"The central role played by indentured servants in the settlement and development of the English colonies in the West Indies and the North American mainland in the first century of English colonization has been overshadowed by the much larger later trade in African slaves. This book provides the first examination of the English end of the trade in the four sorts of indentured servant that delivered the majority of an estimated 457,000 white people to the American colonies before 1720. Colonization created new Englands out of England to enlarge trade and plantation, but settlement required people to be transported over 4,000 miles of ocean. Adults and children paid for their transportation and keep with four or more years of unpaid service in a new system of indentured servitude. The system was not benign in the sugar, tobacco, and rice plantations of the West Indies and southern Continental colonies, nor at the centre of the trade in London and other migrant ports where merchants, procurers, and masters of ships often used illicit methods to recruit servants. Measures to reduce spiriting by making the offence a felony punishable by hanging, or by registering servants in new offices, had a limited effect. New legislation in the 1718 Transportation Act eased the problem, but more important was the increasing substitution of slaves for servants to supply the soaring demand in Britain and Europe for the addictive products of the sugar and tobacco colonies."

"Disajikan ulangnya Voluntary Servitude dalam tataran politis menghadirkan alur baru dalam memandang politik, terkhusus pada praktik kuasa atau relasi dominasi, bahwa dominasi terjadi bukan karena pemaksaan kehendak dari yang berkuasa kepada yang dikuasai melainkan karena sukarela. Preasumsi tentang langgengnya dominasi bukanlah terletak pada manusia yang haus akan kuasa atau kejam bagi manusia lainnya, melainkan langgengnya dominasi terjadi karena fenomena servility sudah turun- temurun terjadi hingga menjadi budaya, hal tersebut mengakibatkan kebebasan tidak lagi dipandang sebagai sesuatu yang secara alamiah dimiliki setiap orang melainkan sesuatu yang harus diraih. Kebebasan yang perlu diraih bukan kebebasan yang terbebas dari dominasi sebagai suatu kondisi saja, melainkan kebebasan yang yang diraih melalui negasi epistemologis, terhadap ide tentang dominasi yang dimiliki oleh The Master atau yang berkuasa. Maka dari itu epistemologi baru sebagai absence dari epistemologi The Master harus dibentuk atau epistemologi the slave, dengan tujuan menjadi tahap lanjutan dari pembebasan diri dari dominasi.

The restatement of Voluntary Servitude at the political level presents a new path in viewing politics, especially in the practice of power or relations of domination, that domination occurs not because of coercion of the will of the ruling to the ruled but because of voluntary. The assumption about the perpetuation of domination does not lie in humans who are hungry for power or cruel to other humans, but rather the perpetuation of domination occurs because servility phenomena have passed down through generations to become a culture, as something that must be achieved. The freedom that needs to be achieved is not freedom that is free from domination as a condition, but rather the freedom achieved through epistemological negation, to the idea of domination which belongs to The Master or the ruling. Therefore a new epistemology as the absence of epistemology of The Master must be formed or The Epistemology of the slave, with the aim of becoming an advanced stage of liberation from domination."

ABSTRAK Skripsi ini membahas mengenai perbandingan konstruksi hukum pengabdian pekarangan di Indonesia dan Amerika Serikat. Konstruksi hukum pengabdian pekarangan di Indonesia dan Amerika Serikat sedikit berbeda karena pengabdian pekarangan servitude yang dikenal di Amerika Serikat dibagi menjadi 4 empat tipe dimana pembagian ini tidak dikenal di dalam konstruksi hukum pengabdian pekarangan yang ada di Indonesia. Permasalahan ini ditinjau dari perbandingan hukum dengan metode penelitian yuridis normatif dan penulisan bersifat deskriptif. Data dalam penulisan ini diperoleh dari studi dokumen sebagai data utama dari penulisan kualitatif. Hasil penelitian memperlihatkan bahwa baik Indonesia maupun Amerika Serikat memiliki ciri khas dalam masing-masing konstruksi hukumnya dan terdapat persamaan maupun perbedaan dalam konstruksi hukum pengabdian pekarangan.
ABSTRACT This thesis discusses the comparison in the construction law of servitudes in Indonesia and the United States of America. There are differences between Indonesia and the United States of America rsquo s construction law of servitudes which are servitudes known in the United States consist of 4 four types which are different from servitudes known in Indonesia. With normative legal research methods and descriptive writing, the data in this study were obtained from documents study as the main data of qualitative writing. The result showed that both Indonesia and the United States of America have their own distinctive characteristic and there are differences and similarities in the law construction of servitudes. "
