"Merek merupakan salah satu elemen yang penting di dalam dunia Perdagangan,
keberadaan merek ditujukan sebagai suatu identitas dari pelaku usaha tertentu.
Keberadaan Merek terus berkembang seiring dengan perkembangan indusri,
dimana merek tidak hanya terdiri dari Merek yang bersifat Konvensional, namun
juga terdapat Merek Non-Konvensional. Salah satu jenis Merek Non-Konvensional
yaitu Position Mark (Merek Posisi). Position Mark telah mendapatkan
perlindungan di ranah Internasional. Akan tetapi, tidak semua negara melindungi
position mark sebagai Merek, dimana Indonesia merupakan salah satu negara yang
tidak melindungi position mark sebagai Merek. Sebagai pembanding, pada skripsi
ini akan dibahas mengenai Perlindungan position mark di beberapa negara seperti
Uni Eropa, Jepang, dan Korea. Selain itu, skripsi ini juga membahas mengenai
permasalahan atau kendala di dalam melidungi position mark sebagai merek,
seperti ketiadaan daya pembeda, anggapan position mark sebagai dekorasi semata,
definisi yang masih rancu, dan permasalahan di dalam Undang-Undang Merek
Indonesia, serta urgensi perlindungannya di Indonesia. Metode yang digunakan di
dalam Skripsi ini adalah Yuridis-Normatif yang didukung dengan bahan-bahan
hukum primer, sekunder, dan tersier, serta menggunakan pendekatan konseptual
dan komparatif terhadap hukum merek yang berlaku di negara lain

Trademark is one of the most important elements in the world of Commerce. The
existence of a Trademark is intended as an identity of a certain Business Actor. The
existence of Trademark continues to grow along with the development of Industry.
Hence, nowadays, Trademark does not only consist of the Conventional one, yet
there are also the Non-Conventional ones. One of the types of Non-Conventional
Trademarks is Position Mark. Position Mark has received protection in the
International scope. However, not all countries protect position mark as a
Trademark, where Indonesia is one of the countries that does not protect position
mark as a Trademark. As a comparison, this thesis will discuss the protection
regarding position mark in several countries, such as The European Union, Japan,
and Korea. In addition, this thesis will also discuss the problems regarding position
mark protection as a Trademark, such as the lack of distinction, the perception of
position mark as mere decoration, ambiguous definitions, and problems in the
Indonesian Trademark Law, as well as the urgency of its protection, especially in
Indonesia. The method in writing this thesis is juridical-normative research that also been supported by primary, secondary, and tertiary legal materials. This thesis also
uses a conceptual and comparative approach to trademark law in other countries

"Perlindungan merek tiga dimensi, suara dan hologram telah diatur di dalam UU No. 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Sejak lima tahun diadopsikannya tiga jenis merek nontradisional tersebut, ketentuan baru mengenai larangan bentuk yang bersifat fungsional baru diberlakukan pada tahun 2021. Berdasarkan statistik, selama lima tahun terakhir terdapat peningkatan permohonan pendaftaran. Oleh karenanya, perlu dilakukan penelitian mengenai bagaimana penerapan perlindungan merek tiga dimensi, suara dan hologram di Indonesia. Penelitian ini menggunakan metode yuridis normatif untuk meneliti rumusan permasalahan mengenai topik terkait yang didukung dengan bahan-bahan hukum primer, sekunder dan tersier. Penelitian ini juga menggunakan pendekatan komparatif, yaitu membahas perlindungan merek tiga dimensi, suara dan hologram di Uni Eropa dan Amerika Serikat. Adapun selama lima tahun mengadopsi merek tiga dimensi, suara dan hologram di Indonesia, terdapat permasalahan yang dihadapi, yaitu mengenai representasi merek, penilaian daya pembedanya dan larangan fungsionalitas. Skripsi ini akan menyimpulkan mengenai perbandingan sistem hukum, penerapan di masing-masing negara. Serta memberikan saran berupa solusi dari permasalahan penerapan perlindungan merek tiga dimensi, suara dan hologram di Indonesia.

The protection of three-dimensional, sound and hologram brands has been regulated in Law no. 20 of 2016 concerning Trademark and Geographical Indications. Five years since Indonesian Government adopted the adoption the three types of non-traditional marks, new provisions regarding the prohibition of functional forms will only be enforced in 2021. Based on statistics, over the last five years there has been an increase in applications for registration. Therefore, it is necessary to conduct research on how Indonesian Government apply the protection of three-dimensional, sound and hologram marks. This research will use normative legal method to seek answers based on presented research questions that is supported by primary, secondary, and tertiary legal materials. This study also uses a comparative approach, which discusses the protection of three-dimensional, sound and hologram marks in the European Union and the United States. In adopting three-dimensional, sound and hologram marks in Indonesia, there have been problems faced, namely regarding the representation, assessing distinctiveness, and functionality exclusion. Furthermore, there will be a conclusion about the comparison of legal systems, their application in each country and solutions to the problems of implementing three-dimensional, sound and hologram marks protection in Indonesia. "
