"International Human Rights Protection, addressed to judges and lawyers, diplomats and civil servants, researchers and students, is based on the author's personal research and personal involvement with a wide range of subjects, such as the basic concepts of civil and social rights, discrimination and affirmative action, issues of procedure and jurisdiction and issues such as the death penalty and the protection of refugees, minorities and victims of armed conflicts. At the universal level, the book introduces the reader to the labyrinth of United Nations Charter-based and treaty-based procedures. As well as an overview of the Inter-American and African systems, it deals at the regional level particularly with the case law of the European Court of Human Rights in Strasbourg, and also looks at the national level at the case law of the US Supreme Court and the South African Constitutional Court. This book adopts a particularly critical approach to the so-called dynamic" interpretation of the European Convention on Human Rights by the Court of Strasbourg. It is the author's feeling that judges in particular those belonging to courts specialising in human rights have a tendency to systematically support interpretations benefitting the applicants while overlooking too easily the far-reaching implications of judgments for society as a whole. He prefers a more balanced and more realistic approach taking into account the difficulties democratic governments face in coping with the challenges of our present time and with the pressing needs of the realities of today's world. Marc Bossuyt has not only a vast academic experience as Professor of International Law (at the University of Antwerp), as Visiting Professor in universities in Africa America and Asia and as a researcher in the field of International Human Rights Protection. "Perang Dunia II telah menggoreskan sejarah buruk terkait perlindungan komunitas internasional terhadap hak asasi manusia (HAM). Sejak saat itu masyarakat internasional melalui PBB memberikan perhatian lebih kepada masalah HAM dengan membentuk Komisi HAM di bawah Dewan Ekonomi dan Sosial PBB. Sejak saat itu, berbagai lembaga HAM internasional serta di berbagai kawasan seperti Amerika, Eropa, dan Afrika didirikan. Namun Asia sebagai kawasan dengan kepadatan penduduk tertinggi di dunia tidak kunjung mendirikan mekanisme regional tersebut hingga akhirnya pada tahun 2009 AICHR berdiri sebagai lembaga HAM regional di Asia Tenggara. Setelah hampir tiga tahun sejak AICHR berdiri terdapat banyak masalah dan tantangan yang dihadapi oleh Komisi tersebut. Dengan demikian penting untuk mengetahui bagaimanakah peran lembaga-lembaga HAM internasional dan regional sebagaimana mekanisme HAM di dunia, kedudukan AICHR sebagai lembaga HAM di Asia Tenggara, serta tantangan-tantangan yang dihadapi AICHR dalam menjalankan tugas dan fungsinya sebagai lembaga HAM regional di Asia Tenggara. Permasalahanpermasalahan tersebut akan dijawab melalui penelitian yuridis-normatif sehingga diperoleh simpulan bahwa lembaga-lembaga HAM internasional dan regional berperan penting dalam pemonitoran, pemajuan, serta perlindungan HAM di dunia dan regional. Selain itu dapat diketahui juga bahwa AICHR merupakan badan HAM di Asia Tenggara yang bersifat intergovernmental yang menghadapi banyak tantangan, baik yang berasal dari internal ASEAN maupun dari AICHR sebagai lembaga.

At first, human rights matter was given low concerns until it took the catalyst of World War II to propel it into the international conscience. Then the United Nations started the development of human rights through the creation of the UN Commission on Human Rights under the Economic and Social Council. From that point, many international human rights bodies and even regional systems were established like in America, Europe and Africa. This leaves Asia as the only region without such mechanism until in 2009 ASEAN inaugurated AICHR as the South East Asia?s human rights body. After almost three years of existence, this Commission has been facing many issues and challenges. Thus it is important to know about the role of international and regional human rights body, AICHR?s position as a regional human rights body in ASEAN, and the challenges that AICHR faces in exercising its functions as a regional human rights body in South East Asia. These problems will be answered through a juridical-normative research until it can be concluded that international and regional human rights bodies play an important role in the monitoring, promotion, and protection of human rights in the world and regions. Furthermore it can be informed that AICHR is a South East Asian?s human rights body with an intergovernmental characteristic that still faces many challenges coming both from the internal of ASEAN and from its shortcomings as an organization."

"The law on human rights court has brought the new hopes for certain people have suffered because of the human rights violation happened in the past government (before the law enacted in the years of 2000). The demand for justice does not only focus on human rights violations, which occurred in the past but also similar human rights violations that will occur in the future. The existence of a permanent Human Rights Court seems to imply that human rights will be upheld and protected. The resolution of past human rights violations through extra-judicial organizations is an advanced step towards resolving the case, whereas a conflict approach can be used to settle the case. The existence of the Human Rights Law provides a new frontier in implementing the principle of restorative justice in the approach of case settlement. It is hoped that such restorative justice can create a political balance between the past and the future.

Undang-undang tentang Pengadilan HAM telah membawa harapan baru bagi orang-orang tertentu yang menderita karena pelanggaran hak asasi manusia yang terjadi dalam pemerintahan masa lalu (sebelum hukum diberlakukan pada tahun 2000). Tuntutan keadilan tidak hanya fokus pada pelanggaran hak asasi manusia yang terjadi di masa lalu, tetapi juga pada pelanggaran HAM serupa yang akan terjadi di masa depan. Keberadaan Pengadilan HAM permanen tampaknya menyiratkan bahwa hak asasi manusia akan dijunjung tinggi dan dilindungi. Resolusi pelanggaran HAM masa lalu melalui organisasi ekstra-yudisial merupakan langkah maju menuju penyelesaian kasus ini, sedangkan pendekatan konflik dapat digunakan untuk menyelesaikan kasus ini. Keberadaan UU Hak Asasi Manusia memberikan sebuah perbatasan baru dalam melaksanakan prinsip keadilan restoratif dalam pendekatan penyelesaian kasus. Diharapkan bahwa keadilan restoratif tersebut dapat menciptakan keseimbangan politik antara masa lalu dan masa depan."

"ABSTRAK
Skripsi ini bertujuan untuk mendeskripsikan validitas data statistik kriminal terkait pelanggaran hak atas kebebasan beragama dan berkeyakinan di Indonesia. Penelitian ini bermula pada popularitas penggunaan statistik dalam penelitian kriminologi di samping banyaknya permasalahan yang juga telah menjadi problematika umum. Angka gelap, misalnya, telah menjadi karakteristik dari statistik kriminal, selain itu terdapat permasalahan kejahatan yang diketahui polisi dan tekanan organisasi dalam melakukan pencatatan terhadap suatu kejadian. Kekurangan-kekurangan tersebut menjadi akar keraguan bagi para kriminologis terkait validasi data statistik kriminal yang berasal dari pranata resmi. Akan tetapi, tidak hanya pranata resmi seperti kepolisian yang membuat dan menyajikan data statistik. Maraknya kasus-kasus yang berkaitan dengan agama dalam beberapa tahun terakhir juga menggerakkan beberapa instansi untuk menyusun dan menerbitkan data statistik terkait situasi hak atas kebebasan beragama dan berkeyakinan. Dengan menggunakan prinsip-prinsip statistik kriminal dari Gwynn Nettler, peneliti akan membandingkan data statistik dari Kepolisian RI, Komnas HAM dan SETARA Institute tahun 2015-2016 untuk dapat menjelaskan validitas kedua data yang digunakan. Hasil temuan menunjukkan bahwa terdapat konsistensi yang ditunjukkan pada metodologi yang digunakan pada kedua data. Namun ketiadaan pedoman dalam membuat klasifikasi dan definisi terhadap masing-masing bentuk pelanggaran hak atas kebebasan beragama dan berkeyakinan menjadi isu yang melubangi kualitas data.

ABSTRACT
This research purposes to describe the validity of criminal statistics related to religious rights offences in Indonesia. It began with the common use of statistical methods in many criminological research alongside its large number of issues. Dark figure of crime, for example, has become characteristic of criminal statistics, also crime known to the police and organizational pressure on incidents recording. Those deficiencies turned into causes of doubt for criminologist related to its validity, while came from official institutions. However it wasnt only governmental institutions who had created and published such data. The rise of cases relating to religion and belief in recent years also drives several organization to collect and publish statistics criminal of religious rights condition. By using the criminal statistics principles from Gwynn Nettler, researcher would compare the statistical data of The Indonesian National Police, National Commission of Human Rights and SETARA Institute about religious rights offences in 2015-2016 to be able to explain the validity of this data. The findings then indicate that there is consistency on both methods, so the validity of criminal statistics from both institutions is acceptable. Nonetheless, the lack of guidelines in making the classification and definitions against each offences of religious rights could be an issue which can damage data quality. "
