Abstrak :
[Tesis ini membahas tentang merek yang “telah menjadi milik umum” dan merek yang “merupakan keterangan atau berkaitan dengan barang atau jasa yang dimohonkan pendaftarannya” sebagaimana Pasal 5 huruf c dan huruf d Undang-Undang No. 15 Tahun 2001 tentang Merek, serta bagaimana keterkaitan antara keduanya. Hasil penelitian ini menjelaskan adanya kesalahpahaman lembaga pengadilan mengenai merek-merek yang dianggap telah menjadi milik umum, atau menghubungkannya dengan merek yang dianggap “merupakan keterangan atau berkaitan dengan barang atau jasa yang dimohonkan pendaftarannya;The Thesis discusses about the mark which is having become public property and is constituting information or related to the goods or services for which registration is requested as on Article 5 Letter c and letter d Law Num. 15 Year 2001 Regarding with Trademark, and relation between them.
