"Skripsi ini membahas tentang keberadaan unsur posisi dominan dan penyalahgunaannya dalam kasus pelayanan Taksi Bandar Udara Internasional Juanda Surabaya. Putusan yang dikeluarkan oleh Komisi Pengawas Persaingan Usaha (KPPU) untuk kasus ini telah berkekuatan hukum tetap pada tahun 2011 dan telah dilaksanakan oleh PT Angkasa Pura I (AP I) dan Primer Koperasi Angkatan Laut (Primkopal) pada 1 Juli 2013. Penelitian ini adalah penelitian yang menggunakan studi dokumen yang bersifat yuridis normatif. Hasil penelitian menyarankan bahwa seharusnya AP I dan Primkopal dapat diduga melakukan penyalahgunaan posisi dominan; mengizinkan operator taksi lain untuk menambah armada taksi argometer mereka apabila ada kelebihan permintaan dari calon penumpang terhadap taksi tersebut; dan memberlakukan sistem pembayaran menggunakan argometer pada semua Taksi Bandara tanpa terkecuali agar sesuai dengan peraturan yang berlaku dan sesuai dengan amar putusan KPPU untuk kasus ini yang telah berkekuatan hukum tetap.

The focus of this study is the existence of abuse of dominant position in the case of taxi services at Juanda International Airport Surabaya. Decision issued by the Commission for the supervision of Business Competition (Komisi Pengawas Persaingan Usaha - KPPU) for this case is final and binding in 2011 and has been implemented by PT Angkasa Pura I (AP I) and Primer Koperasi Angkatan Laut (Primkopal) on July 1, 2013. This research is legal-normative. The results of the study suggest that AP I and Primkopal should be suspected of abusing their dominant position; allowing other taxi operators to increase their fleet of metered taxis if there is excess demand of the passengers for the taxi, and implementing payment system using a metered taxi service to all taxi fleet without exception in order to enforce the applicable regulations and in accordance with the ruling of the KPPU."

"ABSTRAK
Notaris/Pejabat Pembuat Akta Tanah/Pejabat Lelang Kelas II seharusnya
memiliki peran yang penting dalam rangka membantu menurunkan tingkat tindak
pidana pencucian uang di Indonesia. Tulisan ini membahas bagaimana peran dari
Notaris/Pejabat Pembuat Akta Tanah/Pejabat Lelang Kelas II dalam melakukan
pencegahan dan pemberantasan tindak pidana pencucian uang serta bagaimana
kasus hukum yang terkait dengan peran dari masing-masing profesi tersebut
dalam mencegah dan memberantas tindak pidana pencucian uang di Indonesia.
Permasalahan tersebut dijawab dengan menggunakan metode penelitian yuridis
normatif yang meliputi studi kepustakaan dan wawancara dan kemudian
menghasilkan kesimpulan bahwa tindakan pencegahan dapat dilakukan dengan
menerapkan prinsip Know Your Customer (KYC), Customer Due Diligence
(CDD), dan Enhanced Due Diligence (EDD). Sedangkan tindakan pemberantasan
dapat dilakukan dengan melakukan kewajiban pelaporan kepada PPATK bagi
profesi yang telah menjadi Pihak Pelapor atau melaporkan adanya indikasi tindak
pidana pencucian uang kepada instansi penegak hukum bagi profesi yang belum
menjadi Pihak Pelapor, selain itu para Notaris/Pejabat Pembuat Akta
Tanah/Pejabat Lelang Kelas II juga dapat berperan dalam rangka memberantas
tindak pidana pencucian uang dengan bertindak secara kooperatif apabila
keterangan atau kesaksiannya diperlukan dalam suatu proses hukum.

ABSTRACT
A Notary/Land Deed Official/Auctioneer Class II should have an important role
in the prevention and eradication of money laundering in Indonesia. This paper
discusses about the role of Notary/Land Deed Official/Auctioneer Class II in the
prevention and eradication of money laundering and various legal cases relating to
the role of each of these professions in preventing and combating money
laundering in Indonesia. The problem is answered by using normative juridical
research method, which includes studies of literature and interviews. It leads to
the conclusion that the prevention measure which should be taken and
implemented by a Notary/Land Deed Official/Auctioneer Class II are Know Your
Customer (KYC) principle, Customer Due Diligence (CDD) principle and
Enhanced Due Diligence (EDD) principle. A Notary/Land Deed
Official/Auctioneer Class II should also help combat money laundering by
reporting requirements to INTRAC to those who have become Reporting Parties
or reporting indication of money laundering to the law enforcing institutions for
those who have not become Reporting Parties, moreover Notary/Land Deed
Official/Auctioneer Class II may also combat money laundering by acting
cooperatively in the event of providing evidence and information in any relevant
judicial proceeding."

Pemerintah Kota Surabaya mempunyai pengaturan tanah yang unik dan tidak dijumpai di kota manapun di Indonesia dengan memberikan Surat Izin Pemakaian Tanah atau sering dikenal dengan ldquo Surat Hijau rdquo yang mendasari penarikan retribusi kepada masyarakat Pengaturan tanah tersebut di atas tanah negara dan sebagian lagi memang di sebagian tanah Aset Daerah Kota Surabaya sendiri Penelitian Kebijakan Penyelesaian Konflik Pertanahan di atas ldquo Surat Hijau rdquo di Kota Surabaya ini menggunakan metode penelitian hukum normatif yaitu penelitian hukum yang dilakukan dengan cara meneliti data sekunder atau bahan pustaka Dalam perkembangannya masalah ldquo Surat Hijau rdquo telah menimbulkan berbagai macam konflik antara pemegang ldquo Surat Hijau rdquo dengan Pemerintah Kota Surabaya Konflik ini timbul karena terdapat perbedaan persepsi antara masyarakat dan Pemerintah Kota Surabaya dalam merujuk peraturan mengenai masalah penguasaan tanah Untuk itu diperlukan solusi yang saling menguntungkan antara pemegang ldquo Surat Hijau rdquo dengan Pemerintah Kota Surabaya.

Penelitian ini menggunakan metode yuridis-normatif dengan meninjau aturan iktikad baik dalam Undang-Undang No 15 Tahun 2001 dan Undang-Undang No 20 Tahun 2016, Putusan-Putusan Hakim di Indonesia dikomparasikan dan diulas dengan pendapat para ahli hukum dan Putusan US Supreme Court dan European Union Supreme Court. Hasil penelitian menyimpulkan dibutuhkan aturan atau panduan yang lebih detail mengenai penentuan ada atau tidaknya iktikad baik dalam sengketa merek di Indoneisa.
This thesis discusses the regulation and implementation of the principle of good faith in trademark disputes that focus on cancellation of the trademark in Indonesia. This study uses the juridical normative by reviewing good faith principles in the Law No. 15 of 2001 and Law No. 20 of 2016, Judge Decisions in Indonesia that compared and reviewed with the opinion of legal experts and Decision of US Supreme Court and the European Union Supreme Court. The research concludes rules or guidelines necessary details regarding the determination of whether there is any good faith in trademark disputes in Indonesia."
