Pertumbuhan penduduk yang terus meningkat dari tahun ke tahun berbanding lurus dengan peningkatan kebutuhan akan hunian yang layak serta fasilitas pendukungnya yang lengkap namun berbanding terbalik dengan ketersediaan lahan yang dapat dikembangkan sebagai hunian, oleh karenanya pengembangan mixed-use properti merupakan solusi atas permasalahan kurangnya ketersediaan lahan. Bentuk penelitian yang digunakan adalah penelitian hukum normatif dengan metode studi kepustakaan. Peraturan perundang-undangan yang terdapat di Indonesia sebenarnya hanya mengenal istilah Rumah Susun, dan istilah-istilah yang lain merupakan istilah serapan dari bahasa asing yang digunakan oleh para pengembang dalam memasarkan produknya. Pada dasarnya UU 20/2011 sudah mengakomodir adanya konsep mixed-use properti. Hal ini dapat diperhatikan dalam ketentuan Pasal 50 serta penjelasan Pasal 50 huruf b UU Nomor 20 Tahun 2011 tentang Rumah Susun. Dalam setiap tahapan pengembangan mixed-use properti, terdapat aturan-aturan hukum yang tidak boleh dikesampingkan dan harus sangat diperhatikan, mulai dari tahapan pra-pembangunan, tahapan pembangunan, tahapan pasca-pembangunan. Dalam proses pengembangan mixed-use properti ini, terdapat beberapa permasalahan hukum yang perlu diperhatikan.Terkait studi kasus dimana penulis memilih pengembangan mixed-use properti di Daerah Istimewa Yogyakarta, adalah dikarenakan di daerah tersebut telah diterbitkan beberapa Peraturan Daerah, khususnya di Kabupaten Sleman, yang cenderung menambah permasalahan hukum dalam rangka mixed-use properti.
The increase of population growth from year to year and directly proportional to the increase in demand for proper-residential with complete facilities, but inversely proportional to the availability of land that can be developed as residential, therefore the mixed-use development property is a solution to the problem of the lack of land availability. Form of study is a normative legal research with the literature study method. Legislation in Indonesia was only familiar with the term of ?Rumah Susun?. Other terms are term uptake of foreign languages ​​used by developers in marketing their products. Basically Law 20/2011 already accommodate the concept of a mixed-use property. This can be noted in the provisions of Article 50 as well as the elucidation of Article 50 paragraph b of Law No. 20 of 2011 on the ?Rumah Susun?. In every stage of the development of mixed-use properties, there are rules of law that should not be ruled out and should be very concerned, ranging from pre-construction stages, development, stage, and post-development stages. In the process of developing a mixed-use properties, there are some legal issues that need to be noted. Related to the case study in which the authors chose the mixed-use development property in Daerah Istimewa Yogyakarta, is due in the area has issued several Regional Regulation, particularly in Sleman, which tends to add to the legal issues in the framework of a mixed-use development property.

ABSTRAK
Pengembangan Mix Land Use merupakan salah satu bagian kebijakan yang ditujukan untuk meningkatkan kualitas perkotaan, salah satunya dalam pemenuhan kelangkaan (scarcity) lahan fasilitas publik. Penelitian ini bertujuan untuk mengidentifikasi pola pemanfaatan ruang dengan konsep Mix Land Use sehingga pemanfaatan ruang akan optimal dalam pemerataan pelayanan pendidikan dan kesehatan, serta melihat autokorelasi spasial keberadaan fasilitas prasarana pendidikan dan kesehatan terhadap penetapan NJOP. Penelitian dilakukan berdasarkan data GIS di Kota Batam dengan metode analisis yang digunakan adalah Analisis Entropy; Analisis Skalogram dan Indeks Marshal; serta Analisis Gap. Untuk melihat faktor-faktor determinan yang mempengaruhi NJOP dan autokorelasi spasial NJOP digunakan metode Analisis Model Panel dan Indeks Moran dengan Stata 14. Hasil penelitian ini mengidentifikasi lebih dari 50% pemanfaatan ruang di Pulau Batam yang berkonsep zoning berubah kearah pola pemanfaatan Mix Land Use. Karakteristik wilayah yang memanfaatkan pola Mix Land Use adalah: 1) merupakan kecamatan dengan hirarki pelayanan tinggi; 2) memiliki prasarana pendidikan dan kesehatan yang lebih lengkap dan tersebar secara merata untuk dapat diakses oleh masyarakat; 3) gap kebutuhan akan prasarana pendidikan dan kesehatan lebih kecil. Variabel kepadatan penduduk menjadi faktor yang dominan mempengaruhi NJOP, sedangkan keberadaan prasarana pendidikan dan kesehatan tidak menjadi memberikan pengaruh signifikan. Dalam analisis spasial menunjukkan adanya autokorelasi spasial penetapan NJOP antar kecamatan. Hasil studi ini merekomendasikan perlunya penerapan konsep Mix Land Use dalam penyusunan Perda RTRW Kota Batam serta perlunya Pemerintah Pusat melakukan peninjauan ulang terhadap pemberlakuan sistem sewa tanah di Kota Batam sehingga dapat dilakukan reformulasi penetapan nilai NJOP sebagai potensi peningkatan Pendapatan Asli Daerah (PAD).
ABSTRACT
Mix Land Use has become one of the key planning strategies at improving the quality of urban areas, especially fulfillment scarcity of public facilities area. This research aims to identify the patterns of spatial use with the concept of Mix Land Use in order to optimalization the use of space within equal distribution of education and health well as see the spatial correlation within the existence of education infrastructure facilities and health to the NJOP determination. The research was conducted based on the GIS data in Batam City with an analytical methods used are Entropy Analysis; Schallogram Analysis and Marshal Index; and Gap analysis. To see the spatial correlation are used Panel and Moran?s Index with Stata 14. The results of this research identified more than 50% the use of space on Batam city with the concept Zoning to turn toward adopt Mix Land Use pattern. Characteristics of the region that used Mix Land Use are: 1) is a district with a high service hierarchy; 2) have the education and health infrastructure which is more detailed and spread equally to be accessible for the public; 3) The necessity gap between education and health infrastructure are smaller. In the spatial analysis shows the spatial correlation of NJOP determination between regions, but the existence of education and health infrastructure does not affect the formulations on the value of NJOP determination. The results of these studies, recommends the need of review the Mix Land Use in RTRW Batam City as well as the the need for the Central Government to conduct a review of the implementation of the land lease system in Batam, as well as the fixing the reformulation NJOP as the potential for increased Original Local Income (PAD).

ABSTRAK Tesis ini membahas tentang pengembangan bangunan mixed-use skala besar Pancoran Chinatown Point di kawasan Pecinan Pancoran yang bersejarah. Kawasan Pecinan yang umumnya terdiri dari bangunan mixed-use skala kecil berupa rukoruko dengan fungsi retil dan hunian, mendapat pengaruh dari adanya perubahan jaman dan dinamika perkembangan kawasan, yang menuntut adanya peningkatan kapasitas dan kemampuan kawasan. Hal ini diaplikasikan dalam pengembangan bangunan mixed-use modern dengan konsep retil dan hunian berbentuk vertikal dengan tingkat kepadatan yang lebih besar, hemat lahan, dan lingkungan yang lebih berkarakter serta ramah pedestrian, yang berpengaruh pada nilai properti di kawasan.
ABSTRACT This thesis discusses about the development of Pancoran Chinantown Point, a large scale mixed-use building located in the Historical Pancoran Chinatown area. Chinatown area often consist of small scale mixed-use buildings, in the form of shop houses for commercial and residential purposes, profoundly influenced by globalizational impacts from economic, cultural and other aspects, that requires to expand and increase the spatial forms of the area. This was applied to the development of large scale mixed-use buildings by increasing the level of density, space efficiency, friendly pavement and cultural value of the area. That eventually raised property value.

The development of the area in Bowen Hills is one of the main factors to promote and level the economy in Brisbane so that it is not only focused on the Brisbane City area. Previously, the Bowen Hills area was a residential area with minimum function for commercial or office use. Therefore, the local government created an equalization program in the area around downtown Brisbane City. Changes in the function of new buildings are one factor in this development program with the aim of attracting more people to live and work in Bowen Hills. Architecture is an essential part of the development of programs carried out by the local governments. Using the mixed-use building concept, the building that will be developed in the Bowen Hills area will be a suitable facility due to the efficiency of the building area that can be used for many functions. In this case, the building to be developed is targeted to be commercial and residential. Sustainability is one of the most critical factors in the building development process. With some analysis and architectural programs, Brisbane One Tower has become friendly to the environment and the surrounding community. Therefore, the idea of ​​developing Brisbane One Tower will have a positive impact and answer the economic development program in Bowen Hills. ...... Pengembangan kawasan di Bowen Hills menjadi salah satu faktor utama untuk memajukan dan meratakan perekonomian di Brisbane agar tidak hanya terfokus di kawasan Kota Brisbane. Sebelumnya, kawasan Bowen Hills merupakan kawasan pemukiman dengan fungsi minimal untuk komersial atau perkantoran. Oleh karena itu, pemerintah setempat membuat program pemerataan di kawasan sekitar pusat kota Brisbane City. Perubahan fungsi gedung baru menjadi salah satu faktor dalam program pembangunan ini dengan tujuan untuk menarik lebih banyak orang untuk tinggal dan bekerja di Bowen Hills. Arsitektur merupakan bagian penting dari pengembangan program yang dilakukan oleh pemerintah daerah. Dengan menggunakan konsep mixed-use building, gedung yang akan dikembangkan di kawasan Bowen Hills akan menjadi fasilitas yang sesuai karena efisiensi area gedung yang dapat digunakan untuk banyak fungsi. Dalam hal ini, bangunan yang akan dikembangkan ditargetkan untuk komersial dan residensial. Keberlanjutan adalah salah satu faktor terpenting dalam proses pembangunan gedung. Dengan beberapa program analisis dan arsitektur, Brisbane One Tower menjadi ramah lingkungan dan masyarakat sekitar. Oleh karena itu, ide pembangunan Brisbane One Tower akan berdampak positif dan menjawab program pembangunan ekonomi di Bowen Hills.

Skripsi ini membahas hubungan yang dapat terjadi dari pembangunan kawasan mixed use dalam potensinya mencapai keberlanjutan sosial di kawasan perkotaan. Untuk membahas potensi tersebut, dilakukan kajian teori tentang kawasan mixed use, melingkupi definisi, sejarah, faktor-faktor yang mempengaruhi, dampak yang dihasilkan, dan contoh penerapan dan isu yang muncul dari kawasan mixed use di berbagai negara. Setelah itu, dilakukan kajian teori keberlanjutan sosial melingkupi definisi, indikator dalam mengukur keberlanjutan sosial, serta peran faktor fisik dan non fisik dalam mencapai keberlanjutan sosial. Merujuk pada kajian kedua teori tersebut, kemudian dilakukan analisis kawasan mixed use dengan potensinya dalam mencapai keberlanjutan sosial, hal ini melingkupi hubungan antara kawasan mixed use dan keberlanjutan sosial, keuntungan sosial dari kawasan mixed use, dan mengukur keberhasilan kawasan mixed use dalam mencapai keberlanjutan sosial. Berdasarkan kajian teori dan analisis yang dilakukan, ditemukan bahwa pembangunan kawasan mixed use berpotensi dalam mencapai keberlanjutan sosial di perkotaan. Hal ini ditunjukkan dari hasil analisis bahwa manfaat yang dihasilkan oleh kawasan mixed use merupakan faktor-faktor yang dapat membangun keberlanjutan sosial di perkotaan. ......This study discusses the relation that may happen between mixed use area development in its potential to achieve social sustainability in urban context. To examine that potential, the way is by doing theoretical study about mixed use area, including the definition, the history, factors influencing it, the impacts that may happen, and precedent studies with their issues coming from mixed use area implementations in various countries. Afterwards, theoretical study about social sustainability is done, including the definition, indicators used to measure social sustainability, and the role of physical and non physical factors in achieving social sustainability. Referring to those studies, the next thing done is to analyze mixed use area in its potential to achieve social sustainability, this analysis includes the relation between mixed use area and social sustainability, the social advantages from mixed use area development, and measuring the success of mixed use area development in achieving social sustainability. Based upon the studies and analysis done, it is found that mixed use area development is potential to achieve social sustainability in urban context. This is shown by the analysis that shows mixed use area development generates advantages that are the factors to achieve social sustainability in urban context.

Skripsi sarjana ini mencakup eksplorasi solusi arsitektur berkelanjutan, seiring dengan menjaga nilai-nilai etika. Mengakui dampak besar lingkungan binaan terhadap perubahan iklim dan mengambil tanggung jawab untuk mempromosikan masa depan yang lebih hijau dan berkelanjutan. Tujuan dari penelitian ini adalah untuk mengatasi masalah berkelanjutan baik secara lingkungan maupun sosial di Bowen Hills, Brisbane, Australia melalui desain kontekstual spasial dan berbasis penelitian. Studi literatur, metode kualitatif, dan kuantitatif digunakan untuk skripsi ini. Perusahaan Daerah yang mengelola pasar tradisional di DKI Jakarta perlu melakukan diversifikasi sumber pendanaan dengan mengajak pihak swasta untuk berinvestasi dalam peremajaan sekaligus pengembangan pasar tradisional yang sesuai dengan tuntutan perkembangan perkotaan dan lingkungan sekitar. Implementasi dari investasi tersebut yaitu Pembangunan dan Pengembangan Pasar ABC dengan konsep mixed-use yang dibentuk dari sebuah ikatan kerjasama antara Pemerintah (PD Pasar Jaya) dengan Swasta. Pembagian profit sharing atas investasi tersebut antara pihak public dan pihak private dinilai belum proposional, dikarenakan nilai profit sharing belum memperhitungkan faktor-faktor risiko. Penelitian ini bertujuan untuk mengetahui risiko, alokasi risiko dan mitigasinya serta profit sharing berbasis alokasi risiko dari proyek Pasar ABC. Metode penelitian ini menggunakan metode deskriptif dan melakukan wawancara dengan responden terkait, kemudian melakukan analisa kualitatif melalui risk assesment sampai dengan analisis finansial untuk menentukan profit sharing optimal berbasis alokasi risiko yang optimal. Untuk nilai profit sharing berbasis alokasi risiko optimal diperoleh dari hasil analisis cashflow after adjust risk yaitu sebesar Rp 264.231.751.000 turun sebesar Rp 323.729.417.000 dari cashflow before risk. Faktor-faktor risiko dapat menurunkan kinerja profit sharing Proyek Pasar ABC.

Local companies that manage the traditional markets in DKI Jakarta need to diversify sources of funding to persuade the private sector to invest in the rejuvenation and the development of traditional markets in suitable with the demands of urban development and environment. Implementation of these investments, namely the construction and development ABC Market with mixed-use concept which is formed from a bond of cooperation between the Government (PD Pasar Jaya) with Private sector. The distribution of profit sharing on investment between the public and private parties is considered not proportional, because the value of profit sharing did not measure the risk factors. This study aims to determine risk, risk allocation and mitigation as well as profit-sharing based on the risk allocation of the ABC Market project. This research method using descriptive method and conduct interviews with related respondents, then perform a qualitative analysis through risk assessment to the financial analysis to determine the optimal profit-sharing based on the optimal risk allocation. For value of profit sharing based on optimal risk allocation is obtained from the analysis outcome of cash flow after adjust risk which to Rp 264.231.751.000 decreased into Rp 38.729.417.000 from cashflow before risk. Dengan maksud mempersingkat waktu proses persiapan dan pelaksanaan tender, maka dipilihlah sistem kontrak rancang bangun (design and build) untuk proyek Mixed Use Building. Namun pada pelaksanaannya, muncul banyak klaim yang diajukan oleh kontraktor sehingga menyebabkan dispute diantara para stakeholder terkait yang seharusnya dapat diminimalkan dengan melakukan manajemen kontrak yang tepat. Penelitian ini bertujuan untuk mengetahui strategi manajemen kontrak konstruksi design and build yang tepat pada proyek Mixed Use Building berdasarkan CMBOK dengan melakukan survey dan interview pakar. Pada penelitian ini diperoleh sistem manajemen kontrak rancang bangun (design and build) yang berbasis resiko.
