Abstrak :
Seiring dengan teknologi, informasi dan komunikasi yang semakin modern, muncul fenomena baru yaitu cyberbullying sebagai dampak negatif atas perkembangan tersebut. Sifat tanpa-batas dan anonimitas dalam dunia maya seakan menjadi faktor yang tidak bisa terhindarkan dalam mendukung cyberbullying. Dalam skripsi ini, penulis melihat faktor lain dengan asumsi bahwa semakin positif interaksi dalam peer group dan semakin rendah pengalaman bullying serta pengetahuan siswa tentang peraturan sekolah terkait kekerasan maka semakin rendah perilaku cyberbullyingnya. Unit analisis penelitian ini adalah individu yaitu siswa Sekolah Menengah Atas di Jakarta. Data penelitian diperoleh dari hasil survei kuisioner terhadap 336 responden. Hasilnya menunjukkan bahwa diantara ketiga variabel yang digunakan, interaksi dalam peer group menjadi variabel yang paling berpengaruh terhadap perilaku cyberbullying siswa. Hal ini menunjukkan bahwa teman sebaya melalui interaksinya memiliki pengaruh yang cukup kuat dalam mendukung perilaku cyberbullying siswa. ...... Along with the information and communication technology which are increasingly modern, emerging new phenomenon called cyberbullying as a negative impact on those development. Limitlessness and anonymity in cyberspace become factors that can’t be avoided in favor of cyberbullying. In this thesis, the authors examines other factors related to cyberbullying under the assumption that positive interaction within peer group, also lower level of bullying experiences and student’s knowledge about school’s regulations related to violence contributed to lower lever of student’s cyberbullying behavior. The unit of analysis of this study is high school students in Jakarta. Datas were obtained from the results of questionnaire survey towards 336 respondents. The results show that among three variables used, the interaction within peer group becomes the most influential variables on student’s cyberbullying behavior. This statement shows that peer group through their interaction fairly strongly affected student’s cyberbullying behavior.

Penelitian ini bertujuan untuk mengetahui hubungan antara persepsi siswi tentang budaya dan peraturan sekolah dengan tingkat religiositas para siswi di Sekolah Menengah Atas Negeri studi SMAN 1 Padang Panjang dan SMAN 2 Padang Panjang Budaya sekolah yang digunakan dalam penelitian ini dari konsep Deal dan Peterson 1999 yaitu visi misi dan nilai sekolah ritual dan perayaan sekolah dan terakhir arsitektur dan artifak sekolah Selanjutnya dari aspek peraturan sekolah peneliti melihat dari bagaimana pandangan para siswi terhadap aturan tata tertib sekolah yang memasukkan unsur keagamaan didalamnya serta bagaiaman para siswi mengimplementasikan peraturan sekolah yang ada Sedangkan untuk aspek religiositas akan mengacu pada konsep religiositas yang diutarakan oleh Glock dan Stark 1974 yaitu terdiri dari 1 religious belief 2 religious experience 3 relgious knowledge 4 religious consequence dan 5 religious practice Pendekatan penelitian ini adalah kuantitatif eksplanatif Di mana subjek penelitiannya adalah siswi kelas XI SMAN Kota Padang Panjang Sampel yang diambil menggunakan metode simple random sampling Pada penelitian ini dapat disimpulkan bahwa terdapat hubungan yang positif antara budaya sekolah dan peraturan sekolah dalam mempengaruhi tingkat religiositas para pelajarnya Namun di antara kedua variabel tersebut variabel peraturan sekolah memiliki kecenderungan kekuatan yang lebih tinggi dibandingkan dengan variabel budaya sekolah.

Tesis ini ini menyoroti proses berlangsungnya program PPMK dalam upaya meningkatkan kesejahteraan masyarakat melalui tiga bina; bina sosial, bina ekonomi, dan bina lingkungan fisik. Untuk itu pertanyaan penelitian yang diajukan adalah : (1) Bagaimana proses pengelolaan PPMK pada ketiga programnya dalam mewujudkan tujuannya?; dan (2) Sejauh mana peran program PPMK dalam upaya meningkatkan kesejahteraan masyarakat?. Penelitian ini dilakukan pada Program Pemberdayaan Masyarakat kelurahan (PPMK) Kelurahan Malaka Jaya, Duren Sawit, Jakarta Timur. Pendekatan yang digunakan adalah kualitatif dengan metode studi kasus. Hasil penelitian ini menunjukkan bahwa perubahan kelembagaan yang diiringi dengan pembagian program PPMK tidak serta merta membuat bisa memberdayakan masyarakat secara maksimal. Perubahan tersebut pada satu sisi meningkatkan akuntabilitas PPMK terhadap pemerintah, namun disisi lain perubahan ini justru memperburuk sinergi program yang kemudian mempengaruhi efektifitas dalam rangka mempercepat peningkatan kesejahteraan masyarakat kelurahan. Pembangunan masyarakat dalam PPMK dapat dimasukkan dalam pendekatan pembangunan dengan masyarakat (development with community). Aktor utamanya adalah aktor luar dengan masyarakat, bentuk hubungan berupa kolaborasi, pengambil keputusan oleh masyarakat lokal dengan aktor luar, pelaksana. Masyarakat lokal dan bentuk kegiatan berupa proyek dan program. Selain itu, Satuan komunitas PPMK yang berada di tingkat Kelurahan belum bisa menampung kepentingan seluruh lapisan masyarakat perkotaan. Peningkatan kesejahteraan masyarakat pun baru berada pada tingkatan individual, belum mencapai kesejahteraan komunitas secara luas. PPMK dijalankan dengan pengetahuan lokal dan klaim profesionalisme tidak nampak dalam kepengurusan LMK. Untuk menjadi anggota LMK tidak diperlukan keahlian khusus, melainkan lebih bersifat politis. Dalam studi ini juga disampaikan implikasi-implikasi praktis dan teoritik dari hasil penelitian ini beserta kesimpulan-kesimpulan pokok dan rekomendasi. ...... This thesis highlights on the ongoing process PPMK program in an effort to improve the welfare of the community through “tiga bina”; bina sosial, bisna ekonomi, bina lingkungan fisik. For that the research questions posed were: (1) How does the management of the third PPMK program in achieving its purpose?, And (2) The extent to which the role PPMK program in an effort to improve the welfare of society? The research was conducted at the Community Empowerment village (PPMK) Malaka Jaya Village, Duren Sawit, East Jakarta (PPMK) Malaka Jaya, Duren Sawit, East Jakarta. The approach used is a qualitative case study method. The results of this study indicate that the institutional changes that accompanied the division of program PPMK not necessarily making can empower the community to the fullest. Such changes on the one hand PPMK increase accountability of the government, but on the other hand these changes actually make synergy which then affects the effectiveness of the program in order to accelerate the increase in welfare villages. Community Development in PPMK can be included in the development with community approach. The main actors are actors outside the community, form relationships in the form of collaboration, decision-making by local communities and external actors, implementers: Local communities and forms of activity in the form of projects and programs. In addition, the Unit of community in PPMK located at the Village can not accommodate the interests of all segments of urban society. Increased welfare was only at the individual level, not the community at large to achieve prosperity. PPMK run with local knowledge and professionalism claim does not appear in the management of LMK. To become a member of LMK does not require special skills, but more political. In this study also presented and the practical implications of the theoretical results of this study and its principal conclusions and recommendations.

ABSTRAK
Tesis ini membahas mengenai partisipasi relawan didalam PNPM Mandiri Perkotaan. Partisipasi merupakan konsep sentral didalam pemberdayaan masyarakat yang dipandang sebagai proses dan tujuan (as means to ends). Tinggi rendahnya partisipasi masyarakat didalam pemberdayaan berimplikasi terhadap demokrasi dan implementasi HAM didalam program. Berdasarkan kajian literatur dan pemetaan teoretis diduga terdapat empat variabel independen yang berhubungan dengan variabel dependen tingkat partisipasi relawan didalam PNPM Mandiri Perkotaan. Keempat variabel independen tersebut antara lain : Gaya Kepemimpinan Partisipatif KSM (X1), Peningkatan Kapasitas KSM (X2), Pendampingan KSM oleh Fasilitator (X3) dan Alokasi Pendanaan KSM (X4).

Tujuan dari penelitian ini adalah untuk menguji hipotesis serta derajat keeratan hubungan dari keempat variabel independen (X1-X4) terhadap variabel dependen (Y). Tesis ini menggunakan metode kuantitatif dengan teknik penelitian survey serta didukung oleh wawancara. Sampel penelitian dipilih secara total dari populasi (total sampling) dari seluruh KSM Fisik yang ada di Kecamatan Pesanggrahan. Uji statistik menggunakan pearson correlation dengan terlebih dahulu dilakukan uji validitas, reliabilitas, normalitas, outlier dan linearitas.

Hasil pengujian menunjukan, hubungan variabel gaya kepemimpinan partisipatif KSM signifikan (sig = 0.035) terhadap tingkat partisipasi dengan derajat keeratan Rendah (0.210). Variabel peningkatan kapasitas KSM signifikan (sig = 0.01) terhadap tingkat partisipasi dengan derajat keeratan Rendah (0.314). Variabel pendampingan KSM oleh fasilitator signifikan (sig = 0.000) terhadap tingkat partisipasi dengan derajat keeratan Tinggi (0.772). Sedangkan variabel alokasi pendanaan BLM tidak signifikan (sig = 0.157) terhadap tingkat partisipasi dengan derajat keeratan Rendah (0.338). Penelitian juga menunjukan pentingnya struktur LKM sebagai bentuk pengorganisasian masyarakat, terbangunnya kapital sosial melalui proses rembug warga, adanya pemaknaan bersama (shared meaning) mengenai program diantara para relawan, tindakan komunikatif fasilitator didalam menterjemahkan pengetahuan teknis yang dibawa program serta peningkatan kapasitas relawan dan perencanaan anggaran deliberatif.
ABSTRACT
This thesis discusses the participation in the PNPM Mandiri Perkotaan. Participation is a central concept in the community development is seen as a process and a goal (as means to ends). The level of citizen participation in the development has implications for democracy and human rights in the program implementation. Based on a literature review and a theoretical mapping there were four independent variables associated with the dependent variable levels of voluntary participation in the PNPM Mandiri Perkotaan. The four independent variables are: Participative Leadership Style of KSM (X1), KSM Capacity Building (X2), KSM Assistance by Facilitator (X3) and KSM Funding Allocation (X4).

The purpose of this study was to test the hypothesis and the degree of relationship between the four independent variables (X1-X4) to the dependent variable (Y). This thesis uses quantitative methods, survey research techniques and supported by interviews. Samples were selected from the total population (total sampling) of all KSM Fisik in the Pesanggrahan District. Statistical test using pearson correlation with first tested the validity, reliability, normality, outliers, and linearity.

The test results showed the relationship between KSM participative leadership style variable is significant (sig = 0.035) to the level of KSM participation with degree of closeness low (0.210). Variable KSM Capacity Building significant (sig = 0.01) to the level of participation with degree of closeness low (0.314). Variable KSM Assistance by Facilitator significant (sig = 0.000) to the level of participation with a high degree of cohesion (0.772). While the BLM funding allocation variables were not significant (sig = 0.157) to the level of participation with a low degree of closeness (0.338). The study also shows the importance of the structure of KSM as a form of community organizing, social capital through the establishment of citizen deliberation (rembug), shared meaning of the program among volunteers, facilitators communicative action in translating technical knowledge and capacity building had brought by program to volunteers and deliberative budget planning.

Penelitian ini membahas mengenai internalisasi multikulturalisme di Sekolah dengan latar keagamaan yang berbeda. Lokasi penelitian adalah SMAI Al Izhar dengan latar keagamaan Islam dan SMA Kolese Gonzaga dengan latar keagamaan Katolik. Kedua Sekolah berlokasi di Jakarta Selatan. Penelitian ini denga menggunakan metode kualitatif dengan strategi studi kasus. pertama, untuk menjelaskan perbandingan internalisasi multikulturalisme di SMAI Al Izhar dan SMA Kolese Gonzaga yang memiliki latar keagamaan berbeda. Kedua, untuk menjelaskan mengenai praktik multikultural dilihat melalui pola-pola relasi yang terjalin antara aktor-aktor yang terlibat dalam proses internalisasi multikulturalisme di sekolah. Analisis mengenai internalisasi multikulturalisme dan praktik multikulturalisme di sekolah diketahui dari peran masing-masing aktor yang terlibat di sekolah yaitu, Kepala Sekolah (Pimpinan Sekolah), Guru, Karyawan, Peserta Didik dan Orang Tua Peserta Didik. Beberapa temuan yang didapat pada penelitian ini dapat digambarkan dalam beberapa aspek. Pertama, internalisasi multikulturalisme dipengaruhi oleh nilai keagamaan masing-masing sekolah yang mewujud pada visi, misi, dan core values. Kedua, internalisasi multikulturalisme kepada peserta didik dilakukan melalui kegiatan pembelajaran dan program-program yang dirancang sekolah. Ketiga, praktik multikulturalisme dilihat melalui pola-pola relasi yang terjalin antara aktor-aktor yang terlibat dalam proses internalisasi multikulturalisme di sekolah.
ABSTRACT
This study discusses the internalization of multiculturalism in school with different religious background. SMAI Al Izhar with Islamic religious background and SMA Kolese Gonzaga with Catholic religious background. Both of Schools are located in South Jakarta. This study using qualitative methods with case study strategy. The aims of this study are,first, to explain the internalization of multiculturalism in SMAI Al Izhar and SMA Kolese Gonzaga which has a different religious background. Second, to explain the practice of multicultural through the patterns of relationships that exist between the actors involved in the process of internalization of multiculturalism in schools. Analysis of the internalization of multiculturalism and the practice of multiculturalism in school known from the relationship pattern of each actor involved in the school. The actors are Vice Pronciples, Teachers, Students. Employees, and the parents of students. This study can describe in several aspects. First, internalization of multiculturalism influenced by religious values of each school as embodied in the vision, mission, and core values. Second, internalization of multiculturalism through learning activities and programs are designed by school. Third, the practice of multiculturalism through the patterns of relationshipsthat exist between the actors who involved in the process of internalization of multiculturalism in schools.

[Di dalam praktek sehari-hari, sering kita jumpai hutang piutang antara Debitor kepada Kreditor yang dijamin dengan Hak Tanggungan. Hubungan hutang piutang mensyaratkan adanya kewajiban dari Debitor untuk membayar utang beserta bunganya yang menjadi hak Kreditor. Jika Debitor wanprestasi, Kreditor mempunyai hak untuk menuntut pemenuhan piutangnya (hak eksekusi) terhadap harta kekayaan Debitur yang dipakai sebagai jaminan hutang. Dalam kaitannya dengan Hak Tanggungan tersebut, kalau terjadi wanprestasi, jalan keluarnya adalah dengan cara dilelang sesuai dengan ketentuan Pasal 6 UUHT maupun peraturan lelang. Lelang Hak Tanggungan dapat dilakukan berdasarkan Pasal 6 dan Pasal 14. Sesuai Pasal 6, permohonan lelang harus diajukan sendiri oleh bank langsung kepada Kantor Lelang, apabila Pasal 6 tidak dapat digunakan karena barangnya diguggat pihak lain maka Lelang Hak Tanggungan akan dilaksanakan melalui Pengadilan (Pasal 14), dalam hal pelaksanaan lelang Hak Tanggungan, Balai Lelang dapat berperan sesuai dengan kesepakatan dengan Kreditur. Jika lelang melalui Pengadilan, Balai Lelang dapat membantu Pengadilan yang bertindak sebagai pemohon, disini Balai Lelang dapat berperan dengan memberikan bantuan jasa-jasa pra dan pasca lelang kepada Kreditur untuk memperlancar pelelangan. Tetapi ternyata dalam peraturannya masih kurang jelas dan masih terdapat beberapa hambatan. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan teknik pengumpulan data melalui data primer dan sekunder. Untuk menghimpun data primer dilakukan dengan penetitian lapangan dengan menggunakan wawancara. Sedangkan data sekunder diperoleh dengan mengkaji bahan hukum primer dan bahan hukum sekunder, yang kemudian dianalisis dengan menggunakan teknik analisis kualitatif dan ditafsirkan secara logis dan sistematis yang kemudian ditarik kesimpulan.;In the daily practice, we often encounter between Debtor accounts payable to creditors secured by a Mortgage. Accounts payable relationship entails the obligation of the debtor to pay the debt with interest to consumption into creditor rights. If the debtor defaults, creditors have the right to demand the fulfillment of its accounts receivable (right execution) of the assets of the Debtor is used as collateral. In relation to the Mortgage, in case of default, the solution is to be auctioned in accordance with the provisions of Article 6 UUHT and auction rules. Auction Encumbrance can do under Article 6 and Article 14. According to Article 6, the petition must be filed by the auction bank directly to the Office of the Auction, if Article 6 can not be used because the goods diguggat other party then Auctions Encumbrance will be implemented through the Court (Article 14 ), in the case of auction Encumbrance, Auctioneer may act in accordance with an agreement with creditors. If the auction through the Court, Auctioneer may assist the Court that acted as the applicant, here Auctioneer may play a role by providing support services to the pre and post auction creditors to expedite the auction. But it turns out in the regulations are still unclear and there are still some obstacles. This study uses empirical juridical approach to data collection through primary and secondary data. To collect primary data by using interview penetitian field. [Dalam hal debitor wanprestasi, maka sudah selayaknya kreditor dapat langsung mengeksekusi objek jaminan tersebut melalui lelang. Saat pelaksanaan lelang, siapa saja dapat menjadi peserta lelang, kecuali yang bersangkutan termasuk dalam pihak-pihak yang dilarang sebagai peserta lelang, seperti yang tercantum dalam Pasal 49 ayat (1) PMK No. 40/PMK.07/2006 jo Pasal 69 PMK No. 93/PMK.06/2010. Penulis menganalisis bagaimana keabsahan lelang yang dimenangkan oleh karyawan kreditor beserta pertimbangan Hakim dalam putusan Nomor 1368K/Pdt/2011. Metode penelitian yang digunakan adalah yuridis normatif yaitu menelaah norma-norma hukum tertulis yang berkaitan dengan permasalahan yang diangkat dalam penelitian ini. Dalam penelitian ini tidak ditemukan peraturan yang secara khusus mengatur mengenai boleh atau tidaknya karyawan kreditor menjadi peserta lelang, yang berakibat munculnya dua putusan yang berbeda mengenai hal tersebut, yaitu putusan dalam tingkat pertama dengan putusan dalam tingkat banding dan kasasi. Namun, setelah Penulis menelaah lebih dalam mengenai hal tersebut, tidak ada satu ketentuan yang melarang karyawan kreditor menjadi peserta bahkan Pembeli dalam lelang. Karyawan tersebut dapat menjadi peserta bahkan menjadi pembeli dalam lelang selama yang bersangkutan telah memenuhi seluruh kewajibannya. Dengan demikian, lelang yang telah dilaksanakan pada tanggal 18 September 2007 yang memenangkan Tergugat IV selaku karyawan kreditor adalah sah dan tidak melanggar hukum

Currently the auction, anyone can become and join as a participant in the auction, except the concerned parties including the banned as a participant of the auction, as stated in Article 49 paragraph (1) PMK No. 40/ PMK.07/2006 in conjunction with Article 69 PMK No. 93/PMK.06/2010. The author analyzes how the validity of the auction, which was won by the creditor’s employees and how about the Judge’s consideration when made a decision No. 1368K/Pdt/2011. The method used is a normative juridical norms which examines the written law relating to the issues raised in this study. In this research, there’s no regulations specifically regarding whether or not the creditor’s employee become a participant in the auction, which resulted two different decisions from two different courts, there are Jakarta Timur’s district court with DKI Jakarta’s high court and the supreme court. However, after the author examines more deeply about that problem, there is no spesific regulation about the creditor’s employee banned as a participant in auction. As long as that employee can fulfilling all of their obligations they can become a participant or the winner of the auction. Therefore, the auction that was held on September 18, 2007 who won by the fourth defendant as a creditor’s employee is still valid because he doesn’t violates the law., In case when the debtor defaults, the creditor can directly execute the object of mortgage right. Abstrak :
[Gadai lahir karena penyerahan kekuasaan atas barang gadai dari pemberi gadai kepada pegadaian. Pegadaian BUMN adalah lembaga yang sah dalam melakukan usaha berdasarkan hukum gadai. Seiring dengan berkembangnya kebutuhan hidup masyarakat akan dana tunai, banyak pihak swasta yang juga mendirikan Pegadaian Swasta di Jakarta. Sehubungan dengan itu maka timbul permasalahan bagaimana pelaksanaan atau proses pegadaian pada pegadaian swasta di Jakarta, dan bagaimana perlindungan hukum pemberi gadai pada pegadaian swasta di Jakarta. Jenis penelitian tesis ini adalah penelitian hukum normatif, metode analisis data yang digunakan adalah kualitatif. Bentuk hasil penelitian ini adalah preskriptif analitis. Analisis data dilakukan dengan mengumpulkan data primer dan data sekunder selanjutnya dilakukan evaluasi dan analisis secara kualitatif untuk membahas permasalahan yang ada. Proses gadai pada pegadaian swasta yang ada di Jakarta bertentangan dengan KUH Perdata terutama dalam Pasal 1159 ayat (1) dan ayat (2) dan Pasal 1425 mengenai Hak Kompensasi. Dalam mengeksekusi barang gadai pegadaian swasta di Jakarta juga tidak sesuai dengan ketentuan KUHPerdata dan Vendu Reglement jo. Peraturan Menteri Keuangan Nomor 93/PMK.06/2010 tentang Petunjuk Pelaksanaan Lelang yang sebagaimana diubah dengan Peraturan Menteri Keuangan Nomor 106/PMK.06/2013. Dalam hal perlindungan hukum, pemberi gadai tidak mendapatkan perlindungan hukum yang memadai karena Pemerintah belum mengatur suatu ketentuan yang mengatur praktek pegadaian swasta.;Pawn was born since the handover of a pledged good from a pledgor to a Pawnshop. The Indonesian State Owned Enterprises Pawnshop is a legitimate institution that doing business under the law. Along with the needs of cash in life necessities, many individuals setting up their own private pawnshops in Jakarta. The aforementioned situation then raise questions on how these private pawnshops operate and how the legal protection of pledgors of private pawnshops in Jakarta. The type of the research is Normative Legal Research using qualitative analyzing data method. The form of the result of this study is Prescriptive Analytical. Data Analyzing was performed by collecting and evaluating primary data and secondary data. The research found that the practices of the private pawnshops in Jakarta violated the Civil Code Article 1159 verse (1) and verse (2) and also Article 1425 with regard to Compensation Rights. The execution of pledged goods of private pawnshops in Jakarta also did not conform with the auction provisions of the Civil Code and the Auction Act (Vendu Reglement) jo. the Minister of Finance Regulation Number 93/PMK.06/2010 on the Implementations of Auction Guidelines as already amended by the Minister of Finance Regulation Number 106/PMK.06/2013. [Tesis ini membahas mengenai hubungan hukum antara Balai Lelang dan Pejabat Lelang Kelas II baik berdasarkan Peraturan Menteri Keuangan yang terbit Tahun 2005 yaitu Peraturan Menteri Keuangan Nomor 118/PMK.07/2005 tentang Balai Lelang dan Peraturan Menteri Keuangan Nomor 119/PMK.07/2005 tentang Pejabat Lelang Kelas II maupun berdasarkan Peraturan Menteri Keuangan yang terbit Tahun 2010 yaitu Peraturan Menteri Keuangan Nomor 176/PMK.06/2010 tentang Balai lelang dan Peraturan Menteri Keuangan Nomor 175/PMK.06/2010 tentang Pejabat Lelang Kelas II. Penelitian ini adalah penelitian Yuridis Normatif, dengan metode analisis data kualitatif, serta tipologi penelitian eksplanatoris sehingga bentuk hasil penelitian adalah ekplanatoris-analitis. Permasalahan yang diangkat dalam penelitian ini adalah bahwa berdasarkan Peraturan Menteri Keuangan yang terbit Tahun 2005 maka Balai Lelang dalam menyelenggarakan Jasa Pelaksanaan Lelang wajib mengadakan perikatan perdata dengan Pejabat Lelang Kelas II mengenai pelaksanaan lelang dan honorarium Pejabat Lelang Kelas II. Namun kemudian ketentuan tersebut diubah dengan dikeluarkannya Peraturan Menteri Keuangan yang terbit Tahun 2010 di mana didalamnya diatur Balai Lelang selaku pemohon atau kuasa pemilik barang dapat mengadakan perjanjian perdata dengan Pejabat Lelang Kelas II mengenai pelaksanaan lelang dan imbalan jasa Pejabat Lelang Kelas II. Sejak diterbitkannya Peraturan Menteri Keuangan Tahun 2010 banyak keluhan yang muncul terutama dari pihak Balai Lelang dikarenakan Balai Lelang tentunya merasa lahan pekerjaannya jadi mengecil jika dibandingkan dengan ketentuan sebelumnya. Hasil penelitian kemudian menyimpulkan belum adanya harmonisasi yang baik antara Balai Lelang dengan Pejabat Lelang Kelas II. Tesis ini juga membahas hubungan hukum yang tepat yang dapat mengharmonisasikan hubungan Balai Lelang dengan Pejabat Lelang Kelas II.; This thesis discusses the legal relationship between the Auction House and the Second Class Auctioneer under the Minister Of Finance Regulations, published in 2005, namely Minister of Finance Regulation No. 118/PMK.07/2005 on Auction House and Minister of Finance Regulation No. 119/PMK.07/2005 on Second Class Auctioneer and based on the Regulation of the Minister of Finance, published in 2010, namely Minister of Finance Regulations No. 176/PMK.06/2010 on Action House and the Minister of Finance Regulation No. 175/PMK.06/2010 on Second Class Auctioneer. This research is a normative juridical research, with qualitative data analysis methods, as well as the typology of explanatory research that the forms results is a analytical ekplanatory research. Issues raised in this study is that based on the Regulation of the Minister of Finance, published in 2005, the Auctioneer in organizing Implementation Services Auctions shall hold a civil engagement with Second Class Auction Officer regarding the auction and honorarium Second Class Auction Officer. But then such provision amended by the enactment of the Finance Minister, published in 2010, where in regulated Auctioneer as the applicant or owner of the goods can hold power civil agreement with Second Class Auction Officer regarding the auction and auction fee of Second Class Auction Officer. Since the enactment of the Finance Minister in 2010 many complaints that arise mainly from the Party of Auction House, it because they certainly find their land of work be smaller when compared to the previous provisions. Results of the research concluded that there is a lack of harmonization between the Auction House and the Second Class Auction Officer. [Tesis ini membahas kepastian hukum atas batasan nilai gratifikasi sebagaimana diatur dalam Pasal 12B ayat (1) huruf b Undang-Undang Nomor 20 Tahun 2001 tentang Tindak Pidana Korupsi perihal nilai gratifikasi dibawah Rp 10.000.000,- (sepuluh juta rupiah), serta mengenai pelaksanaan lelang atas barang gratifikasi. Penelitian ini adalah penelitian hukum yuridis normatif yang bersifat ekplanatoris. Hasil penelitian menunjukkan bahwa terdapat banyak pengaturan mengenai nilai standar gratifikasi yang berbeda-beda. Muncul juga penafsiran gratifikasi yang tidak sesuai dengan UU Tindak Pidana Korupsi. Sehingga penulis menyarankan agar dilakukan unifikasi hukum nasional atas Pasal 12B ayat (1) huruf b UU Tindak Pidana Korupsi melalui peraturan pemerintah. Lelang Barang Gratifikasi dilakukan oleh Kementerian Keuangan melalui lelang non-eksekusi wajib, lelang dilakukan secara lelang terbuka dan terkadang melalui lelang internet.;This thesis analizes the legal certainty of the gratification limitation as regulated by Article 12B paragraph (1) letter b Law Number 20/2001 concerning Corruption Law the amount of gratification under Rp 10.000.000,- (ten million rupiah), as well as the auction of the gratification goods. This thesis is a explorative normative legal study. The study found many regulations give distinctive minimum amount of gratification. Furthermore, some intrepretation even dissent with the Corruption Law. Therefore, the writer suggests the goverment to make some unification of national law concerning the Article 12B paragraph (1) letter b Corruption Law through the enacment of Government Regulation.
