"Tesis ini membahas mengenai bagaimana implementasi Sertifikasi HAM Perikanan guna melindungi hak-hak pekerja pada usaha perikanan di Indonesia. Adapun beberapa lokasi penelitian yang dipilih untuk mengkaji dan menganalisis sejauh mana Sertifikasi HAM Perikanan telah diimplementasikan yakni di Pelabuhan Perikanan Samudera Belawan Medan, Pelabuhan Perikanan Nizam Zachman Jakarta, Pelabuhan Perikanan Pantai Tegalsari Tegal, dan Pelabuhan Benoa Bali. Oleh karena itu, metode penelitian yang digunakan dalam penulisan hukum tesis ini adalah normatif-empiris/normatif terapan (applied law research), yakni mengkaji pelaksanaan atau implementasi ketentuan hukum positif secara faktual pada peristiwa hukum tertentu yang terjadi dalam masyarakat guna mencapai tujuan yang telah ditentukan. Berdasarkan hasil penelitian, disimpulkan bahwa Sistem dan Sertifikasi HAM Perikanan belum diimplementasikan. Banyak hak-hak dasar pekerja/buruh maupun awak kapal perikanan/nelayan pada usaha perikanan yang belum dipenuhi. Berdasarkan kesimpulan, penulisan hukum tesis ini merekomendasikan beberapa hal terhadap para pemangku kepentingan maupun pihak-pihak terkait yakni segera dibentuknya tata kerja dari Tim HAM Perikanan, pemerintah perlu meratifikasi Konvensi ILO 188 tentang Pekerjaan dalam Penangkapan Ikan, perlu adanya koordinasi lintas kementerian untuk mengimplementasikan Sistem dan Sertifikasi HAM Perikanan, serta perlu adanya kerja sama baik secara bilateral maupun regional antara Pemerintah RI dengan negara bersahabat lainnya guna memberantas isu slavery at sea mengingat isu ini merupakan isu lintas batas negara.

This thesis focuses on how to implement Fisheries Human Rights Certification to protect workers’ rights in fisheries industries in Indonesia. The research locations selected to study and analyze the extent to which the Fisheries Human Rights Certification has been implemented are, among others, Belawan Oceanic Fishing Port (Medan), Nizam Zachman Fishing Port (Jakarta), Tegalsari Coastal Fishing Port (Tegal), and Benoa Port (Bali). Therefore, the research method used in thesis is normative-empirical/applied law research, which is to review the application or implementation of factually positive legal provisions on certain legal events occurring in the community in order to achieve predetermined goals. Based on the results of the study, it is concluded that the Fisheries Human Rights System and Certification have not been implemented. There are many basic rights of workers/laborers and crews of fishing boats/fishermen in fisheries sector which have not been fulfilled. Based on the conclusions, the thesis recommends a number of things to stakeholders and related parties such as immediate establishment of the Fisheries Human Rights Team’s work procedures, government’s ratification of ILO Convention 188 on Work in Fishing, the need for inter-ministerial coordination to implement the Fisheries Human Rights System and Certification and the need for bilateral and regional cooperation between Indonesian Government and other friendly States to eradicate the issue of slavery at sea considering that this is a cross-border issue."

"Dalam aktifitas perdagangan, baik berupa aktifitas ekspor/impor atau perdagangan domestik, kebutuhan akan proses sertifikasi merupakan suatu keharusan. Proses sertifikasi bertujuan untuk memberikan kepastian bahwa produk yang diperdagangkan sesuai dengan kriteria atau standar yang telah ditentukan sebelumnya. Kriteria atau standar tersebut dapat berupa informasi mengenai kualitas, kuantitas, dimensi atau informasi lain yang menjelaskan mengenai kondisi produk bersangkutan.
Permasalahan timbul ketika suatu perusahaan yang melakukan proses sertifikasi, dituntut untuk melakukan proses sertifikasi secara lebih cepat. Umumnya hal ini disebabkan karena perusahaan konsumen memberikan tenggat waktu (date line) kepada perusahaan produsen dalam memenuhi pesanannya. Sementara dipihak lain, karena keberadaan kendala tertemu, perusahaan produsen hanya dapat memenuhi pesanan dari perusahaan konsumen menjelang batas waktu yang telah ditentukan.
Untuk mempercepat proses sertifikasi yang sekarang berlaku, tentunya diperlukan suatu analisa yang bersifat logis dan sistematis terhadap proses sertifikasi tersebut. Dengan melakukan analisa tersebut, akan dihasilkan suatu perbaikan pada proses sertifikasi sekarang. Sehingga, pada akhirnya akan dihasilkan suatu proses sertifikasi yang lebih baik.
Pengembangan proses sertifikasi yang lebih baik dapat dilakukan dengan melakukan analisa terhadap proses sertifikasi sekarang menggunakan metode sembilan pendekatan analisa operasi utama (the nine primary Operation analysis approaches) dan metode SMED (Single Minute Exchange of Dies).
Analisa ini hanya dimungkinkan jika keseluruhan data dan informasi seputar pross sertifikasi sekarang, telah terkumpul dan tersusun secara sistematis. Untuk melakukan pengumpulan dan penyusunan data dan informasi tentang proses sertifi kasi sekarang dapat dilakukan dengan menggunakan alat bantu (room) berupa diagram alir (flow chart) dan diagram proses (process chart)."

"A professional teacher is a yearned - for personnel in terms of creating qualified human resource for the Indonesian development. The government accomplished the yearning by the program of teacher certification that is aimed at specifying teacher appropriateness to become a teaching agent , increasing the quality of education success and teachers status, promote teachers professionalism and properity. In order to get a certificate the teacher has to possess academic qualification at least of bachelor or fourth diploma degree and has competency to realize the national education goal. In order to get the certificate the teacher has to pass the certification test as shown by various documents in the set of portfolio. Many people are skeptical towards the certification accomplishment because of the practices of corruption activities for the purpose of obtaining a piece of magical certificate that should be used to get the increase of teacher quality and income. This article is to spotlight numerous difficulties and barriers faced by the teachers in fulfilling the demand of portfolio so that the teacher certificate could become an aspiration that would be accomplished or on the contrary it would be nothing other than a dream because of the impossibility to fulfill the certification demands."

"Penelitian ini dilakukan dengan metode studi kualitatif deskriptif, dengan tujuan untuk melihat Analisa Langkah-Iangkah Pencapaian Sertifikasi ISO 14001 Klinik PT MONAGRO KIMIA dan kliniknya pada tahun 1998" di Kawasan industri Manis, Desa Jatake, Kecamatan Jatiuwung, Tangerang. Dalam Kesimpulan yang didapat ditemukan bahwa secara umum Klinik PTMK ini sudah melakukan langkah-langkah yang dalam upaya pencapaian standar Prosedur ISO 14001 sehingga dapt memenuhi kebutuhan kelengkapan sertifikasi 1SO14001. Disarankan bagi Klinik ini agar terus melakukan perbaikan berkelanjutan, termasuk bila perlu melengkapi personel pada manajer Sumber Daya Manusianya untuk membuat program ini menjadi tujuan menyeluruh ke seluruh cabang di bagian negara Indonesia lainnya dan dapat dijadikan bahan referensi bagi Klinik kecil pelayanan kesehatan yang mau punya perjanjian kepedulian terhadap kuatitas dan perduli terhadap lingkungan dimana dia berada.

Analysis Certification Step Program On Iso 14001 in PT Monagro Kimia And The Clinic, Kecamatan Jatiuwung Kabupaten Tangerang On The Year 1998This research survey is made by doing the methodology of a Descriptive Qualitative Study with some informants to gather the data for the purpose of "Analyzing the general steps preparation procedures for achieving the certification for ISO 14001 in 1998", Which is held in the scope of an American Corporate for Agro Chemical Industries PT MONAGRO KIMIA (MONSANTO INDONESIA) Clinic, at Manis industrial Estate, Jatake Village, Jatiuwung, Tangerang. As the Summary comes it is well proven that the Clinic of PT MONAGRO KIMIA has done a committed management programs in general in order to meet the Certifications Standard Procedures as it is suitable for the Total Quality Management and Environment friendly company. For more advisory matters this would made the Clinic to do even better for doing the continuous improvement, including needs to re-organize the Plant HR manager vacancy if necessary, for making this program as continuous goals throughout this nation for all regional areas in Indonesia, and can be made as reference materials by other small Clinics who serves medical care and committed to have a quality service, and friendly to the environment where it stands.

Skripsi ini membahas mengenai pengadopsian konsep bisnis dan hak asasi manusia yang diatur di dalam United Nations Guiding Principles on Business and Human Rights ke dalam Peraturan Menteri kelautan dan Perikanan No. 35/PERMEN-KP/2015 tentang Sistem dan Sertifikasi Hak Asasi Manusia pada Usaha Perikanan. Rumusan masalah yang akan dibahas adalah bagaimana konsep United Nations Guiding Principles on Business and Human Rights menentukan penerapan hak asasi manusia dalam bisnis, bagaimana konsep United Nations Guiding Principles on Business and Human Rights diatur menurut Peraturan Menteri Kelautan dan Perikanan No. 35/PERMEN-KP/2015 tentang Sistem dan Sertifikasi Hak Asasi Manusia pada Usaha Perikanan, dan apakah Peraturan Menteri Kelautan dan Perikanan No. 35/PERMEN-KP/2015 tentang Sistem dan Sertifikasi Hak Asasi Manusia pada Usaha Perikanan sudah cukup mengadopsi konsep bisnis dan hak asasi manusia yang diatur dalam United Nations Guiding Principles on Business and Human Rights. Skripsi ini disusun dengan metode penulisan hukum normatif. Hasil penelitian menyimpulkan bahwa pengadopsian konsep dari United Nations Guiding Principles on Business and Human Rights ke dalam Peraturan Menteri Kelautan dan Perikanan No. 35/PERMEN-KP/2015 tentang Sistem dan Sertifikasi Hak Asasi Manusia pada Usaha Perikanan dilihat dari penerapan tiga pilar utama yaitu protect, respect, remedy, yang beguna untuk memastikan adanya penghormatan terhadap hak asasi manusia yang dilakukan oleh perusahaan perikanan.

ABSTRACT
This thesis discusses the adoption of business and human rights concepts as set within the UNGP BHR to the Minister of Maritime Affairs and Fisheries Regulation No. 35 PERMEN KP 2015 on Human Rights System and Certification in Fishery Business. The formulation of the issues to be discussed is how the concepts of the UNGP BHR determine the application of human rights in business, how the concepts of the UNGP BHR are governed by the Minister of Maritime Affairs and Fisheries Regulation No. 35 PERMEN KP 2015 on Human Rights System and Certification in Fishery Business, and whether Minister of Maritime Affairs and Fisheries Regulation No. 35 PERMEN KP 2015 concerning Human Rights System and Certification in Fishery Enterprises has sufficiently adopted the business and human rights concepts set forth in the UNGP BHR. This thesis is prepared by normative legal writing method. The results conclude that the adoption of the concept of the UNGP BHR into the Minister of Maritime Affairs and Fisheries Regulation No. 35 PERMEN KP 2015 on Human Rights System and Certification on Fishery Business is seen from the implementation of three main pillars namely protect, respect, remedy, which are useful to ensure deference of human rights committed by fisheries corporation."

Tesis ini membahas implementasi kebijakan sertifikasi guru pada SMA Negeri di
Kecamatan Indramayu Kabupaten Indramayu dan faktor-faktor yang
mempengaruhinya yaitu Komunikasi, Sumber daya, Sikap para pelaksana, Stuktur
Birokrasi organisasi pelaksana, dan Lingkungan sosial ekonomi. Penelitian ini
merupakan penelitian kualitatif dengan desain deskriptif. Hasil penelitian
menyarankan bahwa pihak-pihak yang terkait dalam implementasi kebijakan perlu
lebih peduli pada kelengkapan dan kejelasan dari isi kebijakan sertifikasi guru;
guru perlu memahami maksud dan tujuan sertifikasi sebagai upaya reformasi
pendidikan dengan menjadikan guru sebagai suatu jabatan profesi; perlunya
perencanaan yang matang, koordinasi dan kinerja yang baik dari para pelaksana
yang menangani penyelenggaraan sertifikasi guru.

Abstract
The research explained the implementation of certification policy and factors that
influences of it such as Communication, Resource, Attitude or Disposition,
Structure Organization, and Social Economic. The result of the research suggest
that the stakeholders in implementing the policy should be more focus on clearity
of the policy. The teacher need to understand the purpose of teacher certification
as educational reform; accurate planning, coordinating, and good performance
need to be set in implementing the policy of teacher certification."

"Idealnya, semua hotel di Indonesia telah disertifikasi sesuai standar hotel yang diberlakukan pemerintah sesuai amanah UU. Nyatanya 74,04% hotel belum tersertifikasi. Kondisi tersebut dapat merugikan konsumen/wisatawan karena tidak ada jaminan produk yang ditawarkan hotel berkualitas sesuai standar. Merancang peta jalan bagi para pemangku kepentingan (regulator, pemerintah daerah, lembaga penilaian kesesuaian, asosiasi) merupakan tujuan penelitian ini sebagai upaya mendorong pertumbuhan sertifikasi hotel di Indonesia. Penggunaan pertanyaan terbuka sebagai dasar wawancara dengan para pakar di dalam metode fenomenografi berhasil menetapkan 32 isu. Berdasarkan perhitungan geomean, 23 dari 32 isu tersebut dianggap mempengaruhi pertumbuhan sertifikasi hotel. Lalu, isu tersebut digunakan untuk merancang peta jalan. Selanjutnya, peta jalan prioritas ditentukan menggunakan metode perbandingan berpasangan. Studi ini menetapkan 6 dari 24 rancangan, yakni kaji ulang regulasi, evaluasi penerapan oleh Pemerintah Pusat, pembinaan bagi para pelaku usaha hotel oleh Pemerintah Daerah, pengembangan standar baru, sosialisasi dan pelatihan bagi LSUP, dan pemberian insentif fasilitas bimbingan teknis penerapan standar bagi pelaku usaha hotel yang komitmen. Meski demikian peta jalan lainnya tetap dijalankan secara simultan.

Ideally, all hotels in Indonesia have been certified according to hotel standards imposed by the government by the law's mandate. In fact, 74.04% of hotels have not been certified. This condition can be detrimental to consumers/tourists because there is no guarantee that the products offered by the hotel are of quality according to standards. Designing a roadmap for stakeholders (regulators, local governments, conformity assessment bodies, associations) is the aim of this research to encourage the growth of hotel certification in Indonesia. Using open-ended questions as the basis for interviews with experts in the phenomenography method succeeded in establishing 32 issues. Based on geomean calculations, 23 of the 32 issues are considered to affect the growth of hotel certification. Then these issues are used to design a roadmap. Furthermore, priority roadmaps were determined using the pairwise comparison method. They defined 6 of the 24 designs, namely regulatory review, implementation evaluation by the Central Government, guidance for hotel business actors by local governments, development of new standards, socialization and training for LSUPs, and providing incentives such as technical guidance facilities for the application of standards for committed hotel business actors. However, other roadmaps are still being conducted simultaneously."

"Usaha mikro, kecil, dan menengah (UMKM) merupakan pilar perekonomian nasional. UMKM memberikan kontribusi terhadap penyerapan tenaga kerja, pemerataan pendapatan, dan wadah sosial ekonomi masyarakat. Namun, jumlah UMKM yang sudah mendapatkan sertifikasi Standar Nasional Indonesia (SNI) produk masih rendah. Oleh karena itu, penelitian ini bertujuan untuk menentukan tantangan sertifikasi SNI produk pada UMKM untuk meningkatkan minat sertifikasi SNI produk pada UMKM, mengetahui manfaat sertifikasi SNI produk pada UMKM yang telah mendapatkan sertifikasi SNI produk, dan mengetahui faktor–faktor yang memiliki hubungan signifikan antara manfaat sertifikasi SNI produk dengan lamanya implementasi sertifikasi SNI produk pada UMKM. Metode penelitian yang digunakan yaitu pembobotan tantangan sertifikasi SNI produk dengan Analytical Hierarchy Process (AHP) dan fuzzy–AHP, serta analisis manfaat sertifikasi SNI produk dengan menggunakan korelasi Spearman. Hasil dari penelitian ini adalah diperolehnya tantangan sertifikasi SNI produk yaitu kurangnya Lembaga Penilaian Kesesuaian (LSPro dan laboratorium uji) yang diakreditasi oleh pemerintah untuk mendorong UMKM mendapatkan sertifikasi SNI produk. Hasil hubungan signifikansi antara manfaat sertifikasi SNI produk dengan lamanya implementasi sertifikasi SNI produk pada UMKM yaitu terdapat hubungan yang signifikan antar variabel lama sertifikasi SNI pada UMKM dengan peningkatan keuntungan, peningkatan kualitas produk, peningkatan penjualan, dan peningkatan efisiensi kinerja.

Micro, small, and medium enterprises (MSMEs) are the pillars of the national economy. However, the number of MSMEs that have obtained SNI product certification is still low. Therefore, this study aims to determine the challenges of SNI product certification to MSMEs, to find out the benefits of SNI product certification to MSMEs, and to determine factors that have a significant relationship between the benefits of product certification implementation. The research method used is weighting the challenges of SNI product certification with Analytical Hierarchy Process (AHP) and fuzzy–AHP, as well as analysis of the benefits of SNI product certification using the Spearman correlation. The result of this research is to obtain the challenge of SNI certification for products, namely the lack of Conformity Assessment Bodies (product certification bodies and test laboratories) which are government-accredited to encourage MSMEs to obtain SNI product certification. Meanwhile, the result of the significant relationship between the benefits of SNI product certification and the length of implementation of the SNI product certification at MSMEs are the variables of the length of implementation certification with increased profits, increased product quality, increased sales, and increased performance efficiency."

sekolah, kepala sekolah, Unit Pelaksana Dinas Kecamatan Sekampung Udik, dan juga guru sekolah dasar negeri di Kecamatan Sekampung Udik. Teknik pengumpulan data yang digunakan adalah wawancara dan studi dokumentasi. Hasil peneltian ini menunjukkan bahwa implementasi kebijakan sertifikasi guru sekolah dasar negeri di Kecamatan Sekampung Udik Kabupaten Lampung Timur Tahun 2014 telah memenuhi sembilan indikator dari unsur implementasi kebijakan publik model Merille S Grindle walaupun belum sempurna. Variabel lingkungan implementasi (cntext of implementation) merupakan
unsur yang paling lemah dalam pelaksanaan kebijakan sertifikasi guru. Peningkatan koordinasi merupakan solusi alternatif untuk permasalah pelaksanaan kebijakan sertifikasi guru di Kecamatan Sekampung Udik.

Research object are employees of Education And Culture Department Lampung Province, Youth Education And Sport Department East Lampung Regency, LPMP East Lampung's Employees, LPTK Administrator Area 107 Lampung University, school superintendent, head master, service, UPDT Sekampung Udik Sub District, and elementary school?s teachers in Sekampung Udik Subdistrict. Data collection method in this research are interview and documentation study. Research result show that implementation of teacher certification policy in Sekampung Udik sub district, East Lampung regency in 2014 has been for qualified nine indicator from public policy's Implementation element Merille'S Grindle's model although it is not perfect yet. This research using post positivis approach by qualitative method with case study model.
Research object are employees of Education And Culture Department Lampung Province, Youth
Education And Sport Department East Lampung Regency, LPMP East Lampung’s Employees,
LPTK Administrator Area 107 Lampung University, school superintendent, head master, service,
UPDT Sekampung Udik Sub District, and elementary school’s teachers in Sekampung Udik
Subdistrict. Data collection method in this research are interview and documentation study.
Research result show that implementation of teacher certification policy in Sekampung Udik sub
district, East Lampung regency in 2014 has been for qualified nine indicator from public policy’s
Implementation element Merille S Grindle’smodel although it is not perfect yet.
Environmental implementation variable (context of implementation) is the weaknest element in
teacher’s policy implementation. Strengthen the coordination is an alternative solution for
teachers certification policy’s problem in Sekampung Udik sub district.]

"Penelitian ini menganalisis implementasi penerbitan sertifikasi profesi bagi anggota Subdit Regident Ditlantas Polda Metro Jaya. Tingginya jumlah pelayanan penerbitan Surat Ijin Mengemudi (SIM), Surat Tanda Nomor Kendaraan (STNK), dan Buku Pemilik Kendaraan Bermotor (BPKB) tidak sebanding dengan personil yang telah memiliki sertifikat kompetensi, yaitu hanya 58 personil dari 1370 personil Subdit Regident Ditlantas PMJ sehingga berpengaruh terhadap kualitas pelayanan yang diberikan. Proses penerbitan sertifikasi profesi tersebut tidak mudah, karena ada beberapa kendala yang dihadapi antara lain: terbatasnya jumlah asesor yang dimiliki Lembaga Sertifikasi Profesi Polri, adanya pembatasan jumlah peserta sertifikasi profesi dalam setiap uji kompetensi maksimal sebanyak 100 (seratus) orang, kerjasama antar satuan kerja yang terbatas, belum tersedia sarana prasarana tempat uji kompetensi (TUK), maupun metode uji kompetensi yang terdiri dari wawancara dan praktek belum maksimal menggali pengetahuan dan keterampilan peserta uji kompetensi. Permasalahan diatas akan dianalisis menggunakan teori manajemen SDM, konsep manajemen organisasi, teori kerjasama, teori implementasi dan teori kebijakan.
Metode penelitian yang digunakan dalam penelitian ini adalah metode kualitatif-deskriptif. Pendekatan kualitatif digunakan sebagai strategi penelitian dalam memahami, mengkonstruksi dan menyikapi permasalahan terkait implementasi penerbitan sertifikasi profesi dalam meningkatkan kinerja anggota Subdit Regident Ditlantas Polda Metro Jaya khususnya bidang pelayanan penerbitan SIM, STNK dan BPKB. Temuan penelitian terhadap permasalahan diatas adalah tidak sebanding jumlah anggota yang dinyatakan kompeten dengan jumlah pelayanan yang diberikan, terbatasnya jumlah peserta yang dapat mengikuti sertifikasi profesi, minimnya jumlah asesor yang dimiliki LSP Polri, tidak tersedianya tempat uji kompetensi yang memadai, dan terbatasnya kerjasama antara LSP Polri, Korlantas Polri dan Ditlantas Polda Metro Jaya.

This study analyzes the implementation of the issuance of professional certification for members of the Regional Police Headquarters of the Jakarta Police. The high number of services for issuing a drivers license (SIM), vehicle registration number (STNK), and Motor Vehicle Ownership Book (BPKB) is not comparable to personnel who already have competency certificates, namely only 58 personnel from 1370 Regident Ditlantas PMJ personnel, so influential the quality of services provided. The process of issuing professional certification is not easy, because there are several obstacles faced, among others: the limited number of assessors possessed by the National Professional Certification Agency, the limitation of the number of professional certification participants in each competency test to a maximum of 100 (one hundred) personnel, infrastructure facilities where the competency test (TUK) are not available, or the competency test method consisting of interviews and practice has not maximally explored the knowledge and skills of competency test participants. The above problems will be analyzed using HR management theory, organizational management concepts, collaboration theory, implementation theory and policy theory.
The research method used in this study is a qualitative-descriptive method. The qualitative approach is used as a research strategy in understanding, constructing and responding the problems related to implementation of publishing professional certification in improving performance of members of the Regident Sub Directorate, Traffic Directorate of Metro Jaya Regional Police, especially in the field of SIM, STNK and BPKB publishing services. The research findings on the above problems are not comparable to the number of members who are declared competent with the number of services provided, the limited number of participants who can take professional certification, the minimum number of assessors possessed by LSP Polri, unavailability of adequate competency test places, and the limited collaboration between LSP Polri, Indonesian National Traffic Police and Traffic Directorate of Metro Jaya Regional Police.
