"Skripsi ini membahas mengenai perlindungan hukum bagi nasabah pengguna layanan internet banking sebagai salah satu terobosan bagi dunia perbankan. Di sisi lain, penyelenggaraan layanan internet banking tidak terlepas dari berbagai resiko yang pada akhirnya dapat merugikan nasabah pengguna selaku pihak yang lemah. Perlindungan nasabah menjadi hal yang penting demi terciptanya hubungan antara bank dan nasabah yang sehat. Dalam hal ini, dibutuhkan pengaturan dan pengawasan yang ketat atas penyelenggaraan layanan internet banking, terutama yang terkait dengan perlindungan nasabah penggunanya. Pengaturan tersebut terwujud baik dalam bentuk perjanjian layanan internet banking antara bank dan nasabah maupun dalam bentuk berbagai peraturan yang secara tidak langsung mengatur mengenai internet banking terbitan pemerintah, sedangkan pengawasan dilakukan secara sinergis oleh Otoritas Jasa Keuangan dan Bank Indonesia. Selanjutnya, penulis menganalisis sejauh mana penerapan peraturan-peraturan tersebut pada sebuah kasus pembobolan rekening seorang nasabah pengguna layanan internet banking.
Berdasarkan hasil analisis penulis, bank belum menerapkan perlindungan nasabah secara maksimal. Di sisi lain, Otoritas Jasa Keuangan atau Bank Indonesia diharapkan segera mengeluarkan peraturan yang mengatur mengenai internet banking secara spesifik demi semakin terwujudnaya kepastian hukum. Tujuan dari penelitian ini adalah untuk mengkaji aspek perlindungan nasabah pengguna layanan internet banking berdasarkan peraturan perundang-undangan yang berlaku dan menganalisis penerapannya pada kasus. Dalam skripsi ini, penulis menggunakan metode penelitian yuridis normatif.

This thesis analyzes the legal protection for users of internet banking services as one of the breakthroughts for the banking world. On the other hand, the implementation of internet banking services can not be separated from various risks that ultimately can harm the user rsquo s customers as the weak party. Customer protection is important in order to create a healthy relationship between banks and customers. In this case, strict regulation and supervision of internet banking services, especially those that are related to the protection of it rsquo s customers, are needed. The regulations are realized both in the form of internet banking service agreements between banks and customers as well as in the form regulations that indirectly regulate internet banking publications, while supervision is conducted synergistically by Otoritas Jasa Keuangan and Bank Indonesia.
Furthermore, the authors analyzed the extent to which the application of these regulations in a case of account breaking of a customer using internet banking services. Based on the analysis, the bank has not implemented the customer protection throughoutly. On the other hand, Otoritas Jasa Keuangan and Bank Indonesia are expected to immediately issue regulations governing internet banking specifically for the realization of legal certainity. The purpose of this study is to examine the customer protection aspects of the internet banking service users based on applicable laws and regulations and analyze their application to the case. In this thesis, the authors use the normative juridical research method.

"Saat ini perkembangan teknologi dan Internet sangat pesat, semua hal menjadi lebih mudah. Salah satu sektor yang dipengaruhi oleh perkembangan teknologi informasi dan komunikasi adalah Perbankan, sebuah sub-sektor ekonomi yang memobilisasi dana publik. Dibalik kenyamanan yang diperoleh dari penggunaan Internet Banking, Ada juga risiko yang terdapat dalam penggunaan layanan ini, antara lain, banyak pelanggaran hukum mengenai data pribadi melalui Internet dan juga tentang risiko keuangan yang diderita oleh nasabah bank di penggunaan Internet Banking. Para penjahat IT menyebabkan industri perbankan harus menyiapkan fitur keamanan yang mampu menjaga tingkat kepercayaan publik bahwa transaksi elektronik tersebut aman. Kemudian hal ini menimbulkan sejumlah pertanyaan, yaitu bagaimana ketentuan dan undang-undang tentang Internet Banking di Indonesia, kemudian bagaimana Bank dapat bertanggung jawab dalam keamanan data dan informasi nasabah, dan bagaimana bank melindungi pelanggan ini ketika ada masalah saat menggunakan Internet Banking. Penelitian ini dilakukan dengan menggunakan metode penelitian normatif, dimana penelitian berbasis perpustakaan dilakukan dari bahan-bahan pada buku, jurnal, dan juga hukum dan peraturan, dan penelitian lapangan dengan melakukan wawancara pada pekerja Bank X. Dengan demikian terdapat berbagai bentuk perlindungan bagi pelanggan yang menggunakan layanan Internet Banking yang disediakan oleh bank, sedangkan dalam hal tanggung jawab bank sebagai penyedia layanan Internet Banking, pelanggan lebih meningkatkan kesadaran dan ketelitian dalam menggunakan layanan Internet Banking.

At the present the development of technology and the Internet has been very rapid, everything has been made easier. One sector that is affected by the development of information and communication technology is Banking, an economic sub-sector that mobilizes public funds. Behind the convenience obtained from the use of Internet Banking, there are also risks that can be used in the use of this service, among others, many violations of law regarding personal data via the Internet and also regarding financial risks suffered by bank customers in the use of Internet Banking The IT criminals cause the Banking industry to be able to prepare security features that are able to maintain the level of public confidence that electronic transactions are safe. Then this raises a number of questions, namely how the provisions and laws regarding Internet Banking in Indonesia, how a Bank can be responsible in the security of customer data and information, and how banks protect these customers when there are problems when using Internet Banking.This research is conducted by utilizing the normative research method, in which library based research is conducted from the materials on the books, journal, and also laws and regulations, and field research by conducting interview on Bank X worker. Thus there are various forms of protection for customers using Internet Banking services provided by banks, while in terms of bank responsibility as an Internet Banking service provider, the customer is more increased awareness and thoroughness in using Internet Banking services."

"Perkembangan teknologi berpengaruh terhadap keamanan pada sistem pembayaran di Indonesia. Kegiatan penatausahaan sumber dana berupa penerbitan kartu anjungan tunai mandiri dan kartu debit dari Penyedia Jasa Pembayaran (“PJP”) akan memunculkan kejahatan-kejahatan pada kartu dan mesin ATM. Secara keseluruhan dalam pelaksanaannya telah berjalan dengan baik, namun terdapat kendala seperti terjadinya kejahatan card trapping yang dialami oleh konsumen pengguna jasa pada putusan Nomor 149/Pdt.G/2021/PN DPs. Oleh karena itu, skripsi ini membahas mengenai perlindungan konsumen, dalam hal terjadinya card trapping pada mesin ATM. Bentuk penelitian pada skripsi ini adalah yuridis-normatif yang menelaah dan menganalisis ketentuan hukum serta bahan pustaka lainnya yang berhubungan dengan perlindungan konsumen dalam sistem pembayaran oleh penyelenggara yaitu Bank, dalam hal terjadinya card trapping. Dan tipologi penelitian ini menggunakan metode deskriptif, dengan mendeskripsikan pelaksanaan peraturan perundang-undangan untuk memecahkan sebuah masalah. Kesimpulan yang didapat atas penelitian skripsi ini adalah (1) pengaturan perlindungan konsumen pada alat pembayaran menggunakan kartu sebagai salah satu instrument pembayaran dari PJP terhadap card trapping adalah Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik beserta ketentuan pelaksanaannya, Peraturan Bank Indonesia (PBI) Nomor 22/23/PBI/2020 beserta ketentuan pelaksanannya, Peraturan Bank Indonesia (PBI) Nomor 23/6/PBI/2021 tentang PJP beserta ketentuan pelaksanaannya, PBI Nomor 16/1/PBI/2014 tentang Perlindungan Konsumen Jasa Sistem Pembayaran yang telah disempurnakan dengan PBI Nomor 22/20/PBI/2020 tentang Perlindungan Konsumen Bank Indonesia beserta ketentuan pelaksanaannya; dan (2) Implementasi pengaturan perlindungan konsumen terkait card trapping pada ATM yang diselenggarakan oleh Bank dan belum dilaksanakan dengan cukup baik. Dari hasil penelitian skripsi ini, penyelenggara perlu memberikan kepastian mengenai penanganan dan penyelesaian terhadap pengaduan nasabah agar penanganan sengketa antar Bank dengan Nasabah bisa diselesaikan dengan tercapainya kesepakatan antar kedua belah pihak.

Technological developments affect the security of the payment system in Indonesia. Administration of sources of funds in the form of issuing automated teller machines and debit cards from Payment Service Providers (“PSP”) will lead to crimes on cards and ATM machines. Overall, the implementation has gone well, but there are obstacles such as the occurrence of card trapping crimes experienced by consumer on the verdict Number 149/Pdt.G/2020/PN Dps. Therefore, this thesis discusses consumer protection in payment instruments using cards, in the event of card trapping at ATM machines. The form of research in this thesis is juridical-normative reviewing and analysing legal provisions and other library materials related to consumer protection in the payment system by the organizer, namely the Bank, in the event of card trapping. The conclusions obtained from this thesis research are (1) the regulation of consumer protection on payment instruments using cards as one of the payment instruments from PJP against card trapping is Law Number 11 of 2008 concerning Information and Electronic Transactions and their implementing provisions, Bank Indonesia Regulation (PBI) Number 22/23/PBI/2020 and their implementing provisions, Bank Indonesia Regulation (PBI) Number 23/6/PBI/2021 concerning PSP and their implementing provisions, PBI Number 16/1/PBI/2014 concerning Consumer Protection for Payment System Services has been refined by PBI Number 22/20/PBI/2020 concerning Bank Indonesia Consumer Protection and its implementing provisions; and (2) Implementation of consumer protection regulations related to Card trapping at ATMs held by the Bank and has not been implemented properly. From the results of this thesis research, the organizers need to provide certainty regarding the handling and settlement of customer complaints so that the handling of disputes between banks and customers can be resolved by reaching an agreement between the two parties."

"Skripsi ini membahas mengenai perlindungan hukum terhadap nasabah yang telah menutup nomor telepon seluler yang terkoneksi dengan layanan mobile banking atas pembobolan rekening bank miliknya dikarenakan tindakan pihak lain yang tidak bertanggung jawab. Perlindungan nasabah pengguna mobile banking memang menjadi suatu hal yang urgensi untuk dibahas mengingat pada era digitalisasi ini hampir setiap orang memiliki telepon seluler yang mana SIM card di dalamnya telah didaftarkan pada layanan perbankan, seperti halnya mobile banking. Tujuan awalnya memang untuk memudahkan nasabah dalam melakukan berbagai macam transaksi melalui telepon seluler, namun di sisi lain berpotensi timbulnya fraud di kemudian hari apabila ada kelalaian ataupun disalahgunakan pihak tertentu. Adapun ketika terjadi fraud mobile banking, baik bank maupun perusahaan telekomunikasi dimintakan pertanggungjawaban berupa ganti kerugian oleh nasabah. Namun demikian, ganti kerugian dari pihak bank dan perusahaan telekomunikasi tidak serta merta diberikan kepada nasabah apabila tidak terbukti kesalahannya. Dalam hal ini, nasabah juga dituntut untuk selalu menjaga data security rekeningnya (user ID, password, dan m-pin) agar tidak diketahui oleh pihak manapun. Begitu pula, ketika terdapat perubahan data nasabah (nomor telepon, alamat rumah, dan alamat e-mail) di kemudian hari, maka sudah sepatutnya nasabah menyampaikan kepada pihak bank. Sayangnya, hal-hal seperti itu masih kurang mendapat perhatian dari nasabah. Pada skripsi ini, penulis menganalisis sejauh mana penerapan peraturan perundang-undangan di Indonesia, Peraturan Bank Indonesia, dan Peraturan Otoritas Jasa Keuangan pada sebuah kasus pembobolan rekening mobile banking nasabah dimana nasabah yang bersangkutan merasa telah menutup nomor telepon seluler yang terkoneksi dengan rekening mobile banking miliknya.

This thesis discusses legal protection for customers who have terminated their cellular phone numbers linked to mobile banking services for actions to break into their bank accounts by unauthorized other parties. Protection of customers using mobile banking has indeed become an urgent matter to analyze considering that in this digitalization era, almost everyone has a cellular phone which has the SIM card been registered with banking services, such as mobile banking. The initial purpose of it was to make it easier for customers to carry out various kinds of transactions via cellular phones, but on the other hand, there is the potential fraud arising in the future if there is negligence or misuse by unauthorized parties. In the case of a mobile banking fraud occurs, both banks and telecommunications companies are asked to be held accountable in the form of compensation by the customer. However, the compensation from banks and telecommunications companies can only be given to customers if they are legally proven against the law. In this case, customers are also required to always maintain their account data security (user ID, password, and m-pin) so that they are not known and used by any unauthorized parties. Likewise, when there is a change in customer data (phone number, home address, and e-mail address) at a later date, it is an obligation for the customer to notify the bank. Unfortunately, for most customers, such things still went by unnoticed. In this thesis, the author analyzed the extent to which the application of laws and regulations in Indonesia, Bank Indonesia Regulations, and Financial Services Authority Regulations into a case of unauthorized breaking into a customer's mobile banking account where the customer in question felt that he had terminated the cellular phone numbers that connected to his mobile banking account."

"Pesatnya perkembangan teknologi informasi semakin membuat layanan internet banking populer di masyarakat. Dengan berdasarkan informasi-informasi yang diperoleh secara online, nasabah dapat memutuskan untuk melakukan transaksi dengan bank kapan dan di manapun konsumen menghendaki. Permasalahannya adalah apa saja standar yang digunakan serta objek dalam pelaksanaan legal audit terhadap layanan internet banking dan dampak yang timbul dari pelaksanaan legal audit internet banking ini terhadap perlindungan kepentingan bank, nasabah, dan pihak ketiga sebagai pihak terkait dalam layanan internet banking ini. Skripsi ini ditulis dengan menggunakan metode yuridis normatif yang mengutamakan studi kepustakaan. Penelitian ini bersifat kualitatif melalui kajian kepustakaan terhadap berbagai sumber hukum primer mencakup berbagai peraturan perundang-undangan serta data sekunder seperti pendapat para ahli, dan referensi terkait lainnya. Perlu diingat bahwa terdapat pula resiko-resiko yang melekat pada layanan internet banking, seperti resiko strategik, resiko reputasi, resiko operasional termasuk resiko keamanan dan resiko hukum, resiko kredit, resiko pasar dan resiko likuiditas. Oleh sebab itu, Bank Indonesia sebagai lembaga pengawas kegiatan perbankan di Indonesia mengeluarkan Peraturan Bank Indonesia No. 9/15/PBI/2007 agar setiap bank yang menggunakan Teknologi Informasi khususnya internet banking dapat meminimalisir resiko-resiko yang timbul sehubungan dengan kegiatan tersebut sehingga mendapatkan manfaat yang maksimal dari internet banking. Untuk memproteksi kepentingan bank dan nasabah maka legal audit merupakan proses hukum yang harus dilalui sebelum bank mengeluarkan produk layanan internet banking. Legal audit dalam internet banking merupakan proses penilaian atas fakta-fakta hukum yang relevan dengan bank, nasabah dan juga perangkat lunak (software) maupun perangkat keras (hardware). Legal audit yang didasarkan pada standar dan parameter tertentu akan menghasilkan suatu legal opinion tentang apakah produk layanan internet banking itu sah dan valid atau tidak. Di Indonesia, belum ada standar legal audit internet banking. Bank-bank yang menawarkan layanan internet banking memiliki standar legal audit-nya sendiri. Hal ini dapat dimaklumi karena belum memadainya Peraturan yang mengatur secara spesifik tentang legal audit internet banking. Akan tetapi, mengingat pentingnya suatu standar legal audit bagi perlindungan nasabah maka perlu mengacu pada peraturan yang relevan yakni Peraturan-peraturan yang dikeluarkan Bank Indonesia, Hukum perlindungan Konsumen, dan Undang-Undang Informasi dan Transaksi Elektronik.

The rapid development of information technology makes internet banking services more popular in the society. Based on the information from online research, the customer may decide to arrange transactions with bank whenever and wherever customers want. The problem is what standards and objects are used in the implementation of the legal audit of internet banking services and also what impacts that will arising from legal audit of internet banking implementation especially for protection of the interests of banks, customers, and third parties as related parties in the internet banking service. This thesis is written using normative methods that give priority to library research. This research is qualitative study of the literature of the various sources of primary law includes a variety of laws and regulations as well as secondary data such as expert opinions, and other related references. Therefore, Bank Indonesia as the only one banking supervisory agency in Indonesia issued Bank Indonesia Regulation PBI Number 9/15/PBI/2007 that each bank using internet banking in particular information technology to minimize the risks that arise in connection with these activities so all of the bank will get the maximum benefit from internet banking. To protect the interests of the bank and the customer then the legal audit is a legal process that must be passed before the bank can provides internet banking service products. Legal audit in internet banking is the process of assessment of the facts relevant to the bank's legal, customer and also the software or hardware. Legal audit is based on specific standards and parameters will produce a legal opinion on whether the product is legitimate internet banking services and is valid or not. In Indonesia, there is no standards for legal audit in Internet banking mechanism. The banks that offer internet banking services have a legal standard of auditing its only for themself. This may be due to inadequate governing regulations for the specifics of the legal audit in internet banking. However, given the importance of a legal audit standards for the protection of customers, it is necessary to refer to the relevant regulatory, such as rules that issued by Bank Indonesia, consumer protection laws, and the Law on Information and Electronic Transactions."

"ABSTRACT
Bank secrecy and customer personal data are the two things that cant be separated and must go hand in hand. The arising relationships that occurred between customers and banks are the contractual relationships that based on trust. The customer entrusts his money to the bank and or utilizes the bank's services if the customer knows that theres a guaranteed that the bank will not abusing the personal data of the customers. As a business actor, the bank should be responsible for maintaining the security of the customers personal data. In Indonesia itself, bank secrecy already had been regulated in Law No. 10 of 1998 concerning Banking. As for the research questions of this thesis are how is the legal protection of the personal data of customers in Indonesia related to the transparency of information on the use of bank products and analysis of the decisions that given by the judges related to the decision No: 434/PDT.G/2011/PN.JKT.Sel is already accordance with the Banking Law. The research method used is a normative juridical approach. The research resulted an information about the protection of personal data is that there is no specific law that regulated and related of personal data in Indonesia only about the personal data of the customer is set out in the banking secrecy of the Banking Law and regarding its implementation in the decision No. 434/PDT.G/2011/PN.JKT.Sel is already accordance with the Banking Law concerning bank secrecy. The Author suggested that it is recommended that the Indonesian government ratify the laws of personal data and each parties should further increases its awareness to maintain the security of personal data of banking customers.

ABSTRACT
Rahasia bank dan data pribadi nasabah adalah dua hal yang tidak bisa dipisahkan dan harus berjalan beriringan. Hubungan yang terjadi antara nasabah dengan bank adalah hubungan kontraktual yang berdasarkan kepercayaan. Nasabah memercayakan uangnya pada bank dan atau memanfaatkan jasa bank apabila mengetahui adanya jaminan bahwa bank tidak akan menyalahgunakan data pribadi nasabahnya. Sebagai pelaku usaha, pihak bank seharusnya bertanggung jawab dalam menjaga keamanan data pribadi nasabah. Di Indonesia sendiri mengenai rahasia bank sudah diatur dalam UU No. 10 Tahun 1998 tentang Perbankan. Adapun dengan demikian mengenai rumusan masalah dari penelitian ini adalah bagaimanakah perlindungan hukum dari data pribadi nasabah di Indonesia terkait dengan transparansi informasi penggunaan produk bank dan analisis mengenai putusan yang diberikan hakim terkait dengan Putusan No: 434/PDT.G/2011/PN.JKT.Sel sudah sesuai dengan UU Perbankan. Metode penelitian yang digunakan adalah pendekatan yuridis normatif. Alat pengumpulan data adalah data primer yaitu studi dokumen dan wawancara, sedangkan data sekunder dikumpulkan melalui studi kepustakaan. Hasil penelitian yang dilakukan adalah mengenai perlindungan data pribadi belum adanya Undang-undang khusus yang mengatur dan berkaitan dengan pemrosesan data pribadi hanya untuk mengenai data pribadi nasabah sudah diatur dalam rahasia bank UU Perbankan dan mengenai penerapannya dalam putusan no 434/PDT.G/2011/PN.JKT.Sel sudah sesuai dengan UU Perbankan mengenai rahasia bank. Disarankan agar pemerintah Indonesia mengesahkan mengenai undang-undang data pribadi dan masing-masing pihak lebih meningkatkan kesadarannya.

Masyarakat sering memanfaatkan jasa perbankan maka banyak hubungan yang
terjadi antara masyarakat dan bank dengan perjanjian tertulis atau tidak tertulis.
Namun nasabah atau calon nasabah tidak selalu memperhatikan klausula di dalam
perjanjian tersebut telah ditetapkan terlebih dahulu oleh Bank. UUPK telah
mengatur larangan penggunaan klausula tertentu di dalam perjanjian nasabah dan
bank, tapi dalam prakteknya terdapat Bank yang mencantumkan klausula baku
seperti melepas tanggungjawab atas kerugian yang dialami nasabah saat sedang
atau setelah memanfaatkan jasa perbankan. Bank tidak bisa berlindung dengan
perjanjian baku yang telah dibuat sebelumnya apabila klausula perjanjian tersebut
mencantumkan hal-hal yang dilarang untuk dicantumkan oleh UUPK.

whereas the clauses has already been provisioned by the bank. UUPK prohibits the usage
of such particular clause in the mentioned above agreement, in common practice, there
are banks that include prohibited clauses. One of the clause that is prohibited by UUPK
to be included in the bank-customer agreement is ?bank is not responsible for customer?s
loss while and/or after using the bank?s services?. In fact, Bank that cause loss to
customers has to be responsible for customer?s loss and can not protect itself using the
standard clauses that has been made before by the bank, if such clauses are prohibited by
