This paper will assess the progress and challenges of the peace agreement between the Government of Indonesian and Free Aceh Movement (MoU Helsinki) post the enactment of the Law on Aceh Government 11/2006 (LAG), particularly on the vulnerability status of MoU both in national and international legal system. Using normative approach and analysing data from local, national and international sources to describe the recent implementation of MoU. It confirms that after eleven years security and political aspect has been demonstrated, while economic and human rights-related issues remain left behind. Therefore this paper argues that the legalization of MoU in the international procedural system will ensure the compliance of agreement, and strengthen sustainable peace in Aceh-Indonesia context."

"Penelitian ini membahas mengenai kesepakatan perdamaian sebagai alternatif penyelesaian sengketa antarpersero dalam sebuah perseroan terbatas. Notaris bertindak sebagai pelayan masyarakat yaitu pejabat yang diangkat oleh pemerintah yang memperoleh kewenangan secara atributif dari negara untuk melayani kebutuhan masyarakat dalam hubungan hukum yang terjadi antara mereka yang digunakan sebagai alat bukti akan dokumen-dokumen legal yang sah yang memiliki kekuatan pembuktian yang sempurna. Dalam pelayanannya, Notaris terikat pada peraturan jabatan dan kode etik profesi sebagai notaris. Undang-Undang Jabatan Notaris menetapkan kewenangan, kewajiban, larangan, serta ketentuan-ketentuan yang harus dipatuhi oleh tiap-tiap notaris dalam menjalankan tugas dan jabatannya yang berfungsi sebagai "kaidah hukum". Sementara Kode Etik Notaris memuat hal-hal baik dan buruk serta sanksi-sanksi yang dapat dikenakan jika ada yang melakukan pelanggaran, berfungsi sebagai "kaidah moral" bagi praktik kenotariatan di Indonesia. Metode pendekatan yang digunakan adalah yuridis normatif karena menekankan pada penggunaan data sekunder atau berupa norma hukum tertulis. Metode analisa data secara kualitatif sehingga bentuk hasil penelitian ini berbentuk eksplanatoris analitis.
Hasil penelitian menunjukkan bahwa penyelesaian sengketa bisnis melalui jalan pengadilan dianggap kurang menguntungkan bagi pelaku bisnis sebab selain mahal, prosesnya panjang, dan berbelit-belit. Wewenang utama dari notaris adalah membuat akta otentik. Kesepakatan perdamaian secara tertulis dapat dibuat di hadapan notaris sehingga menjadi akta otentik. Oleh karena itu, kesepakatan perdamaian memiliki tiga kekuatan pembuktian seperti halnya akta otentik, yaitu pembuktian formil, pembuktian materiil, dan pembuktian lahir atau keluar. Kesepakatan perdamaian yang merupakan alat bukti tertulis, memberikan sumbangan nyata dalam alternatif penyelesaian sengketa secara hemat waktu dan biaya.

Research discuss about peace agreement as an alternative dispute resolution between the parties of company. Public Notary as public servant functioned as official legally appointed by the government for attributive authority of the state to serve the public in their legal associations to be used as an evidence of legal documents which attain as a perfect evidence. The Law No. 30 of 2004 concerning Notary determine the authority, duties, prohibitions as well as other stipulations to be observed by each public notary in performing their duty and post and function as "principles of law" for the notary, while the Code of Ethics for Public Notary which contain the decent and adverse issues as well as sanctions imposed to violation on the code functioned as "moral principles" for notaries practice in Indonesia. Approaching method use normative juridical because of emphasizing secondary data that is written law norm. Data analyze method is qualitative, so that the format of research result is analytical explanatory.
Research result show that dispute resolution for business dispute through litigation process has less benefit. Business people consider that litigation way needs high cost, long process, and complicated. The main authority of notary is creating authentic document. Peace agreement in writing can be made by the presence of notary, thus becomes authentic document. Therefore a peace agreement has three strength of evidence that is formal, material, and outer. Peace agreement is such a written evidence that giving real contribution in alternative dispute resolution because it is cost-effective and saving time."

"Putusan No. 89 PK/TUN/2008 yang berkekuatan hukum tetap telah memenangkan Susuna Dewi dan menyatakan batal Sertipikat HPL No. 1/Kuningan Barat, Sertipikat HGB No. B.119/Kuningan Barat, dan Sertipikat HGB No. 198/Kuningan Barat serta Surat Keputusan Pemberian Hak yang bersangkutan. Namun, pembatalannya tidak dilaksanakan oleh Badan Pertanahan Nasional (BPN) karena adanya perdamaian di antara para pihak yang tertuang dalam Akta Perdamaian Tanggal 21 Desember 2011 Nomor 117 (Akta Notaris). Pokok permasalahan yang dibahas adalah mengenai kekuatan hukum Sertipikat dan Surat Keputusan Pemberian Hak tersebut ditinjau dari mekanisme eksekusi otomatis dalam Pasal 116 ayat (2) Undang-Undang Nomor 5 Tahun 1986 tentang Peradilan Tata Usaha Negara serta implikasi hukum dari Akta Perdamaian Nomor 117 terhadap Putusan No. 89 PK/TUN/2008. Metode penelitian yang digunakan adalah yuridis normatif dan menggunakan tipelogi deskriptif untuk membahas objek penelitian dari sudut pandang hukum dan peraturan perundang-undangan yang berlaku. Hasil penelitian ini menunjukkan bahwa Sertipikat dan Surat Keputusan Pemberian Hak yang telah dinyatakan batal tersebut tidak memiliki kekuatan hukum secara administrasi. Sedangkan, hak atas tanah yang lahir daripadanya yang bersifat keperdataan tidak hapus. Akta Perdamaian Nomor 117 yang mengesampingkan Putusan No. 89 PK/TUN/2008 dapat dilakukan karena substansi dari keduanya serupa, yaitu untuk melindungi kepentingan hukum Susuna Dewi yang telah dirugikan. Akan tetapi, Akta Perdamaian Nomor 117 tidak menghilangkan kewajiban BPN untuk membatalkan Sertipikat dan Surat Keputusan Pemberian Hak yang bersangkutan serta jalannya perdamaian hanya didasarkan pada itikad baik para pihak karena tidak dikukuhkan dalam Putusan Perdamaian.

Decision No. 89 PK/TUN/2008, which has a permanent legal force, has won Susuna Dewi and has cancelled HPL Certificate No. 1/Kuningan Barat, HGB Certificate No. B.119/Kuningan Barat, and HGB Certificate No. 198/Kuningan Barat and the related Decree on the Granting of Rights. However, the cancellation was not carried out by the National Land Agency (BPN) because of the peace between the parties as stated in the Peace Deed dated 21 December 2011 Number 117 (Notary Deed). The main issues discussed were regarding the legal power of the Certificate and Decree on the Granting of Rights in terms of the automatic execution mechanism in Article 116 paragraph (2) of Law Number 5 Year 1986 regarding State Administrative Courts as well as the legal implications of the Peace Deed Number 117 on Decision No. 89 PK/TUN/2008. The research method used is juridical normative and uses descriptive typology to discuss the object of research from the point of view of laws and regulations in effect. The results of this study indicate that the Certificate and the Decision to Grant the Rights which have been declared null and void have no administrative legal force. Meanwhile, land rights that are born thereof which are civil in nature are not deleted. Peace Deed Number 117 which overrides Decision No. 89 PK/TUN/2008 can be implemented because the substance of the two is similar, namely to protect the legal interests of Susuna Dewi which have been violated. However, the Peace Deed No. 117 does not eliminate the obligation of BPN to cancel the Certificate and Decision to Grant the Rights concerned and the peace is only based on the good faith of the parties because it is not reinforced in a Conciliatory Decision."
