"Di era zaman modern ini, manusia dituntut untuk lebih bekerja keras dalam memenuhi
kebutuhan dan keinginan mereka. Salah satunya dengan cara berinvestasi. Investasi
adalah suatu tindakan dimana seseorang membeli saham, obligasi, atau surat pernyataan
lainnya. Salah satu jenis investasi adalah Exchange-Traded Funds (ETF) yang dimana
investor dapat melihat pergerakan saham didalamnya dan membuat keputusan untuk
membeli atau menjual saham yang disebut sebagai trading. Pada skripsi ini, ditunjukkan
bahwa algoritma trading berdasarkan teori kontrol dapat membantu investor dalam
membuat keputusan tersebut untuk mendapatkan nilai portofolio yang optimal dalam
transaksi ETF. Hasil implementasi pada tiga saham, menunjukkan bahwa terdapat saham
dan kombinasi saham tertentu yang memiliki nilai portofolio optimal. Nilai portofolio
optimal ditentukan oleh kecepatan nilai portofolio tersebut mencapai target dan besarnya nilai portofolio tersebut pada akhir periode.(
)In this modern era, humans are required to work harder in fulfilling their needs and
desires. One of them is by investing. Investment is any action in which someone buy
shares, bonds, or other. One type of investment is Exchange-Traded Funds (ETF) where
investors can see the movement of shares in it and make the decision to buy or sell shares
called trading. In this thesis, it is shown that trading algorithms based on control theory
can help investors make these decisions to get optimal portfolio values in ETF
transactions. The results of the implementation of three stocks indicate that there are
certain stocks and stock combinations that have optimal portfolio values. The optimal
portfolio value is determined by the speed at which the portfolio value reaches the target
and the value of the portfolio at the end of the period.

"ABSTRAK
Tesis ini membahas tentang konsep trading in influence yang ketentuannya terdapat dalam Pasal 18 United Nation Convention Against Corruption (UNCAC). Indonesia sebagai salah satu negara yang ikut menandatangani konvensi ini belum meratifikasi aturan mengenai trading in influence dalam hukum positifnya. Padahal dalam perkara korupsi di Pengadilan Tipikor beberapa diantaranya teridentifikasi sebagai perbuatan trading in influence seperti suap impor daging sapi dengan terdakwa Luthfi Hasan Ishaaq dan Ahmad Fatanah. Metode penelitian yang digunakan adalah penelitian normatif yaitu penelitian yang dilakukan terhadap peraturan perundang-undangan dan kepustakaan hukum serta doktrin yang berkaitan dengan konsep trading in influence. Tesis ini juga membandingkan ketentuan mengenai trading in influence di beberapa negara. Hasil penelitian menyimpulkan bahwa konsep trading in influence memiliki unsur yang hampir sama dengan suap dan gratifikasi sehingga aturan mengenai suap dan gratifikasi dapat digunakan untuk menjerat pelaku trading in influence. Walaupun belum ada delik tersendiri yang mengatur konsep ini, namun pelaku dapat dijerat dengan Pasal 55 KUHP yang dijunctokan dengan pasal mengenai suap atau gratifikasi. Kondisi ini menunjukkan adanya korelasi antara trading in influence dan penyertaan.

ABSTRACT
This thesis discusses the concept of trading in influence that contained in Article 18 United Nation Convention Against Corruption (UNCAC) . Indonesia as one of the countries that signed the convention has not ratified the rules on trading in influence has not ratified the rules on trading in influence in their positive law. Whereas in the case of corruption in the corruption court, some of which have been identified as the act of trading in influence such bribes beef import quota by the defendant Luthfi Hasan Ishaaq and Ahmad Fathanah. The research uses normative research method that is a study of legislation and legal literature and doctrine relating to the concept of trading in influence. This thesis also compared the provisions on trading in influence in some countries. The study concluded that the concept of trading in influence has elements similar to bribery and graft so that the rules regarding bribery and graft can be used against trading in influence. Consequently, although there is no separate set offence, the offender can be charged with Article 55 of the Penal Code in conjunction with Article regarding bribes or gratuities. These condition indicate the existence of the correlation between trading in influence and participation.

"Skripsi ini membahas mengenai penerapan Misappropriation Theory pada pengaturan Insider Trading di Indonesia. Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif. Pengaturan Insider Trading di Indonesia masih memiliki celah hukum dimana Pasal 95 dan 96 UUPM masih menganut Fiduciary Duty Theory. Celah hukum tersebut menjadi hambatan bagi OJK untuk melakukan penegakan hukum pada praktik Insider Trading di Indonesia. Apabila kasus Salman V. United States terjadi di Indonesia, maka Salman tidak akan terjerat oleh hukum. Hal ini dikarenakan menurut teori fiduciary duty, Salman tidak termasuk dalam kategori orang dalam ataupun tippee, dan UUPM tidak mengatur mengenai Secondary Tippee. Oleh karena itu, Misappropriation Theory perlu diterapkan di UUPM sehingga celah hukum pada pengaturan Insider Trading di Indonesia dapat teratasi dan penegakan hukum yang dijalankan oleh OJK dapat berjalan dengan baik.

The focus of this study is to analyze the implementation of Misappropriation Theory in Indonesias Insider Trading law. The method used in this study is a normative juridical method. Theres a shortcoming in Indonesias Insider Trading Law, in which Article 95 and 96 of Indonesias Capital Market Regulation still uses Fiduciary Duty Theory. In order to enforce the law against Insider Trading practices, this loophole is an obstacle for Indonesias Financial Service Authority. If Salman V. United States happened in Indonesia, Salman will not be able to be prosecuted because according to fiduciary duty theory, Salman is not an insider or a tippee, and Indonesias Capital Market Regulation did not regulate Secondary Tippee. Therefore, Misappropriation Theory should be implemented in Indonesias Insider Trading law in order to fix this legal loophole and law enforcement carried out by Indonesias Financial Service Authority could run well."

"July 2007 is the beginning of the world's subprime mortgage crisis.  Since then, the world's liquidity crisis occurred and never found any solution until now.  The liquidity crisis began to spread developed countries to poor countries, developing countries and emerging markets with two channels. This contagious crisis made growing economy and emerging economy fell.  No country in the world survived, including Indonesia.  This paper discussed the management of investments in Indonesia. It started from the spread of global crisis to Indonesia and its impact on investment in Indonesia.  Then, we discussed the government's efforts to encourage investment.  The last was the view of the investment for the next three years (2010-2014)."

"ABSTRAK
The increases in cross-border trade has resulted in more companies with assets, business, and presence in multiple jurisdiction. When any of these companies face debt restructuring or insolvency, it confronts a myriad of complex issues in coordinating rescue proposals or winding up the businesses across jurisdictions. Prior to the 1997 economic crisis, insolvency laws in most state economies were generally out of date and irrelevant to the modern commercial needs, particulary the cross-border insolvency matters that has not been well regulated. ASEAN has initiated an integrated economy regional by launching an ASEAN Economic Community on late 2015. It aimed to establish a deeply integrated and highly cohesive ASEAN economy that would support sustained high economic growth and resilience in the face of global economic shocks and volatilities within ASEAN members. Unfortunately, ASEAN member has not prepared a regulation regarding cross-border insolvency matters which could restrains its aim to establish a fully integrated economy regional. Each state members has its own national insolvency laws and proceedings, but none have the schemes that could surpassed the national borders and simplified the procedures. The aspects of cross-border insolvency from both the International law and domestic law of Indonesia is already prepared to deal with foreign proceedings. Both could be adjusted to establish a cross-border regulation in ASEAN. Hence, there should be an in-depth harmonization of cross-border insolvency should be another priority upon ASEAN Economic Community to achieve a fully-integrated economy in ASEAN."

"In July 2018, Indonesia government implements an Online Single Submission (OSS) system to ease the process of doing business and reduce the time needed for license and permit application. The OSS system is run by Indonesian Investment Coordinating Board (BPKM). One of the aims of this implementation is to increase the level of investment in Indonesia. This research provides evidence the effectiveness or lack thereof of this implementation in achieving this aim. Using common effect panel data regression analysis with quarterly investment data provided by the OSS system between Q1 2016 to Q4 2020, overall it is found that there is indeed a significant positive relationship between the implementation of OSS system and level of investment. However, this is only true for domestic direct investment (DDI), while no such relationship is found for foreign direct investment (FDI). Examining regionally, this study also finds that this positive relationship between OSS implementation and DDI only holds true in the west region of Indonesia, the islands of Sumatera, and Java. While looking at the industry, increase in DDI is found in primary or agriculture and extractive industry and tertiary or service industry.

Pada bulan juli 2018, Pemerintah Indonesia menerapkan sisem Online Single Submission (OSS) untuk meningkatkan tingkat kemudahan berusaha dan mengurangi waktu yang dibutuhkan dalam proses pengajuan izin. Sistem OSS dikelola oleh Kemeneterian Investasi/Badan Koordinasi Penanaman Modal (BKPM). Salah satu tujuan utama penerapan OSS diharapkan dapat meningkatkan realisasi investasi di Indonesia. Dengan menggunakan analisis regresi data panel common effect dengan data realisasi investasi per triwulan yang didapatkan dari sistem OSS diantara triwulan pertama tahun 2016 sampai dengan triwulan keempat tahun 2020. Secara umum dapat ditemukan bahwa adanya hubungan signifikan dan positif terhadap tingkat realissi investasi. Namun hal ini hanya berlaku untuk Penanaman Modal Dalam Negeri (PMDN) dan tidak tercermin untuk Penananaman Modal Asing (PMA). Dengan menguji secara tingkat regional, penelitian ini menemukan hubungan signifikan dan positif tersebut hanya dapat ditemukan di wilayah barat dan timur Indonesia untuk PMDN. Terkait sektor industri, penerapan OSS berdampak signifikan terhadap PMDN hanya untuk sektor tersier/jasa."

"ABSTRAK
Penelitian ini bertujuan untuk menganalisis pengaruh kepemilikan pemerintah dan kepemilikan asing terhadap efisiensi investasi pada perusahaan di Indonesia, Malaysia, Singapura dan Thailand periode 2012-2016. Data yang digunakan merupakan data panel dengan metode Ordinary Least Square. Hasil penelitian ini adalah kepemilikan negara memiliki pengaruh positif signifikan terhadap efisiensi investasi di Indonesia, kepemilikan negara berpengaruh positif dan tidak signifikan di Malaysia dan Singapura, sedangkan kepemilikan negara berpengaruh negatif signifikan di Thailand. Selain itu interkasi kepemilikan negara terhadap peluang investasi menunjukan negatif dan tidak signifikan di Indonesia, Malaysia dan Thailand, tetapi positif dan tidak signifikan di Singapura. Temuan lainnya adalah kepemilikan asing berpengaruh positif dan tidak signifikan di negara Indonesia, Malaysia dan Singapura. Kepemilikan asing berpengaruh negatif dan tidak signifikan di Thailand. Interaksi kepemilikan asing dan peluang investasi menunjukan pengaruh negatif dan tidak signifikan di Indonesia, Malaysia, Singapura dan Thailand. Penelitian juga menguji hubungan antara kepemilikan asing dan investasi terhadap country level institution. Country level institution diukur dengan menggunakan political risk component berupa government stability, investment profile dan law and order. Hasil penelitian menunjukan bahwa tidak terdapat signifikansi antara hubungan kepemilikan asing dan investasi terhadap government stability, investment profile dan law and order di Indonesia, Malaysia, Singapura dan Thailand.

ABSTRACT
This study aims to measure impact of state ownership and foreign ownership to investment efficiency of companies in Indonesia, Malaysia, Singapore and Thailand 2012 2016. This study used panel data with Ordinary Least Square OLS method. The result of this study is state ownership has negative and significant effect on investment efficiency in Indonesia, state ownership has positive and insignificant effect on investment in Malaysia and Singapore, while state ownership has negative and significant effect on investment efficiency in Thailand. In addition, interaction between state ownership are negative insignificant in Indonesia, Malaysia and Thailand, but positive insignificant in Singapore. The other findings are foreign ownership has positive and not significant on investment efficiency in Indonesia, Malaysia, Singapore and Thailand, but foreign ownership has negative and insignificant effect in Thailand. Interaction between foreign ownership and investment opportunities show negative insignificant effect in Indonesia, Malaysia, Singapore and Thailand. This study also examine relation between foreign ownership and investment efficiency on country level institution. Country level institution are measured by political risk component such as government stability, investment profile and law and order. The result show that there is no significance between relation of foreign ownership and investment to government stability, investment profile and law and order in Indonesia, Malaysia, Singapore and Thailand. "
