"Pembiayaan rantai pasokan yang digunakan sebagai mekanisme transaksi dalam konsep dealer financing diawali dengan penjualan barang dari PT. X ke dealer secara kredit. PT. X berdasarkan persetujuan dengan dealer akan menjual piutang tersebut ke bank/perusahaan pembiayaan (kreditur). Selanjutnya data transaksi diteruskan kepada pihak kreditur untuk keperluan penagihan dan kontrol. Kemudian kreditur membayarkan sejumlah nilai transaksi kepada PT. X. Pada tahap akhir dealer akan melunasi nilai transaksi kepada bank atau perusahaan pembiayaan paling lambat pada saat jatuh tempo. Mekanisme transaksi ini memiliki beberapa dilema meliputi setiap dealer yang diharuskan menggunakan dealer financing dan menanggung beban bunga yang sama tanpa memperhatikan kinerja likuiditas masing-masing dealer.

Supply chain financing as a transaction mechanism in dealer financing concept is begun by selling on credit the finished good from PT. X to the dealer. Based on the covenant between PT. X and dealer, PT. X will sell the receivable to the bank/financing company (creditor). Mobil Timor dijual dengan harga separuh lebih murah dari harga mobil sedan di pasaran. Hal ini dianggap merugikan bagi Jepang dan Amerika Serikat, sehingga membawa permasalahan ini ke WTO. Lalu saat krisis ekonomi, Presiden Soeharto menandatangani kesepakatan peminjaman hutang dengan IMF dengan salah satu syaratnya yaitu mencabut kebijakan mobil nasional. Setelah itu, keluarlah Keppres No. 20 Tahun 1998 Tentang Pembuatan Mobil Nasional.

Indonesian Government pass the President's Order (Inpres) No. 2/1996 about the National Car Project to push the nation's independency in the domestic car industries and manufacture. Timor Putra Nasional, Ltd. had been chosen to be the only corporate that is subsidized by the government as the only brand for the national car project. Timor's car was sold publicy with the price half cheaper than any other sedan class car during that time. This was considered as a profit-killing situation for Japan and US, so that makes both countries sent a report to WTO. Then, during the economy crisis, president Soeharto signed a letter of intent with IMF in a certain condition: The Withdrawal of National Car Project's Policy. Later on, the President's Decision (Keppres) No. 20/1998 policy about the Cancellation of National Car Project."

"Aktivitas perdagangan internasional semakin tak lagi dapat dielakkan pada era globalisasi saat ini. Seiring dengan perkembangan aktivitas perdagangan internasional kerap pula ditemukan berbagai permasalahan yang membumbui hubungan dagang tersebut. Salah satu sengketa perdagangan internasional yang pernah dialami Indonesia adalah terkait Program Mobil Nasional. Program ini didukung pemerintah dengan pengesahan berbagai kebijakan yang dinyatakan berlaku guna meraih peluang bisnis industri di bidang automotive. Namun, dalam kelanjutannya beberapa negara yang memiliki penguasaan pasar yang besar di Indonesia, yakni Amerika, Jepang dan Eropa merasa kebijakan yang diberikan pemerintah menimbulkan kerugian bagi mereka, yang kemudian berimplikasi pada pengajuan gugatan Indonesia ke WTO. Dalam tulisan ini, penulis mencoba menganalisa pokok permasalahan berikut: Mengapa Proyek Mobil Nasional melanggar WTO? Bagaimana perkara ini diselesaikan dalam WTO dan bagaimana sikap Indonesia menanggapi sengketa Mobil Nasional ini? Bagaimana konsekuensi jika Indonesia tidak melaksanakan putusan appellate body WTO? Penelitian atas permasalahan tersebut ditujukan untuk memperoleh pemahaman yang komprehensif terkait penyelesaian masalah perdagangan internasional di WTO. Adapun metode penelitian yang dilakukan dalam menulis karya ilmiah ini adalah metode yuridis normative dengan menggunakan data sekunder yang terdiri dari sumber bahan hukum primer, sumber bahan sekunder dan sumber bahan tersier. Dalam kasus ini yang menjadi focus gugatan para pihak adalah pelanggaran prinsip perdagangan Internasional dalam General Agreement on Tariff and Trades (GATT) yakni prinsip Most Favored Nation dan National Treatment. Gugatan tersebut kemudian dikabulkan oleh putusan panel yang kemudian juga disetujui oleh Dispute Settlement Body WTO. Ketentuan yang telah diputus oleh panel tersebut secara imperative mengikat pemerintah Indonesia untuk mencabut seluruh kebijakannya terkait mobil nasional. Apabila ternyata Indonesia kemudian mengabaikan putusan tersebut akan ada konsekuensi yang harus diterima, diantaranya adalah upaya retaliasi.

International trade activity is now become inevitable in the current globalization era. Along with the growing international trade activities, also found various dispute that often spice up the trade relations. One of the international trade dispute ever experienced by Indonesia is regarded to the National Car Program. The program is supported by the government with the recital of the various policies set out policies to achieve business opportunities in the field of automotive industry. However, some countries with large market coverage in Indonesia, namely the U.S., Japan and Europe are given government policies that cause harm to them, which then has implications for the filing of a lawsuit Indonesia to the WTO.

In this paper, the authors tried to analyze the following basic problems: Why is the National Car Project violates the WTO? How the case is resolved in the WTO and how to respond to the attitude of Indonesian National Car dispute this "What consequences if Indonesia does not implement the decision of the WTO appellate body" Research on these issues is intended to build a comprehensive understanding of issues related to the settlement of international trade at the WTO. The method of research that had been applied in this scientific work is a normative juridical method, using secondary data consisting of the primary sources of legal materials, secondary source material, and tertiary source material.

In this case that the focus of a lawsuit the parties is a violation of the principle of international trade in the General Agreement on Tariffs and Trades (GATT), namely the principle of Most Favored Nation and National Treatment. The lawsuit was later granted by the decision of the panel which then also approved by the WTO Dispute Settlement Body. Provisions that have been decided by the panel are imperative bind the Indonesian government to repeal all national car-related policies. If it appears that Indonesia would then ignore the decision there are consequences that must be accepted, including the retaliation effort."

"ABSTRAKLaporan ini membahas proses audit untuk siklus penjualan mobil di PT CPA yang dilakukan oleh KAP KPS. PT CPA menjalankan bisnis di bidang perdagangan dan jasa industri otomotif. Prosedur audit yang dirancang berdasarkan dari audit manual KAP KPS. Tim audit melakukan serangkaian tes untuk memastikan apakah penjualan mobil telah disajikan secara wajar. Pada akhirnya, auditor menyimpulkan bahwa tidak ada salah saji material dan informasi keuangan telah disusun berdasarkan standar yang berlaku.

ABSTRACTThis report discusses the audit process for car sales cycle in PT CPA which was performed by KAP KPS. PT CPA runs business in trading and services of automotive industry. The audit procedures were designed based on the audit manual of KAP KPS. The audit team performed series of tests to ensure whether the car sales is fairly stated. Finally, the auditor concluded that there is no material misstatement and financial information has been prepared based on applicable standards. "
