Judicial review adalah kewenangan menguji undang-undang terhadap UUD 1945 yang merupakan salah satu kewenangan Mahkamah konstitusi. Dalam perkara pengujian undangundang, Mahkamah Konstitusi dapat saja mengesampingkan, membatalkan atau memaknai materi muatan pasal/ayat/bagian dari sebuah undang-undang. Namun dalam perkembangan hukum acara di Mahkamah Konstitusi, ternyata dalam perkara Pemilukada Mahkamah Konstitusi melakukan pseudo judicial review (pengujian undang-undang semu) di mana Mahkamah Konstitusi melakukan pengujian terhadap materi muatan/pasal/ayat atau bagian dari suatu undang-undang. Tujuan penulisan tesis ini adalah untuk mengkaji dan menganalisis konstruksi judicial review dalam pengujian undang-undang dibandingkan dengan konstruksi pseudo judicial review dalam perkara perselisihan hasil Pemilukada. Selain itu juga bertujuan untuk mengkaji dan menganalisis kekuatan hukum mengikat suatu materi muatan pasal/ayat yang telah diuji dalam perkara Pemilukada. Hasil penelitian menunjukkan bahwa secara formil, permohonan judicial review dalam perkara pengujian undang-undang dan permohonan pseudo judicial review dalam perkara perselisihan hasil Pemilukada adalah berbeda karena diatur oleh dua jenis hukum acara dalam kewenangan yang berbeda. Akan tetapi dalam konteks putusan, konstruksi judicial review dan konstruksi pseudo judicial review memiliki persamaan dan perbedaan. Di sisi lain, materi muatan pasal/ayat/bagian dari undang-undang yang telah diuji oleh Mahkamah Konstitusi dalam perkara Pemilukada masih memiliki kekuatan hukum mengikat karena Mahkamah Konstitusi tidak membatalkan norma dalam undang-undang yang diuji. Akhirnya, sebagai peradilan konstitusi, Mahkamah perlu diberi kewenangan menguji Pseudo judicial..., Irfan Nur Rachman, FH UI, 2015 vii secara terbatas saat melaksanakan tugas dan kewenangan selain pengujian undang-undang dan hal ini perlu diatur dalam hukum acara Mahkamah Konstitusi.

ABSTRACT
Judicial review is the test act against UUD 1945- that is one authority the constitutional court.In testing legislation, affairs--how the constitutional court ruled out, could have cancel or material handling charge article / ayat / part of a statute.But in the legal developments event at the constitutional court, turned in regional head affairs--how the constitutional court to review ( pseudo judicial testing legislation specious ) where the constitutional court to do our tests material charge / article ayat / or part of a statute.
