"ABSTRAKDalam hubungan kerja diperlukan adanya aturan yang mengatur syarat-syarat kerja. KKB merupakan aturan kerja yang dibentuk atas dasar negosiasi pekerja dan pengusaha. Akan tetapi, KKB memiliki realisasi terendah dibandingkan aturan lain seperti Peraturan Perusahaan PP . Penyebabnya adalah keengganan pengusaha dan ketidakpahaman pekerja mengenai KKB. Berdasarkan permasalahan tersebut, penelitian ini bertujuan untuk menganalisis mengenai peran pemerintah dalam menguatkan KKB sebagai sarana menciptakan industrial peace. Penelitian ini menggunakan metode kualitatif dan pengumpulan data melalui wawancara mendalam dan studi dokumentasi. Hasil penelitian menunjukkan peran Kementerian Ketenagakerjaan terkendala oleh kuantitas sumber daya manusia yang ada serta keterbatasan anggaran yang dimiliki Kementerian Ketenagakerjaan.

ABSTRACTIn employment relation required the existence of rules that set the terms of work. The KKB is the rules of work that formed on the basis of negotiations between workers and employers. However, KKB has the lowest realization compared to other rules, such as Company Regulation PP . One of the cause is the reluctance of the employers and the lack of understanding of workers regarding KKB. Based on these problems, this research aims to analyze the role of the government in strengthening the KKB as a means of creating industrial peace. This research uses the qualitative method and data collection through in ndash depth interviews and documentation study. The results of the research shows the role of Ministry of Manpower constrained by the quantity of human resource and limited budget which owned by the Ministry of Manpower."

Penelitian inimenggunakan bentuk yuridis-normatif dengan data sekunder ditambah wawancaradengan narasumber dan menggunakan metode deskriptif analisis, yaitumenguraikan dan menganalisis isi Perjanjian Kerja Waktu Tertentu (PKWT) danPerjanjian Kerja Bersama (PKB) pada PT Panasonic Manufacturing Indonesiadalam rangka melihat kesesuaian isi PKWT dengan PKB. Tujuan dari penelitianini agar PKB sebagai peraturan induk dari Perjanjian Kerja dapat menghasilkanPerjanjian Kerja yang baik. Ketentuan dalam PKB di PT PanasonicManufacturing Indonesia telah sesuai dengan peraturan perundang-undangan,namun isi dari PKWT tidak seluruhnya mengacu pada PKB yang ada.

ABSTRACTThis thesis explains about the importance of appropriate regulation foremployment contract between workers and employer. This research use normativeform with secondary data and interview the informant and use descriptiveanalytical methode, that is to unravel and analyze the content and the conformityof Employment Agreement for Certain Time Periode and Collective LabourAgreement on PT Panasonic Manufacturing Indonesia. "ABSTRAKSkripsi ini membahas mengenai analisis peran serikat pekerja pada Jakarta International Container Terminal (JICT) dan dalam pembahasannya penulis fokus pada studi tentang hubungan industrial tripartit. Berlandaskan kepada teori yang dikemukakan Bennington and Moor, terkait teori peran, teori serikat pekerja, dan teori hubungan industrial, maka penelitian ini akan melihat peran dari serikat pekerja JICT itu sendiri dalam melakukan hubungan industrial dan dukungan pemerintah terhadap eksistensi dari serikat pekerja JICT. Pendekatan penelitian yang digunakan peneliti adalah pendekatan kualitatif dengan tujuan penelitian eksplanatif dengan teknik pengumpulan data melalui wawancara mendalam kepada berbagai narasumber yang relevan dan studi literatur. Hasil dari penelitian ini menunjukkan bahwa serikat pekerja JICT telah melakukan peran dan fungsinya sebagai serikat pekerja dengan baik dalam lingkup seperti menampung aspirasi dan keluhan, merumuskan Perjanjian Kerja Bersama (PKB), menjadi perwakilan pekerja di lembaga kerjasama pada Bipartit dan Tripartit, membantu menyelesaikan perselisihan atau permasalahan hubungan industrial, serta meningkatkan kemampuan pekerja JICT. Selain itu, terdapat pula dukungan pemerintah terhadap eksistensi serikat pekerja dalam bentuk pembuatan regulasi, menyediakan layanan, serta menyediakan perlindungan.

ABSTRACT

This thesis discusses the analysis about the role of labor unions in the Jakarta International Container Terminal (JICT) and the focus of this thesis is also discussion about the study of industrial tripartite relations. Based on role theory, trade union theory, and industrial relations theory that put forward by Bennington and Moor, this study will look at the role of the JICT labor unions itself in conducting industrial relations and how government support the existence of JICT labor unions. The approach of this research also used qualitative with the aim of descriptive research with data collection techniques through in depth interviews with various relevant sources and literature studies. The results of this study indicate and explain that the JICT labor union has carried out its role and function as a labor unions in the good way in areas such as accommodating aspirations and complaints, formulating Collective Labor Agreements (PKB), becoming workers representatives in cooperation institutions on Bipartite and Tripartite, helping to resolve disputes or industrial relations issues, and increasing the ability of JICT workers. In addition, on industrial relations there is also government support for the existence of labor unions in the form of making regulations, providing services, and providing protection."
