Surabaya City. The study shows that the central government has made policies to facilitate vulnerable groups in CRVS access. Local governments have policies that make it easier for vulnerable groups to get CRVS access; innovate administrative services; carry out socialization, advocacy, and education efforts involving third parties; and increase cooperation between regional government organizations (OPD) in implementing integrated civil registration services. However, there are still vulnerable groups that are not accommodated. Implementation at the regional level still has infrastructure readiness, human resources, and required special data collection team availability. Therefore, the determination of the vulnerability category becomes essential. This study recommends that it is necessary to create an additional classification of vulnerable groups in CRVS. In addition, it is essential to strengthening outreach to vulnerable groups in CRVS, especially at the regional level."

"Penelitian ini membahas tantangan komunitas transpuan memperoleh pengakuan identitas hukum di Indonesia. Pasal 56 Undang-Undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan dan Pasal 58 Peraturan Presiden Nomor 96 Tahun 2018 tentang Persyaratan dan Tata Cara Pendaftaran Penduduk dan Pencatatan Sipil belum sempurna menangani permasalahan tersebut. Tidak sempurnanya kedua pengaturan hukum tersebut karena pengajuan permohonan pengubahan identitas hukum kepada pengadilan negeri dapat ditolak. Dengan begitu, transpuan di Indonesia tidak mendapatkan salah satu hak dasarnya, yakni identitas hukum. Melalui metode sosio-legal, penelitian ini menganalisis kekurangan kedua pengaturan hukum yang ada dan mewawancarai transpuan di Jakarta Selatan tentang identitas hukum mereka. Hasil ditemukan bahwa para transpuan ini belum melakukan pengubahan identitas hukum karena terintimidasi dengan hukum yang ada. Hal tersebut mengakibatkan keseharian mereka terdapak, termasuk dalam aspek sosial, ekonomi, dan keamanan pribadi. Berdasarkan temuan ini, peneliti memberikan beberapa saran ke depan. Pertama, dicanangkan self-ID law yang memungkinkan transpuan untuk secara langsung mengajukan perubahan identitas tanpa hambatan pengadilan yang berlebihan. Kedua, perlunya kompensasi bagi mereka yang pernah ditolak, serta edukasi intensif bagi petugas pemerintah untuk menghindari diskriminasi. Ketiga, pentingnya dukungan sosial dan hukum yang lebih luas, termasuk layanan kesehatan yang sensitif terhadap transisi gender. Keempat, edukasi masyarakat luas untuk mengurangi stigma terhadap identitas gender yang beragam. Dengan menerapkan saran-saran ini, diharapkan bahwa transpuan di Indonesia dapat mengakses hak mereka untuk identitas hukum dengan lebih mudah dan adil, menjadikan perubahan identitas sebagai bagian normal dari proses transisi mereka.

This study discusses the challenges faced by trans women in obtaining legal recognition of their identity in Indonesia. Article 56 of Law Number 23 of 2006 on Population Administration and Article 58 of Presidential Regulation Number 96 of 2018 on Population Registration Requirements have not adequately addressed these issues. The imperfections in these legal provisions arise from the potential rejection of applications for legal identity change by district courts. Consequently, trans women in Indonesia are denied a fundamental right, namely legal identity. Using socio-legal methods, this research analyzes the shortcomings of existing legal frameworks and interviews trans women in South Jakarta about their legal identities. The findings reveal that these women have refrained from pursuing legal identity changes due to intimidation by existing laws, impacting their daily lives including social, economic, and personal security aspects. Based on these findings, the researcher proposes several recommendations. First, the implementation of a self-ID law that allows trans women to directly request identity changes without excessive judicial barriers. Second, the need for compensation for those previously denied, along with intensive education for government officials to prevent discrimination. Third, the importance of broader social and legal support, including healthcare services sensitive to gender transitions. Fourth, public education to reduce stigma against diverse gender identities. Implementing these recommendations is expected to facilitate easier and fairer access to legal identity rights for trans women in Indonesia, making identity changes a normal part of their transition process."

ABSTRACT
This paper assesses the performance of method targeting and implementation error of social transfer programs in Indonesia, which consists of Raskin, in-kind transfer; Program Keluarga Harapan (PKH), a conditional cash transfer; Program Indonesia Pintar (PIP), scholarship program; and Program Indonesia Sehat (PIS), free health insurance for the poor and vulnerable. The logit model of exclusion and inclusion errors shows the drivers of probability error in targeting these four kinds of social transfer programs. The finding shows error in the implementation that relies heavily on urban-rural differences and legal identity ownership rather than the role of government employees. Measuring the performance of miss-targeting is needed to improve the effectiveness of social transfer programs on achieving their goals. The analysis of targeting performance suggests caution in employing a mechanism of the delivery program to improve the implementation of the targeting program to promote more social safety net rather than in-kind transfer and cash transfer as well as to re-evaluate the identification requirement for receiving social benefits to reach the beneficiaries from the extreme poor."
