"Menurut pasal 1868 Kitab Undang-Undang Hukum Perdata "Suatu akta otentik ialah suatu akta yang dibuat dalam bentuk yang ditentukan undang-undang oleh atau dihadapan Pejabat Umum yang berwenang untuk itu di tempat akta itu dibuat". Jasa Notaris sebagai Pejabat Umum yang membuat akta-akta otentik sangat dibutuhkan dalam kegiatan usaha perbankan, salah satunya adalah dalam pembuatan akta perjanjian kredit perbankan yang melibatkan Nasabah dan Bank, guna menjamin kebenaran dari isi yang dituangkan dalam perjanjian kredit perbankan tersebut, supaya secara publik kebenarannya tidak diragukan lagi. Berdasarkan latar belakang hal tersebut maka yang menjadi pokok permasalahan dalam tesis ini pertama Bagaimanakah Peran Notaris terhadap permasalahan terbakarnya objek jaminan nasabah terkait dengan akta perjanjian kredit yang dibuat olehnya Yang kedua Bagaimanakah Tanggung Jawab Notaris terhadap Akta Perjanjian Kredit yang dibuatnya untuk melindungi kepentingan para pihak (Kreditur dan Debitur).
Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisa peran Notaris dan tanggung jawab Notaris terhadap akta yang dibuatnya dan apakah dapat melindungi kepentingan para pihak. Metode penelitian yang digunakan adalah melalui metode pendekatan yuridis empiris, dengan menggunakan data primer dan data sekunder. Perjanjian kredit perbankan yang dibuat secara notariil bermanfaat bagi para pihak, dalam hal menjamin kekuatan pembuktiannya, menjamin kebenaran dari aktanya Penyelesaian hukum terhadap akta perjanjian kredit perbankan bila timbul persengketaan, dan Notaris mempunyai peran yang penting terhadap kebenaran akta yang dibuatnya.

According to Article 1868 KUHPerdata mentioned: an authentic deed is a made deed in the form of which is determined by code, by or before Public Functionary in charge for that in place that deed is made". Service Notary as Public Functionary which make authentic deed very required in banking business activity, one of them is in making deed agreement of banking credit entangling Client and Bank, utilize to guarantee the truth from content which is poured in agreement of banking credit, so that publicly its truth no doubt again. Based on that the subject matter for this thesis first how is the role of the Notary towards the credit agreement which the objects of the guarantee had burned, and the second subject matter is How Responsibilities of the Notary Towards of Credit Agreement were made to protect the interests of the parties (creditors and debtors).
Intention this research is to know and analyze the role and responsibilities of Notary Public Notary of the deed he made and whether it can protect the interests of the parties. Research method the used is to through method approach empirical juridical, by using primary data and secondary data. Made Credit banking agreement by notarial be of benefit to creditor, in the case of guarantying strength of its verification, guarantying the truth of from its deed and guarantee its investment security. and the Notary has an important role to the truth of the deed made.

"Kebutuhan manusia yang begitu banyak sering kali tidak dapat dipenuhi dengan dana yang ia miliki sehingga manusia memerlukan suatu lembaga yang memberikan fasilitas yang bertujuan untuk memberikan dana penunjang untuk memenuhi kebutuhannya, yakni lembaga jaminan. Dalam pelaksanaannya, setiap lembaga jaminan mengatur tata cara eksekusi nya masing-masing. Hukum Indonesia yang mengenal dua lembaga jaminan yakni lembaga jaminan gadai dan fidusia, mengatur bahwa pelaksanaan eksekusi terhadap benda jaminan khususnya benda bergerak dapat dilakukan melalui lembaga parate executie yang dilakukan tanpa melibatkan proses peradilan dan rieel executie yang dilakukan melalui proses peradilan. Disini diketahui bahwa dalam pelaksanaan eksekusi benda jaminan, negara Indonesia masih melibatkan badan peradilan. Hal tersebut berbeda dengan negara Australia yang pelaksanaan eksekusi benda jaminannya tidak melibatkan badan peradilan. Di negara Australia, hak jaminan benda bergerak yang bernaung dalam satu lembaga yakni lembaga Personal Property Securities, mengatur bahwa terkait pelaksanaan eksekusi nya, para pihak dalam perjanjian penjaminan mengemban hak dan kewajibannya masing-masing berdasarkan Personal Property Securities Act 2009. Sehingga, pelaksanaannya tidak perlu melibatkan badan peradilan. Adanya perbedaan ketentuan tersebut, menjadi dasar penulis untuk melakukan perbandingan terkait pengaturan pelaksanaan eksekusi jaminan benda bergerak antara kedua negara. Dengan itu, dalam skripsi ini akan dibahas mengenai persamaan dan perbedaan pelaksanaan eksekusi lembaga jaminan benda bergerak di Indonesia dan Australia berikut dengan penjelasan umum terkait hukum jaminan yang berlaku di kedua negara. 

Human need often can not be fulfilled because of the limited amount of funds they have, therefore humans need an institution that provides facilities that aim to provide supporting funds to meet their needs, such as security institution.  In practice, every security institution regulates the procedure of its own execution. Indonesia security law, provides two types of security in personal property which is pawn and fiduciary guarantee, both types of security regulate that the execution of collateral can be enforce through parate executie and rieel executie. Enforcing collateral through parate executie does not requaries the court act , while the implementation of rieel executie is involving the court decision. Thus, it is known that the execution of collateral in Indonesian still involves the court act. In the other side, execution of personal property in Australia security law does not involve the court. In Australia, security interest in personal property regulated under one institusion, namely Personal Property Securities. Under the Personal Property Securities, execution of personal property can be enforced by the parties in the security agreement by complying the rights and obligations regulated under Personal Property Securities Act 2009. As a result, the execution of collateral in Australia security law does not requires the court act. The difference in these provisions becomes the basis for the author to make a comparisons related to the execution of personal property between the two countries. Therefore, this thesis will discuss the similarities and differences in the execution of personal property security in Indonesia and Australia along with general explanation related to the security law in both countries. "

"Terjadinya sengketa dalam suatu hubungan kontrak dapat menyebabkan timbulnya pembatalan kontrak. Dalam suatu kontrak dengan pilihan hukum dan pilihan forum asing, khususnya arbitrase yang kini semakin banyak terjadi, pembatalannya tidak sesederhana pembatalan kontrak biasa yang tidak memuat unsur asing. Penelitian ini akan membahas mulai dari forum yang berwenang hingga hukum yang seharusnya diberlakukan untuk pembatalan kontrak internasional. Lebih jauh, dibahas pula mengenai dampak pembatalan kontrak terhadap putusan arbitrase terkait kontrak yang telah memiliki kekuatan eksekutorial. Agar didapatkan pemahaman yang lebih baik, dalam penelitian ini akan dianalisis dua perkara beserta putusan pengadilannya.

A dispute in a contractual relationship can lead to a nullification of the contract.  In a contract with a choice of law and a choice of foreign forum, especially arbitration which occurs more often these days, the nullification is not as simple as the nullification of an ordinary contract which does not contain foreign elements.  This research will discuss starting from jurisdiction to governing law for the nullification of international contracts. Furthermore, it will also discuss the impact of the nullification of the contract on the arbitration award related to a contract that has an executorial power.  In order to get a better understanding, this research will analyse two cases related to the topic and its court decisions.

"Tesis ini membahas tentang bagaimana peran pemerintah dalam usaha memajukan dunia pendidikan di Indonesia sesuai dengan amanat konstitusi Pasal 31 UUD Tahun 1945 serta Undang-Undang tentang Sistem Pendidikan Nasional dan juga menganalisis bagaimana penafsiran Mahkamah Konstitusi dalam Uji Materil Pasal 50 Ayat (3) Undang-Undang Nomor 20 Tahun 2003 tentang Sistem Pendidikan Nasional, serta pengaruh yang timbul akibat adanya putusan tersebut. Dengan adanya putusan Mahkamah Konstitusi Nomor 5/PUU-X/2012 mengenai Sistem Pendidikan Nasional, yang berkaitan dengan pembentukan Rintisan Sekolah Bertaraf Internasional atau Sekolah Bertaraf Internasional secara langsung dan tidak langsung mempengaruhi peran pemerintah terhadap kebijakan rencana dan strategi pendidikan nasional, hal ini tak lepas dari fungsinya dalam memberikan jaminan perlindungan pendidikan yang layak untuk warga negara, adanya putusan tersebut bukan berarti penyelenggara negara dalam hal ini pemerintah dan/atau pemerintah daerah lepas tangan begitu saja untuk mengembangkan RSBI/SBI tetapi justru harus lebih berperan lagi, sepanjang dalam prakteknya tetap memperhatikan pertimbangan hukum Mahkamah Konstitusi karena sejatinya tujuan awal dikembangkannya RSBI/SBI adalah untuk menghasilkan lulusan yang memiliki kompetensi sesuai standar internasional/dunia tetapi tetap menjaga nilai-nilai luhur bangsa dan negara serta budaya lokal.
Penulisan tesis menggunakan metode penelitian yuridis normatif yaitu penelitian yang dilakukan dengan cara meneliti data sekunder atau bahan pustaka dan pendekatan yang digunakan adalah pendekatan perundang-undangan (statue approach).

This thesis discusses how the role of government in an effort to advance education in Indonesia in accordance with the constitutional mandate of Article 31 of the 1945 Constitution and the Law on National Education System and also analyze how the interpretation of the Constitutional Court in the Judicial Article 50 Paragraph (3) of the Law Number 20 Year 2003 on National Education System, As well as the effects that arise as a result of the decision. With the decision of the Constitutional Court No. 5/PUU-X/2012 on National Education System, relating to the establishment of international school or international school directly and indirectly affect the role of government to plan policies and national education strategy. it is not separated from its function in providing protection guarantee a decent education for citizens, the ruling does not mean the state officials in this case the government and/or local governments just hand off to develop RSBI/SBI but it should be more involved again, all in practice taking into account the legal reasoning of the Constitutional Court because his initial goals developed RSBI/SBI is to produce graduates who have the competence to international standards/ world but still maintain high values ​​of the nation and the state as well as local culture.

Penggabungan PT Reasuransi Internasional Indonesia ke dalam PT Reasuransi Indonesia Utama Persero yang dilaksanakan berdasarkan izin Otoritas Jasa Keuangan merupakan kebijakan pemerintah dalam peta jalan pembentukkan Perusahaan Reasuransi Nasional Giant Re . Hal ini dilakukan pemerintah sebagai upaya meningkatkan kapasitas reasuransi dalam negeri yang besar agar dapat menjaminkan ulang risiko dari perusahaan-perusahaan asuransi dalam negeri. Dengan demikian, defisit neraca pembayaran yang dialami negara akibat pertanggungan ulang risiko oleh perusahaan reasuransi luar negeri atas risiko perusahaan asuransi dalam negeri diharapkan dapat teratasi. Berdasarkan hal tersebut, penulis mengajukan pokok permasalahan yaitu: 1. Mengapa penggabungan perusahaan perasuransian harus melalui izin OJK dan mengapa perusahaan berstatus BUMN mendapat perlakuan yang berbeda? 2. Bagaimana pengaturan dan prosedur penggabungan perusahaan perasuransian sebelum dan sesudah POJK Nomor 67 Tahun 2016? 3. Apakah pelaksanaan penggabungan perusahaan reasuransi PT. Reasuransi Internasional Indonesia ke dalam PT. Reasuransi Indonesia Utama Persero telah sesuai dengan Undang-Undang Nomor 40 Tahun 2014 dan Undang-Undang Nomor 19 Tahun 2003? Bentuk penelitian ini bersifat yuridis normatif dengan tipologi penelitian deskriptif. Peneliti memperoleh kesimpulan bahwa pelaksanaan penggabungan tersebut telah sesuai dengan Undang-Undang Nomor 40 Tahun 2014 dan Undang-Undang Nomor 19 Tahun 2003. Penulis menyarankan agar ketentuan mengenai RUPS terkhusus dalam rencana penggabungan BUMN dapat dikaji ulang manfaat dan kegunaannya.

ABSTRACT
The merger between PT Reasuransi Internasional Indonesia and PT Reasuransi Indonesia Utama Persero , permitted by Financial Services Authority of Indonesia OJK , is a part of government rsquo s plan called Road Map to The Establishment of Reinsurance National Company Giant Re . The purpose of the plan is to increase domestic reinsurance capacity in order to re guarantee the risks from domestic insurance companies rsquo premium. By the time domestic reinsurance capacity increased, government is expecting that the premium payment deficit problems are solved. According to those facts, the author formulated and discussed the following problems 1. Why the merger of insurance companies are required to ask a permission from Financial Services Authority of Indonesia OJK and why the merger between state company and non state company are allowed 2. How the insurance regulation set the rules of merger between insurance companies before and after Financial Services Authority Acts 67 2016 3. Is the merger execution between PT Reasuransi Internasional Indonesia and PT Reasuransi Indonesia Utama Persero well suited the law of insurance and law of state company This research uses the normative juridical approach with a descriptive typology. At conclusion, the merger between PT Reasuransi Internasional Indonesia and PT Reasuransi Indonesia Utama Persero is well executed according to the Insurance Acts 2014 and State Company Acts 2003. However, the author suggests that government need to reformulate the regulation about general meeting of shareholders in order to approve the merger plan between state companies. "
