"Tesis ini merupakan hasil penelitian tentang Pelaksanaan Pelatihan Abon Ikan dalam Program Pembinaan Usaha Nelayan termasuk hal-hal yang mempengaruhi pelaksanaan Pelatihan Abon Ikan di Kawasan Sabang. Pelatihan Abon ikan merupakan salah satu kegiatan dalam pelaksanaan Program Pembinaan Usaha Nelayan yang dilaksanakan oleh Badan Pengusahaan Kawasan Sabang (BPKS) sebagai program kerja pada tahun 2004 untuk mengembangkan masyarakat pesisir di Kawasan Sabang.
Penelitian ini dilakukan pada tahun 2005 terhadap pelatihan abon ikan yang telah diselenggarakan di tahun 2004, yang mendasari pelatihan ini adalah, dengan telah diadakannya pelatihan bagi masyarakat nelayan di kawasan Sabang telah menunjukan perbaikan kualitas terhadap produksi abon dalam hal rasa dan kemasan namun masi ditemukan kendala dalam pemasaran abon ikan di kawasan Sabang sehingga peningkatan pendapatan masyarakat pesisir kawasan Sabang sebagai tujuan akhir dari program pembinaan usaha nelayan belum tercapai.
Penelitian dilaksanakan dengan menggunakan metode kualitatif yang menghasilkan data deskriptif melalui study kepustakaan, wawancara dengan informan. Pemilihan informan dilakukan dengan purporsif sampling terhadap staf BPKS yang juga merupakan panitia pelaksana kegiatan pelatihan pembuatan abon ikan, pelatih di pelatihan pembuatan abon ikan, peserta pelatihan abon ikan, panglima !apt kawasan sabang, warga masyarakat netayan di Kawasan Sabang dengan jumlah responden adalah 12 orang.
Penelitian ini menggunakan teori-teori yang berkaitan dengan pengembangan kawasan pesisir dan pembangunan sektor perikanan serta konsep pelatihan sebagai kerangka pikir untuk menganalisis temuan lapangan tentang pelaksanaan pelatihan abon ikan dalam program pembinaan usaha nelayan di kawasan Sabang.
Secara umum pelaksanaan pelatihan abon ikan sudah terlaksana sebagaimana direncanakan oleh pihak panitia penyelenggara, dimana dalam pelatihan abon ikan telah ditetapkan jumlah peserta pelatihan sebanyak 30 orang ibu-ibu rumahtangga isteri para nelayan kawasan Sabang, didukung oleh 4 orang pelatih yang telah berpengalaman yang bertugas melatih terhadap materi yang fetish ditentukan oleh pihak panitia, kemudian jadwal pelaksanaan pelatihan selama 4 hari diadakan pada bulan Juni 2004.
Pelaksanaan pelatihan abon ikan dalam program pembinaan usaha nelayan terdapat faktor-faktor yang mempengaruhi pelaksanaan pelatihan abon ikan, baik yang bersifat mendukung pelaksanaan pelatihan maupun yang bersifat menghambat pelaksanaan pelatihan, adapun faktor yang mendukung pelaksanaan pelatihan adalah berasal dari keterampilan dasar peserta dalam membuat abon, pelatih yang berpengalaman, materi yang mendukung tujuan pelatihan, jadwal pelaksanaan yang sesuai dengan kesempatan peserta serta metode pelatihan yang tepat untuk untuk meningkatkan keterampilan peserta.
Sedangkan faktor penghambat berasal dari rendahnya tingkat pendidikan peserta pelatihan dan jumlah peserta sebanyak 30 orang yang terlatu ramai dan tidak terpantau oleh pelatih, kemudian berbagai kendala yang menjadi penghambat tersebut direkomendasikan dalam bentuk saran untuk perbaikan pelaksanaan pelatihan kedepannya."

"Dalam kehidupan perekonomian Indonesia diperlukan adanya pengaturan mengenai batas-batas yang boleh dan tidak boleh dilakukan dalam persaingan usaha dan untuk itu telah terbit Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat (UU Anti Monopoli) beserta dibentuknya lembaga pengawas bagi pelaksaannya yaitu Komisi Pengawas Persaingan Usaha (KPPU). Permasalahan pokok yang diteliti adalah kesesuaian antara dasar dan pertimbangan-pertimbangan yang dipergunakan oleh KPPU dalam Putusan KPPU Nomor 07/KPPU-LI/2001 serta amar Putusannya dibandingkan dengan ketentuan dalam UU Anti Monopoli. Penelitian dilakukan dengan menggunakan metode penelitian hukum normatif berdasarkan data sekunder yang terdiri dari bahan hukum primer yaitu Putusan KPPU Nomor 07/KPPU-LI/2001, dan UU Anti Monopoli; bahan hukum sekunder meliputi buku, artikel ilmiah dan penelaahan para ahli hukum terhadap praktek monopoli dan persaingan tidak sehat serta bahan hukum tertier dan dianalisis dengan metode kualitatif untuk disimpulkan dalam bentuk eksplanatoris¬analitis.
Hasil penelitian mengarah pada kesimpulan bahwa dasar dan pertimbangan hukum yang dipergunakan oleh KPPU dalam Putusan KPPU Nomor 07/KPPU-LI/2001 telah sesuai dengan Pasal 22 UU Anti Monopoli yang melarang Pelaku Usaha bersekongkol dengan pihak lain untuk mengatur dan atau menentukan Pemenang Tender sehingga dapat mengakibatkan terjadinya persaingan usaha tidak sehat. Sanksi berupa larangan untuk mengikuti Tender serupa selama 2 (dua) tahun di seluruh wilayah Republik Indonesia, yang dijatuhkan kepada Pelaku telah sesuai dengan kewenangan KPPU menurut pasal 47 ayat (1) dan (2) huruf c untuk menjatuhkan sanksi admiministratif berupa larangan melakukan kegiatan usaha bagi pelanggar UU Anti Monopoli serta hasil pemeriksaan Majelis Komisi yang dapat membuktikan telah terjadinya Persekongkolan antara Pelaku dengan Panitia Pelelangan dan Kepala Dinas Perternakan berupa perlakuan khusus bagi peserta lelang tertentu.

In the business realm particularly in Indonesian economic life, there is a need of regulation that determines the matters allowed and prohibited in term of business competition, and for that reason the government has made the Law No.5 Year 1999 concerning the Prohibition of Monopoly Practice and Unfair Business Competition (Anti Monopoly Law), while at the same time established the supervising body for the implementation, named the Supervising Committee on the Business Competition. The main problem to be addressed here is whether the basis and considerations used by the committee in its decision No.07IKPPU-LI12001 and its implementation have been in accordance with the Anti Monopoly Law. This research is conducted by using a normative legal research method, based on secondary data consists of primary legal material (The Committee's Decision No.07IKPPU-LI12001, and the Anti Monopoly Law); and secondary data comprising books, scientific articles and unfair competition, as well as tertiary legal material, which are being analyzed in form of explanatory analytical.
The result shows that the basis and the legal consideration used by the Committee in the decision mentioned above has already in accordance with the Article 22 Anti Monopoly Law that prohibits a business practitioner to collude with other party to manipulate and determine the winner of the auction. The punishment imposed to them, in form of 2 (two) years of ban to participate in any auction in the territory of Republic of Indonesia, is in accordance with the Article 47 section (1) and (2) letter c, mentioning the imposing of administrative punishment in form of prohibition to conduct any business activity. In addition, the investigation conducted by the Board of Commission also has managed to prove the collusion committed by the convict and the auction committee, as well as the Chief of Farming Bureau, in form of the grant of privilege to certain auction participants.
