"Pecandu Narkotika yang tidak terlibat dalam peredaran gelap narkotika berdasarkan hasil asesmen harus diberi tindakan rehabilitasi. Rehabilitasi dapat dilakukan secara sukarela atau secara wajib, sesuai dengan kondisi Pecandu Narkotika yang melaporkan diri/dilaporkan oleh keluarganya atau yang ditangkap/tertangkap tangan. Rehabilitasi dapat dilakukan di Institusi Penerima Wajib Lapor (IPWL) dengan diadakan rangkaian Asesmen Terpadu Narkotika. Tindakan tersebut sebagai wujud dari upaya depenalisasi perkara Pecandu Narkotika. Namun, terhadapnya masih terdapat permasalahan dari aspek perundang-undangan yang menaunginya, serta aspek implementasinya. Penelitian ini bersifat yuridis normatif dengan menelaah peraturan perundang-undangan, studi kepustakaan, dan dilengkapi dengan wawancara narasumber. Hasil penelitian mengungkap bahwa peraturan perundang-undangan yang berlaku masih belum ideal memberikan keadilan bagi Pecandu Narkotika yang tidak terlibat peredaran narkotika. Fungsi dari IPWL dan pelaksanaan proses Asesmen Terpadu Narkotika tidak berjalan optimal. Padahal keduanya merupakan hal yang penting dalam memberikan upaya depenalisasi bagi perkara Pecandu Narkotika berupa rehabilitasi. Oleh karena itu, payung hukum harus dibenahi agar keadilan dapat tercapai. Fungsi serta peran IPWL dan proses Asesmen Terpadu Narkotika harus diperkuat, sehingga dapat berjalan dengan sebagaimana mestinya.

Narcotics addict involving in the drug or narcotics trafficking based on the results of the assessment must be treated with rehabilitation measures. Rehabilitation can be carried out either by voluntarily or compulsorily, according to the condition of the Narcotics Addict whether reporting himself and or is reported by family or those who are caught. Rehabilitation can be carried out at the Report Obligatory Recipient Institution (IPWL) by holding a series of Integrated Narcotics Assessment. This action is a form of efforts to depenalize Narcotics Addict case. However, there are still some problems regarding to the aspect of legislation that covers it, as well as aspects of its implementation.This research is a normative juridical study by examining statutory regulations, literature study, and thus completed with interviewing sources. The results reveal that prevailing laws and regulations are still not ideal to provide justice for Narcotics addicts who are not involved in narcotics or drug trafficking. The function of the IPWL and the implementation of the Integrated Narcotics Assessment process have not run optimally. Though, both are important things in providing depenalization efforts for the Narcotics Addict case in the form of rehabilitation. Therefore, the legal law must be addressed in order to achieved justice. The functions and roles of IPWL and the Integrated Narcotics Assessment process must be strengthened to emable them run properly."

"Tesis ini membahas tentang evaluasi program rehabilitasi sosial bagi pecandu dan korban penyalahguna NAPZA oleh IPWL Kementerian Sosial di DKI Jakarta. Pendekatan penelitian yang digunakan ialah mix-methods research dengan penekanan pada evaluasi berorietasi tujuan. Hasil penelitian menunjukkan bahwa pelaksanaan program rehabilitasi sosial bagi pecandu dan korban penyalahguna NAPZA oleh IPWL Kementerian Sosial di DKI Jakarta tidak berjalan sesuai dengan tujuan. Kenyataan itu terjadi karena adanya instrumen penilaian program yang berbeda dengan pedoman rehabilitasi sosial yang dibuat oleh Kementerian Sosial dan juga dukungan Kementerian Sosial yang belum maksimal. Oleh karena itu, Kementerian Sosial harus memberikan dukungan yang maksimal. Dukungan tersebut tidak hanya dalam bentuk sarana dan prasarana atau pendanaan, tetapi juga pedoman atau petujuk teknis program yang jelas dan konsisten antara konten yang satu dengan konten yang lainnya.

This thesis discusses about the Implementation of social rehabilitation programs for addicts and victims of drug abuse by IPWL of Ministry of Social Affairs in Jakarta. The study used a mix methods research with emphasis on goal oriented evaluation. The results showed that the implementation of social rehabilitation programs for addicts and victims of drug abuse by IPWL of Ministry of Social Affairs in Jakarta is not conducted as the aims. It is happened because of the different assessment instrument program with the program theory and also support of Social Affairs is not maximized. Therefore, the Ministry of Social Affairs should give maximum support, not only in the form of infrastructure or funding, but also the guiding or technical guidelines of program clearly and consistently between the content and the other content."

"Skripsi ini membahas tentang pelaksanaan IPWL mengenai program wajib lapor berdasarkan Peraturan Pemerintah Nomor 25 Tahun 2011 di Lembaga Komunitas “X” Kota Depok. Disahkannya program wajib lapor dan menggandeng lembaga-lembaga terpilih sebagai pelaksana IPWL, merupakan sebuah wujud upaya pemerintah dalam mengatasi tingginya kasus penyalahgunaan narkotika di Indonesia serta bertujuan memberikan wadah bagi pecandu narkotika memperoleh haknya untuk sembuh melalui rehabilitasi (dalam penelitian ini rehabilitasi sosial). Tujuan penelitian ini adalah menganalisis pelaksanaan IPWL yang diselenggarakan di Lembaga Komunitas “X” Depok. Penelitian ini adalah penelitian kualitatif dengan desain deskriptif. Hasil penelitian ini menunjukkan pelaksanaan program wajib lapor di IPWL Lembaga Komunitas “X” Depok, melaksanakan tugas sebagai IPWL dengan SOP yang telah dibuat dan dikembangkannya sesuai pedoman Kementerian. Terdapat beberapa perbedaan dalam pelaksanaannya dengan Peraturan Pemerintah Nomor 25 Tahun 2011 yaitu tidak terdapat tenaga psikolog dan tenaga pekerja sosial secara langsung saat pelaksanaan, melainkan hanya pada saat rapat koordinasi dan workshop. IPWL Lembaga Komunitas “X” melaksanakan rehabilitasi sosial dengan metode “12 langkah” yang diterapkan dalam kehidupan sehari-hari dan juga dikemas kedalam kegiatan sharing feeling. Lembaga Komunitas “X memiliki sumberdaya yang memadai serta struktur organisasi yang jelas. Di sisi lain, terdapat hambatan dalam pencairan dana/gaji oleh pemerintah bagi para tenaga pelaksana tetap IPWL Lembaga Komunitas “X” Depok yang perlu menjadi perhatian khusus dan evaluasi bagi pemerintah. Kemudian jam buka operasional Lembaga Komunitas “X” sebagai IPWL terlalu siang yaitu pukul 10.00 WIB, menyebabkan klien rawat jalan yang berstatus pekerja khususnya bekerja dengan sistem shift, mengalami kendala untuk melakukan konseling rutin mingguan. Wajib menjadi poin penting bagi IPWL Lembaga Komunitas “X” Depok untuk memperbaiki kebijakannya dan lebih memperhatikan hak klien rawat jalan.

This research is review about the implementation of IPWL on the ‘Compulsory Reporting Program’ based on Government Regulation Number 25 of 2011 in the “X” Community Institution in Depok. The existence of a “Compulsory Reporting Program” by the government in collaboration with attempt by the government to reduce the high number of cases of drug abuse in Indonesia, and aims to provide a forum forn narcotics addicts to get their right to recover through rehabilitation, in this research, is social rehabilitation. The purpose of this research is to analyze the implementation of ‘compulsory reporting’ held at “X” Community Institution as IPWL. This research is a qualitative research with a descriptive design. The result of this research, it was found that the implementation of the “Compulsory Report Program” in Community Institutions “X” runs IPWL using a Standard Operating Procedure that has been developed according to the guidelines given by the government. There are several differences in it’s application with government regulation number 25 of 2011. The difference is that there are no psychologists and social workers during the inplementation, but only gathering during coordination meetings and workshops. The Community Institution “X” carries out sosial rehabilitation using the “12 steps” method which is applied in daily and also packaged into “Sharing Feeling” activities, there are has adequate resource and a clear organizational structure. However, there were still barriers to disbursement of funds (salary/incentive) by the government for the implementers of ‘Compulsory Reporting Program’, it must be a concern and evaluation for the government. Another barriers is, the Community Institution “X” has operating hours at 10.00 am. This causes difficulties for outpatient clients who are workers and have a shift system in their work to come for counseling with coucelor at IPWL of “X” Community Institution. Must be an important point for IPWL to improve their policies about the operating hours, and pay more attention to the rights of outpatient clients.

"Rendahnya pemanfaatan layanan rehabiltasi rawat jalan secara sukarela di Klinik IPWL BNN setiap tahun terutama dalam 3 tahun terakhir sangat berdampak pada masih tingginya prevalensi angka penyalah guna narkotika di Indonesia. Sesuai dengan teori Andersen (1974), faktor penyebab perilaku pemanfaatan layanan kesehatan terdiri dari 3 yaitu faktor predisposing, enabling dan reinforcing. Penelitian ini hanya fokus terhadap faktor reinforcing yaitu dukungan keluarga terhadap pemanfaatan layanan rehabilitasi rawat jalan sukarela di Klinik IPWL BNN. Tujuan untuk menggali informasi secara mendalam tentang faktor dukungan keluarga terhadap pemanfaatan layanan rehabilitasi di Klinik IPWL BNN. Penelitian ini menggunakan metode kualitatif dengan pengumpulan data melalui wawancara dan diskusi kelompok terarah. Berdasarkan hasil penelitian diperoleh hasil bahwa rendahnya pemanfaatan layanan rehabilitasi di klinik IPWL BNN disebabkan faktor kurangnya pengetahuan keluarga tentang bagaimana melakukan deteksi dini dan upaya intervensi terhadap anggota keluarga yang mulai terlibat penyalahgunaan narkotika sebelum keluarga membawa ke layanan rehabilitasi. Masih tingginya stigma dimasyarakat juga menjadi penyebab keluarga malu untuk membawa klien ke layanan, hubungan komunikasi antara keluarga kurang baik. Kurangnya sosialiasi program layanan rehabilitasi dan perlunya model intervensi dan regulasi tentang keterlibatan keluarga dalam rehabilitasi. Progam sosialisasi melalui media massa TV, radio, surat kabar, media sosial, majalah sangat efektif membantu penyebaran informasi deteksi dini penyalahguna narkotika di lingkungan keluarga serta upaya rehabilitasi bagi pecandu narkotika. Kemudian untuk mengatasi tingginya stigma terhadap pecandu narkotika dimasyarakat perlu adanya bentuk layanan rehabilitasi yang melibatkan masyarakat (rehabilitasi berbasis masyarakat).

The low utilization of voluntary outpatient rehabilitation services at the BNN Voluntary Clinic every year, especially in the last 3 years has a significant impact on the high prevalence of narcotics abusers in Indonesia. In accordance with Andersens theory (1974), the causes of health service utilization behavior consisted of 3 factors: predisposing, enabling and reinforcing. This study only focused on reinforcing factors, namely family support for the utilization of voluntary outpatient rehabilitation services at the BNN Voluntary Clinic. The purpose of this study is to explore information about the factors of family support for the utilization of rehabilitation services at the BNN Voluntary Clinic. This study uses qualitative methods by collecting data through interviews and focus group discussions. Based on the results of the study, it was found that the low utilization of rehabilitation services at the BNN IPWL clinic was due to a lack of family knowledge about how to conduct early detection and intervention efforts through rehabilitation of family members who were involved in narcotics abuse before family access to rehabilitation centre. The stigma in the community is also a cause of shame for families to bring clients to services, communication links between poor families. Lack of socialization of rehabilitation service programs and the need for intervention models and regulations regarding family involvement in rehabilitation. Socialization programs through mass media such as television, radio, newspapers, social media, and magazines are very effective in helping disseminate information on early detection of narcotics abusers in the family environment and rehabilitation efforts for narcotics addicts. Then to overcome the high stigma against narcotics, the community it self needs to be empowered in a form of comprehensive rehabilitation program (community based rehabilitation)."

"Penelitian dalam tesis ini berfokus pada dasar dasar dibentuknya aturan wajib lapor bagi penyalah guna narkotika dilihat dari perspektif ketahanan nasional. Penanganan masalah narkotika selama ini kurang memperhatikan hak penyalah guna akan aspek kesehatan untuk selanjutnya mendapatkan akses rehabilitasi. Program wajib lapor pecandu narkotika yang diatur dalam Peraturan Pemerintah no 25 tahun 2011, merupakan turunan dari Undang undang 35 tahun 2009 tentang narkotika mengatur tentang kewajiban pecandu narkotika untuk melaporkan diri untuk mendapatkan rehabilitasi. Salah satu tujuan dari program ini adalah upaya dekriminalisasi terhadap penyalah guna narkotika agar penatalaksanaannya secara hukum dapat dibedakan dengan pengedar maupun bandar. Desain yang digunakan adalah kualitatif deskriptif dengan metode wawancara dan pengamatan, menunjukkan kondisi pelaksanaan program wajib lapor dengan berbagai hambatan dalam pelaksanaannya.

The research in this thesis focuses on the basic foundation of the formulation of reporting rules for narcotics abuse seen from the perspective of national resilience. So far, management of substance abuse has been addressing less consideration over the patient 39 s health related right and further had access to rehabilitation. The mandatory reporting program for narcotics addicts set forth in Government Regulation No. 25 of 2011, is derived from Law 35 of 2009 on narcotics governing the duty of narcotics addicts to report themselves for rehabilitation.One of the objectives of the program is the decriminalization of narcotics abusers so that their management can be legally distinguished from dealers and dealers. The design used is qualitative descriptive with the method of interview and observation, indicating the condition of program implementation must report with various obstacles in its implementation."

"This study aims to describe the society perception towards the existence of Mandatory Reporting Recipient Institution. This research uses a qualitative approach with descriptive analysis technique. Data collection was conducted by spreading out questionnaires to the community, social institution and the organizer of the institution. The location and respondents of the research were determinated purposively, that is in Medan City, Sumatera Utara Province.Respondents were consisted of 60 people who lived around the 6 IPWL regions and one was from Social Department officer and also one chairman or management of IPWL each from six IPWLs. The data and information collected were analyzed descriptively qualitatively. The result of the research showed that 80 percent of respondents had not understood the IPWL existence yet. This was because of the lack of program socialization on IPWL to the community. It isrecommended to the Indonesian Republic Ministry of Social to socialize the tasks, roles and functions of IPWL as a rehabilitation managing institution for drugs users to the community widely through social service bodies, social media both press and electronic ones."

The research was meant to know the ability of must-report Institution (IPWL), Nazar Foundation In rehabilitating drug abuse victims. The research Is explorative using qualitative approach, location and respondent chosen purposively In Medan, North Sumatera Province. Data resources were IPWL ofticIaI. Data were gathered through Interview, observation, and analyzed through qualitative descriptive technique. The finding showed that the Institution, Nezar foundation, has been able to rehabilitate drug abuse 40 persons per year before receiving aId from the ministry of social affairs, then 60 people after receiving aid. The rehabilitation ability was supported by adequate facilities and rooms, human resources psychologist, addicted on counce or, human resource (social worker), and operational expenses. But, there was still Iimited In fund and management. It Is recommended to the Ministry of Social Affairs through Directorate of Drug Abuses PreventIon so that keep on giving aid and human resources. Local social agency should be Involved In rehabilitation drug abuse vIctIms at IPWL Nazar. Drug abuse rehabilitation institution pointed as IPWL should be more keenly on the reel condItIon of the clients as regulated."

"Pengawasan ketenagakerjaan merupakan salah satu fungsi dari pemerintah yang cukup krusial. Selain untuk mendukung proses penegakan hukum, hal ini juga dilakukan untuk menjaga keseimbangan iklim industrial antara tenaga kerja dengan suatu perusahaan. Maka dari itu, pemerintah melalui Kemnaker RI meluncurkan layanan WLKP online guna mendukung efektivitas pengawasan ketenagakerjaan oleh pemerintah. Namun, layanan WLKP dihadapi kendala yang menghambat proses pengawasan ketenagakerjaan. Maka dari itu, penelitian ini bertujuan untuk menganalisis efektivitas layanan WLKP melalui konsep perspektif efektivitas melalui pendekatan teori sistem oleh Gibson et al (2011). Metode yang digunakan dalam penelitian ini adalah post-positivist yang didukung dengan data primer melalui wawancara mendalam dan sekunder melalui studi kepustakaan. Hasil penelitian menunjukkan layanan WLKP sebagai upaya mewujudkan penyelenggaraan pengawasan ketenagakerjaan yang sistematis dan terintegrasi masih belum efektif dikarenakan kendala yang ditemukan. Dari 8 indikator dengan 3 dimensi, terdapat 3 indikator yang belum terpenuhi diantaranya keterbatasan anggaran guna mendukung pengembangan sistem WLKP dan diseminasi informasi terkait layanan WLKP melalui sosialisasi, proses pengawasan yang terhambat akibat kendala integrasi data antar isntansi, sinergi strategi teknis serta krisis kebijakan yang berdampak pada hasil pengawasan yang kurang optimal yang ditunjukan dengan kasus pelanggaran norma ketenagakerjaan yang masih tinggi. Sehingga dinilai perlu untuk meninjau bagaimana WLKP bekerja dalam mensinergikan strategi dari masing-masing pihak terlibat di dalamnya agar pengawasan ketenagakerjaan yang optimal dapat terwujud.

Labor inspection is one of the crucial functions of the government. In addition to supporting the law enforcement process, this is also done to maintain the balance of the industrial relations between labor and a company. Therefore, the government through the Ministry of Manpower of the Republic of Indonesia launched the online WLKP service to support the effectiveness of labor inspection by the government. However, WLKP services face obstacles that hinder the labor inspection process. Therefore, this study aims to analyze the effectiveness of WLKP services through the concept of effectiveness perspective through a systems theory approach by Gibson et al (2011). The method used in this study is post-positivist supported with primary data through in-depth interviews and secondary through literature studies. The results showed WLKP services as an effort to realize the implementation of systematic and integrated labor inspection is still not effective due to the obstacles found. From 8 indicators with 3 dimensions, there are 3 indicators that are unfulfilled including budget constraints to support the development of the WLKP system and dissemination of information related to WLKP services through socialization, the monitoring process is hampered due to data integration constraints between agencies, technical strategy synergies and policy crises that have an impact on the results of supervision that are less than optimal as indicated by cases of violations of labor norms which are still high. So, it is considered necessary to review how WLKP works in synergizing the strategies of each party are involved in it so that optimal labor supervision can be realized."

"Penanganan yang tepat bagi pecandu narkotika merupakan pembahasan yang seakan tidak pernah tuntas untuk dibicarakan, baik dalam perdebatan akademik maupun pada pelaksanaan suatu proses peradilan pidana. Seringkali tarik-menarik antara pendekatan kriminal melalui pelaksanaan instrumen pidana dengan pendekatan kesehatan melalui rehabilitasi tidak menemui titik keseimbangannya. Hal tersebut disebabkan oleh pendekatan kriminal yang masih mendominasi terlebih dengan adanya dukungan otoritas yang diberikan melalui kewenangan penegak hukum.
Tak dapat disangkal bahwa peredaran gelap dan penyalahgunaan narkotika merupakan masalah serius dan membutuhkan penanganan yang khusus. Salah satunya adalah dengan menciptakan dan memperkuat regulasi, baik dalam skala nasional maupun internasional. Melalui penguatan regulasi tersebut turut juga diberikan perluasan kewenangan kepada aparat penegak hukum. Kewenangan tersebut pada tataran ideal seharusnya sejalan dengan kebijakan yang tepat dalam memandang pecandu narkotika. Pecandu narkotika merupakan pelaku kejahatan. Pola pikir demikian tidak hanya akrab ditemukan dalam interaksi di masyarakat umum namun juga melanda aparat penegak hukum bahkan pengadilan. Apabila diamati lebih dalam, antara pecandu narkotika dan pelaku tindak pidana narkotika terdapat perbedaan secara prinsipil. Pecandu narkotika justru merupakan korban dari penyalahgunaan narkotika. Urgensi diadakannya pembedaan adalah agar penanganan perlakuan kepada pecandu narkotika tepat sasaran. Sehingga pada jangka panjang, tidak hanya menghasilkan pemulihan bagi pecandu namun juga sebagai strategi dalam penanggulangan penyalahgunaan narkotika.
Di sisi lain, ketidakcakapan dalam melakukan pembedaan ini berimbas cukup besar kepada penanganan tindakan dan perlakuan terhadap pecandu narkotika. Terutama apabila pecandu narkotika berhadapan dengan hukum. Status yang disandang pecandu narkotika sebagai pelaku tindak kejahatan seringkali berujung pada tindakan berupa pemenjaraan bukan pemulihan. Pecandu narkotika yang merupakan korban dari penyalahgunaan narkotika menjadi korban kembali (re-victimization), baik korban dalam proses hukum maupun korban dalam stigma negatif secara sosial.
Pelaksanaan suatu proses peradilan pidana bagi pecandu narkotika dalam praktik memberikan penegasan terhadap dominasi pendekatan pidana tersebut. Pola pemidanaan berupa penjara masih cenderung diterapkan baik oleh penuntut umum dalam dakwaan dan tuntutan serta hakim dalam putusan.
